2 A RESOLUTION ISSUING DEVELOPMENT ORDER NO.
229 FOR NOB HILL/WESTWOOD PLAT (PEBB
3 ENTERPRISES) FOR A PLAT PURSUANT TO THE
PROVISIONS OF SECTIONS 7-2 THROUGH 7-11 OF
4 THE TAMARAC CODE; AND PROVIDING AN
5 EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City
Council of Tamarac, Florida, a public meeting has been
8 advertised in accordance with applicable law of the date,
_g time and place of the meeting regarding the review of the
10 application for a development order by the applicant for
11 development approval; and
12 WHEREAS, the City Council has examined and investigated
13 the application, staff and Planning Commission recommenda-
14 tions, and the attached Development Review Status Sheet dated
15 February 19, 1988; and
16 WHEREAS, the City Council reviewed the development order
17 and accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the
application is in compliance with all elements of the Compre-
20 hensive Plan, or will be in compliance prior to the issuance
21 of a Certificate of Occupancy for the development that is the
22 subject of the application.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24 CITY OF TAMARAC, FLORIDA:
25 SECTION 1: That the development described on the
26 attached Development Review Status Sheet dated February 19,
27 1988, is granted a development order to proceed subject to
28 the following conditions:
29 A. Construction is to be in complete compliance with
30 the plans and specifications submitted by the developer to
the City of Tamarac as described in Section II of the
3[' Development Review Status Sheet and approved engineering
33 drawings.

B. Commencement of construction shall be no longer
than one year from the date of this approval. If the
development does not commence construction within one year,
this approval is null and void unless an extension has been
granted in accordance with applicable regulations.
C. The development order is assignable, but an
assignment does not discharge any assignee from strict
compliance with the order unless the City Council consents to
modify any of the original requirements.
D. Additional conditions established in order to issue
the development order are set forth as follows:
SEC 0 That the following documents are hereby
accepted and approved as a part of this development order:
Water Retention Agreement
Development Review Agreement
SECTION 3 : Should any section or provision of this
development order be declared by a court of competent
jurisdiction to be invalid, the City Council shall determine
if the other portions of the order remain valid or whether
the approval shall be null and void.
_ 110N 4:_ This development order as conditioned shall
become effective immediately upon its passage.
