RESOLUTION NO. R-88-
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE THE FIFTH
AMENDMENT TO INTERLOCAL AGREEMENT WITH
BROWARD COUNTY PROVIDING FOR DIVISION AND
DISTRIBUTION OF THE PROCEEDS OF THE LOCAL
OPTION GAS TAX IMPOSED BY THE BROWARD
COUNTY LOCAL OPTION GAS TAX ORDINANCE; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute the Fifth Amendment to
Interlocal Agreement with Broward County providing for
division and distribution of the proceeds of the local option
gas tax imposed by the Broward County Local Option Gas Tax
Ordinance, a copy of said Agreement being attached hereto as
"Exhibit 1".
SECTION 2: This Resolution shall become effective upon
adoption.

LOCAL OPTION GAS TAX ORDINANCE
This is the Fifth Amendment to the Interlocal Agreement, made and
entered into by and between: BROWARD COUNTY, a political subdivision of
the State of Florida, hereinafter referred to as "COUNTY,"

CITY OF TAMARAC, a municipal corporation, existing under the laws of
the State of Florida, hereinafter referred to as "CITY."
WHEREAS, Section 336.025(1)(b), Florida Statutes (1987), authorizes the
counties to extend the levy of the six (6) cent local option gas tax upon
every gallon of motor fuel and special fuel sold in Broward County for a
period not to exceed thirty (30) years on a majority vote of the governing
body of the COUNTY; and
isWHEREAS, both Broward County's four (4) cent local option gas tax and
its additional five (5) and six (6) cent local option gas tax will expire on
August 31, 1988; and
WHEREAS, prior to July 1, 1988, the Board of County Commissioners will
consider enactment of an ordinance to be effective September 1, 1988,
through August 31, 2018, pursuant to said enabling legislation, extending the
levy of the entire six (6) cent local option gas tax; and
WHEREAS, Section 336.025(3) (a), Florida Statutes (1987), requires such
ordinance to provide for a method of distribution of the proceeds of this tax;
and
WHEREAS, one such method is the execution of an interlocal agreement,
prior to June 1, with one or more of the municipalities representing a majority
of the population of the incorporated area within the county which establishes
the distribution formulas for dividing the proceeds of the tax among the
county and all eligible municipalities within the county, as set forth in Section
• 336.025(3)(a)1., Florida Statutes (1987); and

WHEREAS, the parties hereto have agreed to apply the distribution
formula existing under the terms of said Interlocal Agreement and the Adden-
dum thereto to such six (6) cent local option gas tax for the extension of said
tax through August 31, 2018; and
WHEREAS, paragraph 4 of the Interlocal Agreement, as amended by the
Addendum to the Interlocal Agreement, requires annual adjustment of the
population of the individual municipalities and unincorporated Broward County
in accordance with the population figures set forth in the most current edition
of "Florida Estimates of Population," published by the Bureau of Economics and
Business Research, Population Division, University of Florida; NOW, THERE-
FORE,
IN CONSIDERATION ofthemutualterms, conditions, promises, covenants
and premises set forth herein, the COUNTY and the CITY agree as follows:
1. Paragraph 2of said Interlocal Agreement, as amended, isfurtheramended
to read as follows:
2. Sixty-two and one-half percent (62.5%) of said Local Option
Gas Tax proceeds shall be distributed to the COUNTY and
the remaining thirty-seven and one-half percent (37.5%)
shall be divided among and distributed to the eligible
municipalities within the COUNTY as follows:

3. Paragraph 6 of the I nterlocaI Agreement, as amended, is amended to read
as follows:
This Agreement shall be in effect from September 1, 1983,
to August 331-,- 148&August 31, 2018, both inclusive. It
shall also govern the division and distribution of proceeds
of the Local Option Gas Tax imposed through A-ugust-3-1;
4988 August 31, 2018, but not collected or otherwise not
available for distribution until after A-ugast-317-1988
Auaust 31. 2018.
4. The parties to this Amendment expressly agree that should the Board of
County Commissioners enact an ordinance providing for a thirty-year
extension of the levy of the six (6) cent local option gas tax pursuant
to Section 336.025, Florida Statutes (1987), upon every gallon of motor
