RESOLUTION NO. R-88- 206
A RESOLUTION ISSUING DEVELOPMENT ORDER NO.
248 FOR TAMARAC SPORTS'COMPLEX PROJECT FOR
A REVISED SITE PLAN PURSUANT TO THE
PROVISIONS OF SECTIONS 7-2 THROUGH 7-11 OF
THE TAMARAC CODE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City
Council of Tamarac, Florida, a public meeting has been
advertised in accordance with applicable law of the date,
time and place of the meeting regarding the review of the
application for a development order by the applicant for
development approval; and
WHEREAS, the City Council has examined and investigated
the application, staff and Planning Commission recommenda-
tions, and the attached Development Review Status Sheet dated
November 2, 1988; and
WHEREAS, the City Council reviewed the development order
and accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the
application is in compliance with all elements of the Compre-
hensive Plan, or will be in compliance prior to the issuance
of a Certificate of Occupancy for the development that is the
subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the application for approval of a
revised site plan for Tamarac Sports Complex, prepared by
Scharf & Associates, Incorporated, revised on August 3, 1988,
reflecting a pavilion and concession stand located at the
northeast corner of Northwest 77 Street and Nob Hill Road, is
HEREBY APPROVED, subject to the following conditions:
A. Construction is to be in complete compliance with
the plans and specifications submitted by the developer to
the City of Tamarac as described in Section II of the
Development Review Status Sheet and approved engineering
drawings.

B. Commencement of construction shall be no longer
than one year from the date of this approval. If the
development does not commence construction within one year,
this approval is null and void unless an extension has been
granted in accordance with applicable regulations.
C. The development order is assignable, but an assign-
ment does not discharge any assignee from strict compliance
with the order unless the City Council consents to modify any
of the original requirements.
D. Additional conditions established in order to issue
the development order are set forth as follows:
NONE -
SECTION 2: Should any section or provision of this
development order be declared by a court of competent juris-
diction to be invalid, the City Council shall determine if
the other portions of the order remain valid or,whether the
approval shall be null and void.
SECTION 3: This development order as conditioned shall
become effective immediately upon its passage.

ITEM 5: CONSIDERATION AND POSSIBLE ACTION REGARDING A REVISED SITE PLAN FOR
CITY OF TAMARAC SPORTS COMPLEX LOCATED AT TRACT 27 FOR THE ADDITION
OF A CONCESSION STAND. MF 13-85 (NE corner Nob Hill Rd and NW 77 St.)
Mr. Von Hofen explained the drawing to the Commission and advised them that at
this time, the revision is only for the concession stand and the Pavilion
only. Commissioner Silvestri wanted to know if the pavilion and concession
would be open all the time and was advised only for special events. The
question regarding who would operate the concession was made by Commissioner
Schumann and it was stated that the City would handle the operation. Then
Commissioner Schrieber asked why we are approving only the pavilion and concession
stand now - if the entire facility is not ready for site plan approval and the
answer was that the bathrooms and pavilion are needed now. Commissioner Levine
asked about the size and wondered if it was large enough and Mr. Von Hofen-said that
for crowd control, it was better to have a smaller counter, he added that they
proposed a twelve foot counter. Commissioner Winter MOVED to APPROVE the Revised
Site Plan for the Tamarac Sports Complex, Commissioner Levine SECONDED.
VOTE: ALL VOTED AYE
