A RESOLUTION ESTABLISHING AND MODIFYING RATES AND
CHARGES APPLICABLE TO THE UTILITY OWNED BY THE CITY
OF TAMARAC SERVING CUSTOMERS WEST OF STATE ROAD 7,
AMENDING SUBSECTIONS Jr K & M OF SEC. I OF RESOLUTION
NO. R-82-351; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED'BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTIQN I: The Rate Schedule set forth below
shall be applicable to all customers of the water and sewer
utility served by the City of Tamarac for customers West of
State Road 7:

Any customer for which no schedule directly applies
shall use C. and F. COMMERCIAL RATE PER UNIT.
Contribution Charges - Water $ 555.00per ERC
Contribution Charges - Wastewater 975.00per ERC
L. The number of ERC'S for individually metered
residential or non-residential uses shall be
a minimum of one or more depending upon the
size of water meter installed.
The number of ERC'S for multi -family residential
units with a common or shared meter shall be
based on the following formula:
K = (No. of fixture units * divided by 2) times
the No. of bedrooms**
If K is less than 25; then each unit shall be
considered 2/3 of an ERC.
If K is equal to or more than 25; then each unit
shall be considered one or more ERC.

* The number of fixture units per unit shall be based
on Table 46-1 of the 1981 Broward County Edition of
the South Florida Building Code.
** Includes all rooms except kitchen, living room,
dining room, storage room or utility room.

Q. Customers outside of the corporate limits of the City re-
ceiving service shall, in addition to the rates set, pay a
surcharge of 25%.
R. Service availability charges shall be prorated for customers
becoming a part of or leaving the system during a billing
cycle.
S. To qualify as a Homeowner Association Recreational Facility,
the following criteria shall apply:

co -owner's benefit.

None of the water and sewer is used in any endeavor which
sells or rents a commodity or provides a service for a fee.

HOMEOWNERS' ASSOCIATIONS:
100% of the water and sewer is used exclusively for the
member homeowners' benefit.
None of the water and sewer is used in any endeavor which
sells or rents a commodity Or provides a service for a fee.
Each point of service is separately metered and billed.
A responsible legal entity is established as the customer to
whom the Utility can render its bills, and receive payment
for said service.
Membership in the Homeowners' Association which controls and
operates the common facilities is required as a condition of
property ownership in the subdivision; and such requirement
arises from restrictions of record which are set out or
incorporated by reference on each member homeowner's deed.
Such restrictions require each member homeowner to pay his
proportionate share of the costs of operating and
maintaining the common facilities. This obligation to pay
must be enforceable by placement of a lien on the member
homeowner's property and by foreclosure for non-payment of
such liens.
The Homeowners Associations are comprised of persons owning
contiguous lots in a planned development, and the commonly
owned facilities are located within the development.
SECTION 2: This Resolution shall become effective
immediately upon adoption.
