CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-86-2-YI/O
A RESOLUTION ISSUING DEVELOPMENT NO. 174-1
FOR A REVISED SITE PLAN FOR TAMARAC SQUARE
WEST REFLECTING ELIMINATION OF AN OUTPARCEL
AND ADDITIONAL PARKING; AND PROVIDING AN
EFFECTIVE
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accord-
ance with applicable law of the date, time and place of the meet-
ing regarding the review of the application for a development
order by the applicant for development approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations; and
the attached Development Review Status Sheet dated 5/23/86; and
WHEREAS, the City Council reviewed the development order and
accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the applica-
tion is in compliance with all elements of the Comprehensive
Plan, or will be in compliance prior to the issuance of a
Certificate of Occupancy for the development that is the subject
of the application
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
OECTION 1: That the application for approval of a revised
site plan for Tamarac Square West, prepared by Theo. R. Majdiak
and Associates, revised May 20, 1986, to reflect elimination of
an outparcel and additional parking is approved subject to the
following conditions:
A. Construction is to be in complete compliance with the
plans and specifications submitted by the developer to the City
of Tamarac as described in Section II of the Development Review
Status Sheet and approved engineering drawings.
B. Commencement of construction shall be no longer than one
year from the date of approval. If the development.does not com-
mence construction within one year, this approval is null and
void unless an extension has been granted in accordance with
applicable regulations.

C. The development 6rder is assignable, but the assignment
does not discharge any assignee from strict compliance with the
order unless the City Council consents to modify any of the orig-
inal requirements.
D. Additional conditions established in order to issue the
development order are set forth as follows:
1) Additional 90 degree cross parking easements will
have to be amended to encompass Revision #1.
2) Out parcel #5 eliminated and double row parking added 90
degree.
3) The canal slope does not comply with code requirement
nor is it in conformance with the previous submitted
canal design. Wall will be within 16' of shore line,
therefore within easement.
4) Canal maintenance easement must be shown on site plan,
plus width.
5) Fire Department comments as follows:
a. Building #4 and portions of inlined buildings do not
comply with cities fire land ordinance.
b. Developer to be aware that light poles on site plan
appear to be located closer than 7 1/2 feet from
fire hydrants.
,OECTION 2: Should any section or provision of this devel-
opment order be declared by a court of competent jurisdiction to
be invalid, the City Council shall determine if the other
portions of the order remain valid or whether the approval shall
be null and void.
SECTION 3: This development order as conditioned shall
become effective immediately upon its passage.
