A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE

MARLEN PARK PROJECT, DEVELOPMENT ORDER NO. 212;
AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City Council
6
of Tamarac, Florida, a public meeting has been advertised in
7
accordance with applicable law of the date, time and place of
8
the meeting regarding the review of the application for a
9
development order by the applicant for development approval;
10
and
11
WHEREAS, the City Council has examined and investigated
12
the application, staff and Planning Commission recommendations,
13
and the attached Development Review Status Sheet dated►2/1/86;
14
and
15
WHEREAS, the City Council reviewed the development order
16
and accompanying documents at a public meeting; and
17
WHEREAS, the City Council has determined that the appli-
18
cation is in compliance with all elements of its Comprehensive
19
Plan, or will be in compliance prior to the issuance of a Cer-
20
tificate of Occupancy for any unit on the development that is
21
the subject of the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
23
OF TAMARAC, FLORIDA:

SECTIQN 1: That the development described on the
25
attached development review status sheet dated 12/1/86 is
26
granted a development order for approval of a final plat
27
subject to the following conditions:

A. Construction is to be in complete compliance with the
29
plans and specifications submitted by the developer to the City
30
'of Tamarac as described in Section II of the Development Review
31
Status Sheet and approved engineering drawings.
32
B. The development order is assignable, but an assign-
33
ment does not discharge any assignee from strict compliance
34
with the order unless the City Council consents to modify any
35
of the original requirements.

C. Additional conditions established in order to issue
the development order are set forth as follows:
1. That no Motel be built on the property.
2. That Agreement should be amended to state
condition number 1.
ECTIO 2: Should any section or provision of this
development order by declared by a court of competent juris-
diction to be invalid, the City Council shall determine if the
other portions of the order remain valid or whether the
approval shall be null and void.
SECTION 3: This development order as conditioned shall
become effective immediately upon passage.

Project subject to the requirements included in the Report and the following
conditions: .;
These lands are currently platted as Woodland Villas, First Addition and
zoned R-2, Duplex. This replat is proposed for commercial use and a
request for rezoning from R-2 to B-2 has been initiated and will be heard
by the Planning Commission on December 3, 1986.
Staff recommends approval of the final plat.
A
