3 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE
WOODMONT TRACT 59 PROJECT. DEVELOPMENT ORDER NO.
4 041 AND PROVIDING AN EFFECTIVE DATE.
5 WHEREAS, pursuant to the instructions of the City Counci_
of the City of Tamarac, Florida, a public meeting has been advertised
N in accordance with -applicable law of the date, time and place of the
8 meeting regarding the review of the application for a development
9 order by the applicant for development approval; and
10 WHEREAS, the City Council has examined and investigated
11 the application, staff and Planning Commission recommendations, and
12 the attached Development Review Status Sheet dated 7/14/82; and
13 WHEREAS, the City Council reviewed the development order
14 and accompanying documents at a public meeting; and
15 WHEREAS, the City Council has determined that the appli-
16 cation is in compliance with all elements of its Comprehensive Plan,
17 or will be in compliance prior to the issuance of a Certificate of
A Occupancy for any unit on the development that is the subject of the
application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
21 CITY OF TAMARAC, FLORIDA:
22 SECTION 1: That the development described on the attach-
23 ed development review status sheet dated 7/14/82 is granted a develop-
24 ment order to proceed subject to the following conditions:
25 A. Construction is to be in complete compliance with the
26 plans and specifications submitted by the developer to the City of
27 Tamarac as described in Section II of the Development Review Status
28 Sheet and approved engineering drawings.
29 B. Commencement of construction shall be no longer than
30 oRe year from the date of this approval. If the development does not
commence construction within one year, this approval is null and void
-41 unless an extension has been granted in accordance with applicable
33 regulations.
34 C. The development order is assignable, but an assign-
35 ment does not discharge any assignee from strict compliance with the
36 order unless the City Council consents to modify any of the original
requirements.

D. Additional conditions established in order to issue
the development order are 'set forth as follows:
1) That under the notes, the word "resident" be changed to "residence";
2) That the minilIum width of NW 84 Terrace going north from the plat
line shall be changed so that the mini.mm width between the guardrails
shall be not less than 50-feet with the 24-feet paved;
3) That the sidewalks be changed on the west side from 4-feet to 5-feet
of concrete in widtl..
SECTION 2: Should any section or provision of this
development order be declared by a court of competent jurisdiction to
be invalid, the City Council shall determine if the other portions of
the order remain valid or whether the approval shall be null and void.
SECTION 3: This development order as conditioned shall
become effective
immediately
upon
its passage.
