RESOLUTION NO. R-88-a2_9�5_
A RESOLUTION APPROVING AND ACCEPTING A
5-FOOT UTILITY EASEMENT OFFERED BY THE
CITIZENS AND SOUTHERN NATIONAL BANK OF
FLORIDA, N.A., LOTS 5 AND 6, TAMARAC
BUSINESS CENTER, FOR THE CITIZENS AND
SOUTHERN NATIONAL BANK OF FLORIDA, N.A.;
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the 5-foot utility easement offered by
The Citizens and Southern National Bank of Florida, N.A., for
The Citizens and Southern National Bank of Florida, N.A.
project, is HEREBY APPROVED AND ACCEPTED, a copy of said
easement being attached hereto as "Exhibit 1".
SECTION 2: That the appropriate City officials are
hereby authorized to execute said easement on behalf of the
�) City.
SECTION 3: That the City Clerk is hereby authorized and
directed to record said easement in -the public records of
Broward County, Florida.
SECTION 4: This Resolution shall become effective upon
adoption.
PASSED, ADOPTED AND APPROVED this day of

PUBLIC UTILITY BASEMENT
FOR THE CITIZENS AND SOUTHERN
NATIONAL BANK OF FLORIDA, N.A.
THIS INDENTURE made this day of6cn
A.D., 1988 by THE CITIZENS AND SOUTHERN NATIONAL BANK OF FLORIDA,
N.A. and having its principal place of business at a�4E
first party, and CITY OF TAMARAC at 7525 Northwest 88 Avenue,
Tamarac, Florida 33321, a municipal corporation of the State of
Florida, second party:
(Wherever used herein, the terms, "first party" and
"second party" shall include singular and plural,
heirs, legal representatives and assigns of
individuals and the successors and assigns of
corporations, wherever the context so admits or
requires).
WITHESSETH
WHEREAS, the first party is the fee simple owner of that
parcel of real property, a legal description of which is attached
hereto as Exhibit "A", and incorporated by reference herein,
0 (hereinafter "the servient estate"); and
WHEREAS, the second party desires an easement for a public
utility or other appropriate purposes incidental thereto, under,
on, over and across a portion of the servient estate, a legal
description of which easement portion is attached hereto as I PC
Exhibit "B" and incorporated by reference herein, (hereinafter Q
"the easement area"); and

WHEREAS, the first party is willing to grant such easement.
NOW, THEREFORE, for and in consideration of the mutual '^
covenants each to the other running and one dollar and other good
and valuable considerations, the first party does hereby grant
unto the party of the second part, its successors and assigns,
full and free right and authority to construct, maintain, repair,
install and rebuild facilities for the above purposes and does
hereby grant a perpetual easement under, on, over and across the
above -described easement area property described in Exhibit "B"
for said purposes.

the Plat thereof, as recorded in Plat Book 61, Page 27, of the
Public Records of Broward County, Florida, lying 5 feet North of
and parallel with the following described property:
Beginning at the Southeast corner of said Lot 6; thence Westerly
along the South line of said Lots 6 and 5 and along a curve to
the right whose tangent bears North 85°57'48" West with a radius
of 2814.79 feet in a central angle of 4°05'41", an arc distance
