CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-
A RESOLUTION GRANTING A SPECIAL USE EXCEPTION TO
PERMIT A SELF-SERVICE GASOLINE STATION, EDVVIRD W.
AND BLANCHE HIGGINS, IN A B-2 ZONING DISTRICT -
PETITION #18-Z-82 AND PROVIDING AN EFFECTIVE DATE.
WF=M, the Code of the City of Tamarac provides for the granting of
special exception to permit a self-service gasoline station in a B-2 Zoning District;
and
WHEREAS, a Public Hearing has been held and the public has been given an
opportunity to express their views concerning the application for Special Exception;
and
WHEREAS, the Council of the City of Tamarac finds that the petition for
special exception would be in keeping with the public health, safety and general
welfare of the City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the petition for special exception to permit a self-service
gasoline station in a B-2 Zoning District for Edward W. and Blanche Higgins, Petitior.
#18-Z-82 to be constructed on the northwest corner of N.W. 88th Avenue and Commercial
Boulevard, is HEREBY APPROVED.
SECTION 2: Conditions of approval:
(1) Redesign of the driveways into Commercial Boulevard to be "One Way" in
at the east property line and "One Way" out at the west property line;
(2) That Shell Oil Company agrees to pay a voluntary cash donation in the
amount of $35,000.00 for a traffic light to be installed at N.W. 88
Avenue and N.W. 57 Street, or, failing to get the appropriate approval o
that location, the light would be installed at N.W. 94 Avenue and
Commercial Boulevard. This amount, to be paid at the time of site plan
approval, would generate some interest, and this interest would belong
to the City.
(3) When the property at N.W. 88 Avenue and N.W. 57 Street or at N.W. 94
Avenue and Commercial Boulevard is developed, and if the City generates
more money than the cost of installing the light and the necessary road
work, then Shell Oil Company would be reimbursed up to the sum of
$10,000.00.
