R-88- 3 A RESOLUTION ISSUING REVISED DEVELOPMENT 4 ORDER NO. 174-8 FOR FRIEDES COMMERCIAL CENTER PROJECT FOR A REVISED SITE PLAN *� PURSUANT TO THE PROVISIONS OF SECTION 7-2 THROUGH 7-11 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City 8 Council of Tamarac, Florida, a public meeting has been .g advertised in accordance with applicable law of the date, 10 time and place of the meeting regarding the review of the 11 application for a revised development order by the applicant 12 for development approval; and 13 WHEREAS, the City Council has examined and investigated 14 the application, staff and Planning Commission recommenda-- 15 tions, and the attached Development Review Status Sheet dated 16 June 2, 1988; and 17 WHEREAS, the City Council reviewed the revised develop- ment order at a public meeting; and WHEREAS, the City Council has determined that the 20 application is in compliance with all elements of the Compre- 21 hensive Plan, or will be in compliance prior to the issuance 22 of a Certificate of Occupancy for the development that is the 23 subject of the ap plication. pplication. 24 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 25 TAMARAC, FLORIDA: 26 SECTION 1: That the application for approval of a 27 revised site plan for Friedes Commercial Center, prepared by 28 Ralph. D. Denuzzio & Associates, Incorporated, revised on May 29 31, 1988, reflecting color changes and an additional curb cut 30 for a right turn lane and entranceway, is HEREBY APPROVED subject to the following conditions: J2 A. Construction is to be in compliance with the plans 33 and specifications submitted by the developer to the City of 34 Tamarac as described in Section II of the Development Review 35 Status Sheet and approved engineering drawings. 1 Iz Temp. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: Subject to execution of agreement regarding site plan and sign. SECTION 2: Should any section or provision of this revised development order by declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
