RESOLUTION NO. R-82_a.3,1
A RESOLUTION APPROVING AND ACCEPTING A 35-FOOT
DRAINAGE EASEMENT OFFERED BY TRACT 76 CORP. AND
CITY NATIONAL BANK OF MIAMI, AS TRUSTEE UNDER
TRUST NO. 5003183, SAID EASEMENT BEING A PORTION
OF TRACT K, LAND SECTION 4 GOLF COURSE PLAT, AS
RECORDED IN PLAT BOOK 88, PAGE 20 OF THE PUBLIC
RECORDS OF BROWARD COUNTY, FLORIDA, FOR THE
WOODMONT TRACT 59 PROJECT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the 35-foot Drainage Easement offered by TRACT 76 CORP.
and CITY NATIONAL BANK Of MIAMI, as Trustee under Trust No. 5003183, said easement
being a portion of Tract K, Land Section 4 Golf Course Plat, as recorded in Plat
Book 88, Page 20 of the Public Records of Broward County, Florida, for the
Woodmont Tract 59 project, is hereby approved and accepted. A copy of said
easement is attached hereto as Exhibit "A".
SECTION 2: The City Clerk is hereby authorized and directed to record said
easement in the Public Records of Broward County, Florida.
SECTION 3: This Resolution shall become effective upon adoption.

THIS INDENTURE made this Qj-\-sV day of July, 1982, by
and between TRACT 76 CORP., a Florida corporation, as party
of the first part, and CITY NATIONAL BANK OF MIAMI, a
national banking corporation, as Trustee, under the
provisions of that certain Trust Agreement dated the 14th
day of September, 1978, and known as Trust No. 5003183, c/o
TIBALLI & FAYNE, Post Office Box 5648, 2424 West Oakland
Park Boulevard, Fort Lauderdale, FL 33310, and CITY OF
TAMARAC, a municipal corporation of the State of Florida,
5811 N.W. 88 Avenue, Tamarac, FL 33321, hereinafter
collectively referred to as the party of the second part.
W I T N E S S E T H:
WHEREAS, the party of the first part is the owner of
the property situate in Broward County, Florida, and
described as follows:

WHEREAS, CITY NATIONAL BANK OF MIAMI, as Trustee, under
the provisions of that certain Trust Agreement dated
September 14, 1978, and known as Trust No. 5003183, is the
owner of the property situate in Broward County, Florida,
and described as follows:

WOODMONT TRACT 59
WHEREAS, the party of the second part desires an
Easement for flow drainage purposes, over and across the
land described in Exhibit "A"; and
WHEREAS, the party of the first part is willing to
grant such easement..
NOW, THEREFORE, for and in consideration of the mutual
covenants each to the other running, and ONE AND N0/100 ,
($1.00) DOLLAR, and other good and valuable consideration,
the party of the first part does hereby grant unto the party
of the second part, their successors and assigns, full and
free non-exclusive right and authority to discharge surface
water drainage from the property owned by CITY NATIONAL BANK
OF MIAMI, as Trustee, under the provisions of that certain
Trust Agreement dated September 14, 1978, and known as Trust
No. 5003183, as described in Exhibit "B", and does hereby
grant a perpetual non-exclusive easement across the
following described real property for said purposes; said
real property located in Broward County, Florida, to -wit:

And the Grantor specifically reserves unto itself, its
successors and assigns, the right of ingress and egress to
the property described in Exhibit "A" attached hereto and
further reserves the right to grant future non-exclusive
easements for additional drainage upon said property and to
continue the existing uses of the property.
IN WITNESS WHEREOF, the party of the first part has
hereunto set its hand and seal on the day and year first
above written.

and certify acknowledgments of instruments in said State and

as Vice President of TRACT 76 CORP., a Florida corporation;
that the said person so appearing before me is the individual
and the officer aforementioned of said corporation described
in and who executed the foregoing instrument; and that then
and there said individual as aforesaid officer acknowledged
before me that the seal affixed to said instrument is the
corporate seal of said corporation; that his name officially
is by him subscribed thereto; that said instrument was
signed, sealed and delivered by said corporation in the
presence of two subscribing witnesses, pursuant to law, and
that the same is the free act and deed of said corporation.

An easement for drainage purposes over and across a portion of Tract K,
SEC. 4 GOLF COURSE PLAT, according to the Plat thereof as recorded in P.
Book 88, Page 20, Public Records of Broward County, Florida, described as
follows:
COMMENCING at the Northeast corner of Section 4, Township 49 South, Range 41
East, Broward County, Florida; thence South 00. 12' 16" East, along the East
line thereof, a distance of 2006.80 feet; thence South 89. 47' 44" West, a
distance of 3640.27 feet; thence South 09° 00' 00" East, a distance of
420.00 feet to a point on the boundary of said Tract K; thence along said
boundary, South 66° 31' 43" West, a distance of 614.49 feet; thence continu-
ing along said boundary of Tract K, North 37° 05' 44" West, a distance of
280.67 feet to the POINT OF BEGINNING; thence South 52' 54' 16" West, 35.00
