R-88-v2c,7 A RESOLUTION ACCEPTING A SEWER UTILITY EASE- MENT OFFERED BY CF HOLDINGS, INC. FOR THE CALIFORNIA FEDERAL SAVINGS AND LOAN ASSOCIA- TION CONSTRUCTION SITE ON ROCK ISLAND ROAD; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac adopted Resolution R-86-105 on March 26, 1986 accepting a Sewer Utility Easement from C.F. Holdings, Inc. for the California Federal Savings and Loan Association construction site on Rock Island Road and, WHEREAS, said Sewer Utility Easement was never recorded in the public records of Broward County, Florida and, WHEREAS, the City Council of the City of Tamarac wishes to reaffirm its acceptance of a Sewer Utility Easement from California Federal Savings and Loan Association constriction site on Rock Island Road and record same in the public records of Broward County, Florida, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That the Sewer Utility Easement offered by California Federal Savings and Loan Association for the construction site on Rock Island Road is HEREBY APPROVED and accepted, a copy of said Easement being attached hereto as Exhibit "1". 1 2 3 4 5 8 10 11 Mwd 13 14 15 16 17 18 LU 21 22 23 24 25 26 27 28 29 30 33 34 35 SECTION 2 The City Clerk is hereby authorized and directed to record said Sewer Utility Easement in the public records of Broward County, Florida. The provisions of this easement shall be binding on the rties hereto and the respective successors and assigns as a covenant running with and binding upon the servient estate.. 4.
