RESOLUTION NO.
A RESOLUTION OF THE CITY OF TAMARAC APPROVING
AND ACCEPTING A RIGHT OF WAY DEED FOR 40-FEET
ALONG LOTS 22 AND 23, BLOCK 11, AS RECORDED
IN PLAT BOOK 76 AT PAGE 31, LYONS COMMERCIAL
SUBDIVISION *3, ALONG UNIVERSITY DRIVE
OFFERED BY PHILIP FRYBERGH, PREVIOUS OWNER &
TAMARAC FORTUNE LIMITED PARTNERSHIP, PRESENT
OWNER FOR THE UNIVERSITY PARK OFFICE CENTER
PROJECT; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA;
That the Right of Way Deed for 40-Feet
along Lots 22 and 23, Block 11, Lyons Commercial Subdivision
*3, Plat Book 76 at Page 31, along University Drive offered
by Philip Frybergh, previous owner & Tamarac Fortune Limited
Partnership, present owner for the University Park Office
Center Project, is HEREBY APPROVED and accepted, a copy of
said deed and Legal Survey are attached hereto and
Incorporated herein as Exhibits "1" and "2" respectively;
SECTION 2 The City Clerk is hereby authorized and

directed to record said Deed in the Public Records of Broward
County.
SECTION 3 This Resolution shall become effective
immediately upon Its passage.

TO THE CITY OF TAMARAC
STATE OF FLORIDA
COUNTY OF BROWARD
THIS INDENTURE, made this 16th day of May, 1988, by and
between TAMARAC FORTUNE LIMITED PARTNERSHIP, a Florida limited
partnership, by WEISERT FORTUNE CORPORATION, a Florida
corporation, its General Partner, whose address is 2415 loth
Avenue North, Lake Worth, Florida, 33461, party of the first
part, UNIVERSITY OFFICE PARK, INC., a Florida corporation, whose
address is 7800 University Drive, Penthouse, Tamarac, Florida,
33321, as to whatever interests it may have, and the CITY OF
TAMARAC, a municipal corporation of the State of Florida, and its
successors in interest, whose principal place of business is 5811
Northwest 88th Avenue, Tamarac, Broward County, Florida, 33321,
party of the second part.
W I T N E S S E T H:
That the said party of the first part, for and in
consideration of the sum of One Dollar ($1.00) to it in hand paid
by the party of the second part, receipt whereof is hereby
acknowledged, and for other and further good and valuable
consideration, does hereby grant, bargain and sell to the party
of the second part, and its successors in interest, for the
purpose of a public road right-of-way and purposes incidental
thereto, the following described land, situate, lying and being
in the County of Broward, State of Florida, to wit:
The West Forty (40) feet of Lots 22 and 23, in
Block 11, LYONS COMMERCIAL SUBDIVISION NO. 3, according
to the Plat thereof, as recorded in Plat Book 76, at
Page 31, of the Public Records of Broward County,
Florida, and
as further described on Exhibit "A" attached
hereto.
It is the intention of the party of the first part by this
instrument to convey to the said City, and its successors in
interest, the land above described for use as a public road
right-of-way and for all purposes incidental thereto.
The said party of the first part will defend the title to
said land against the lawful claims of all persons whomsoever,
claiming by, through or under it.
IN WITNESS WHEREOF, the said party of the first part has
signed and sealed these presents on this, the day and year first
above written.
