RESOLUTION NO. R-83-337
A RESOLUTION ISSUING A REVISED DEVELOPMENT
ORDER NO. 043-1 FOR SITE PLAN APPROVAL FOR
WOODMONT TRACT 72-C (PINEAPPLE PARE); AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council
of Tamarac, Florida, a public meeting has been advertised in
accordance with applicable law of the date, time and place of the
8 meeting regarding the review of the application for a revised
9 development order by the applicant for development approval; and
10 WHEREAS, the City Council has examined and investigated the
11 application, staff and Planning Commission recommendations; and
12 the attached Development Review Status sheet dated 12/8/83; and
13 WHEREAS, the City Council reviewed the revised development
14 order and accompanying documents at a public meeting; and
15 WHEREAS, the City Council has determined that the application
16 is in compliance with all elements of the Comprehensive Plan, or
17 will be in compliance prior to the issuance of a Certificate of
Occupancy for the development that is the subject of the applicati.oi
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA.
21 SECTION 1: That the application for site plan approval is
22 approved subject to the following conditions:
23 A. Construction is to be in complete compliance with
24 with the plans and specifications submitted by the developer to the
City of Tamarac as described in Section II of the Development
Review Status Sheet and approved engineering drawings.
27 B. Commencement of construction shall be no longer than one
28 year from the date of this approval. If the development does not
29 commence construction within one year, this approval is null and
30 void unless an extension has been granted in accordance with
applicable regulations.

C. The development order is assignable, but an assignment does
not discharge any assignee from strict compliance with the order
unless the City Council consents to modify any of the original
requirements.
D. Additional conditions established in order to issue the
development order are set forth as follows:
1. The canals must be excavated to the property line on all
_sides. A shelf must be provided for safety purposes.
However, if a shelf cannot be provided, the terms and conditions of
Stipulation #16 must be adhered to with the approval of the City
Engineer.
2. The parking lot lighting plan must be approved by the
Council, and until such time of approval, a permit can only be issued
for the first model.
3. There must be a rust -free sprinkler system installed.
4. The median on Northwest 70 Street and Northwest 80 Avenue
is to be curbed all around, backfilled, and fully sodded with Bahia
grass. When the property owner on the other side of Northwest 70
Street develops, he will be required to assume half the expense of
the curbing.
5. The total units for Tracts A and C shall not exceed 118.
6. There shall be continuous sidewalks leading to the pool and
parking spaces.

Should any section or provision of this development
order be declared by a court of competent jurisdiction to be invalid,
the City Council shall determine if the other portions of the order
remain valid or whether the approval shall be null and void.
SECTION 3: This development order as conditioned shall become
effective immediately upon its passage.
PASSED, ADOPTED AND APPROVED this 14th day of December 1983.

7. Cost estimate to be revised to reflect additional improvements on media
8. Staff recommends Council approve the project with the condition
that prior to obtaining a building permit, the applicant submits
a landscape plan to be reviewed by the City Council
