CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-84.-
A RESOLUTION APPROVING A THIRD AMENDMENT
TO CONTRACT FOR SOLID WASTE COLLECTION AND
DISPOSAL WITH BROWNING FERRIS INDUSTRIES
OF FLORIDA, INC.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the contract for Solid Waste Collection} and
Disposal approved by Council on September 7, 1979, as
amended by Resolutions 80-186 and 82-86, is hereby approved as
amended with respect to Subsection 13.01 Compensation and Subsection
22.01 Special Services, a copy of said amendment being attached
hereto as Exhibit "A".
SECTION 2: The appropriate City officials are hereby
authorized to execute this Amendment to Contract for Solid Waste
Collection and Disposal with Browning Ferris Industries of Florida,
Inc.
SECTION 3: This Resolution shall become effective upon
adoption with rates effective as of January 1, 1984.

THIRD AMENDMENT TO CONTRACT FOR
SOLID WASTE COLLECTION AND DISPOSAL is
THIS AMENDMENT, dated the //day of , 1984,
by and between the CITY OF TAMARAC, a municipal corporation
of the State of Florida (hereinafter referred to as "City"),
acting by and through its duly authoorized City Council and
BROWNING-FERRIS INDUSTRIES OF FLORIDA, INC., (hereinafter
referred to as "Contractor").
WHEREAS, the City and Contractor are parties to that
certain Contract for Solid Waste Collection and Disposal
dated October 5, 1979 (the "Contract"); and
WHEREAS, the parties desire to amend the Contract to
increase the contract prices to exactly reflect the recent
increase in the costs for dumping:
NOW, THEREFORE, in consideration of the foregoing and of
the mutual covenants hereinafter set forth, the parties agree
as follows:
1. Subsection 13.01 is hereby amended as follows:
13.01 Compensation - Contractor.shall be paid the
following sums for all service that it provides within the
City:
Cost per month for curb service per unit
other than condominium $4.65
Cost per month per unit
condominium $2.26
The prices set forth above may be increased only to
exactly reflect increased costs for dumping. This commitment
is made by Contractor with full knowledge of increases in the
cost of labor, materials, equipment and uncertainty as to the
cost of fuel in the future. Contractor must demonstrate to
the City Council that the amount of increase requested is the
minimum amount that will exactly reflect the increased
dumping costs. There shall be no fees or charges other than
those specifically set forth in this contract. Contractor
agrees for purposes of emphasis that the fees it will not
seek to impose include, without limitation, drop fees and
roll in -roll out fees.
2. Subsection 22.01 is hereby amended as follows:
22.01 Contractor shall provide a third pickup per week
at any condominium requesting same at an additional fee of
$2.25 per month per unit for each month when such additional
pickup occurs. Payment for this additional pickup shall be
the sole responsibility of the Condominium Association and
Contractor shall not look to City for payment.
3. In all other respects, the terms of the Contract are
hereby ratified and confirmed.
IN WITNESS WHEREOF, the parties have caused these pre-
sents to be executed and attested to by their duly authorized
officers or representatives and their official seals to be
affixed hereto, the day and year first above written.
