A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER
3 NO. 094-1 FOR A REVISED SITE PLAN FOR FAMILY
MART; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City Council
5
of Tamarac, Florida, a public meeting has been advertised in accord-
ance with applicable law of the date, time and place of the meeting
7
regarding the review of the application for a revised -development
8
order by the applicant for development approval; and
9
WHEREAS, the City Council has examined and investigated the
10
application and staff recommendations; and the attached Development
11
Review Status Sheet dated 6/27/84; and
12
WHEREAS, the City Council reviewed the revised development
13
order and accompanying documents at a public meeting; and
14
WHEREAS, the City Council has determined that the applica-
tion is in compliance with all elements of the Comprehensive Plan,
16
or will be in compliance prior to the issuance of a Certificate of
17
Occupancy for the development that is the subject of the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:

SECTION 1: That the application for approval of a revised
20
site plan for Family Mart, prepared by Mudano Associates, Architects,

Inc., revised June 26, 1984 to reflect a storage area at the rear,
22
is approved subject to the following conditions:
A. Construction is to be in complete compliance with the

plans and specifications submitted by the developer to the City of
25 Tamarac as described in Section II of the Development Review Status
26 Sheet and approved engineering drawings.
27 B. Commencement of construction shall be no longer than
2.8 one year from the date of approval. If the development does not
29 commence construction within one year, this approval is null and
30 void unless an extension has been granted in accordance with applic-
31 able regulations.

C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance
with the order unless the City Council consents to modify any of
the original requirements.
D. Additional conditions established in order to issue
the revised development order are set forth as follows:
1. No outdoor storage will be permitted; therefore, the enclosure
must be adequate in size.
2. The enclosure will be constructed with:
a) Doors must be placed on concrete filled posts instead of
attached to the •?all.
b) A concrete pad beneath the structure instead of asphalt as
shown.
c) Applicant shall place a hedge to the south of the enclosure
to shield the storage area; hedge has died, therefore, staff
recommends placinc* a new hedge.in the landscape island.
3. All work shall be- completed v7ithin 90 days.
SECTION 2: Should any section or provision of this revised
development order be declared by a court of competent jurisdiction
to be invalid, the City Council shall determine if the other portion
of the order remain valid or whether the approval shall be null and
void.
SECTION 3: This revised development order as conditioned
shall become effective immediately upon its passage.
