RESOLUTION NO. R-86--�
A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE A DEVELOPER'S AGREEMENT
WITH BRADLEY CONSTRUCTION COMPANY, INC., FOR
THE UNIVERSITY CLUB PROJECT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate city officials are
hereby authorized to execute a Developer's Agreement with
Bradley Construction Company, Inc., for the University Club
project, a copy of -which is attached hereto as "Exhibit 1".
SECTION 2: That the City Clerk is hereby authorized and
directed to record said easement in the public records of
Broward County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.

DEVELOPER'S AGREEMENT
The DEVELOPER, BRADLEY CONSTRUCTION COMPANY, INC., has submitted to
the CITY a site plan for the development of certain real property located
in the City of Tamarac, Florida, which development is identified as
University Club.
1. See Attached Exhibit "A" for Legal Description.
2. It is expressly agreed and understood by the DEVELOPER and the CITY
that the CITY'S approval of the DEVELOPER'S site plan is subject to payment
of the impact and development -fees in the amounts set forth on Exhibit "B".
It is further expressly agreed and understood by the DEVELOPER and the CITY
that the impact and development fees, paid by the DEVELOPER as set forth in
Exhibit "B", will be returned if Council approval is not granted or if the
DEVELOPMENT does not occur, except for administrative and processing fees.
3. This Agreement shall be construed pursuant to the laws of the State
of Florida.
4. This Agreement constitutes only an Agreement regarding return of
impact fees, and return of certain fees if the project is not approved by
City Council, or if the development is not constructed. This Agreement

between the parties hereto supersedes all prior agreements and understandings,
oral or written, expressed or implied, with respect to the subject matter
hereof. This Agreement may not be amended or modified except by an instrument m 0

being a portion of "Fort Lauderdale Truck Farms Subdivision," according
to Plat Book 4, Page 31, of the Public Records of Broward County,
Florida, being more particularly described as follows:
COMMENCING at the Northeast corner of said Section 4, thence South 00 12' 16"
