A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER
3 NO. 174-5 FOR A REVISED SITE PLAN FOR TAMARAC
SQUARE WEST OUTPARCEL #6; AND PROVIDING AN
4 EFFECTIVE DATE.

6 WHEREAS, pursuant to the instructions of the City Council
7 of Tamarac, Florida, a public meeting has been advertised in
B accordance with applicable law of the date, time and place of
9 the meeting regarding the review of the application for a
10 revised development order by the applicant for development
3-1approval; and
3.2 WHEREAS, the City Council has examined and investigated
13 the application, and staff recommendations; and the attached
Development Review Status Sheet dated 12/11/86; and
14
15 WHEREAS, the City Council reviewed the revised development
16 order and accompanying documents at a public meeting; and
17
WHEREAS, the City Council has determined that the appli-
16 cation is in compliance with all elements of the Comprehensive
19
Plan, or will be in compliance prior to the issuance of a Cer-
20 tificate of Occupancy for the development that is the subject of
the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
22
TAMARAC, FLORIDA:

SECTIQN 1: That the application for approval of a revised
24
site plan for Tamarac Square West Outparcel #6 for a service
25
station prepared by Theodore R. Majdiak and Associates,
26
27 revised December 9, 1986, is HEREBY APPROVED, subject to the
following conditions:

29 A. Construction is to be in complete compliance with the
plans and specifications submitted by the developer to the City
30
of Tamarac as described in Section II of the Development Review
31
Status Sheet and approved engineering drawings.
32
B. Commencement of construction shall be no longer than
33
one year from the date of this approval. If the development
34
does not commence construction within one year, this approval is
35
null and void unless an extension has been granted in accordance
36
with applicable regulations.

C. The 'revised development order is assignable, but an
assignment does not discharge any assignee from strict
compliance with the order unless the City Council consents to
modify any of the original requirements.
D. Additional conditions established in order to issue
the revised development order are set forth as follows:
1. The Petitioner or his successor, does not apply for
Y any futher curb cuts.
2. Signs are discussed as a separate entity.
SECTION 2: Should any section or provision of this
revised development order be declared by a court of competent
jurisdiction to be invalid, the City Council shall determine if
the other portions of the order remain valid or whether the
approval shall be null and void.
C I N 3: This revised development order as condi-
tioned shall become effective immediately upon its passage.
