RESOLUTION NO. R-88-
A RESOLUTION RESCINDING RESOLUTION #R-87-408
WHICH APPROVED AND AUTHORIZED THE APPROPRIATE
CITY OFFICIALS TO EXECUTE THE ASSIGNMENT OF AN
EASEMENT OFFERED BY THE CITY OF TAMARAC TO
BROWARD COUNTY FOR THE 201 FORCE MAIN PROJECT
86-5; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE A CORRECTED ASSIGNMENT OF
AN EASEMENT FOR PROJECT 86-5; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council, on December 23, 1987 adopted
Resolution #R-87-408 which approved and authorized the
appropriate City officials to execute the assignment of an
easement offered by the City of Tamarac to Broward County for
the 201 Force Main Project 86-5; and
WHEREAS, #R-87-408 was recorded in the public records of
Broward County with an incorrect Exhibit attached.
WHEREAS, the City Council is desirous of executing a new
Assignment of an Easement to Broward County from the City of
Tamarac for the 201 Force Main Project 86-5 with a corrected
Exhibit attached.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Resolution #R-87-408 which approved the
Assignment of an Easement offered by the City of Tamarac to
Broward County for the 201 Force Main Project 86-5 is hereby
rescinded.
SECTION 2: That the appropriate City officials are
hereby authorized to execute a corrected Assignment of an
Easement for Project 86-5.
SECTION 3: This Resolution shall become effective
immediately upon its passage.

WHEREAS the first party has been granted Water and Sewer Utility

Force Main utility and/or other appropriate purposes incidental

to the other running and one dollar and other good and valuable
considerations, the first party does hereby grant unto the party of
the second part, its successors and assigns, full and free right and
authority to construct, maintain, repair, install and rebuild
facilities for above stated purposes and does hereby assign a
perpetual easement on, over and across the above described easement
for said purposes.
