5 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER
NO. 083-2 FOR A REVISED SITE PLAN FOR GARDEN MALL;
6 AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City Council of Tamarac,
8
Florida, a public meeting has been advertised in accordance with applicable law of
9
the date, time and place of the meeting regarding the review of the application for
10
a revised development order by the applicant for development approval; and
11
WHEREAS, the City Council has examined and investigated the application
12
and staff recommendations; and the attached Development Review Status Sheet dated
13
9/7/84; and
14
WHEREAS, the City Council reviewed the revised development order and
15
accompanying documents at a public meeting; and
16
WHEREAS, the City Council has determined that the application is in
17 compliance with all elements of the Comprehensive Plan, or will be in compliance

prior to the issuance of a Certificate of Occupancy for the development that is
19
the subject of the application.
20 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:

SECTION 1: That the application for approval of a revised site plan for
22 Garden Mall, prepared by Jerry Gross Associates, revised August. 6, 1984, to reflect
23 a dumpster addition for Beverly Hills Cafe V, is approved subject to the following
24 conditions;
25 A. Construction is to be in complete compliance with the plans and
26 specifications submitted by the developer to the City of Tamarac as described in
27 Section II of the Development Review Status Sheet and approved engineering drawings.
28 B. Commencement of construction shall be no longer than one year from
29 the date of this approval. If the development does not commence construction
30 within one year, this approval is null and void unless an extension has been
31 granted in accordance with applicable regulations.
32 C. The revised development order is assignable, but an assignment does
33 not discharge any assignee from strict compliance with the order unless the City
34 Council consents to modify any of the original requirements.

D. Additional conditions established in order to issue the revised
development order are set forth as follows:
1 - Replacement of seven (7) shade trees, 8-feet high and
30-feet apart along Commercial Boulevard.
SECTION 2: Should any section or provision of this revised development
order be declared by a court of competent jurisdiction to be invalid, the City
Council shall determine if the other portions of the order remain valid or whether
the approval shall be null and void.
SECTION 3: This revised development order as conditioned shall become
effective immediately upon its passage.
