RESOLUTION NO. R- /9
A RESOLUTION APPROVING AND ACCEPTING A 12-FOOT UTILITY
EASEMENT FOR SEWER PURPOSES OFFERED BY F & R BUILDERS,
INC., SAID EASEMEM LYING IN AND BEING A PORTION OF
SECTION 6, TOWNSHIP 49 SOUTH, RANGE 41 EAST, FOR THE
KINGS POINT PROFESSIONAL PLAZA PROJECT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the 12-foot utility easement for sewer purposes
offered by F & R Builders, Inc., said easement lying in and being a portion of
Section 6, Township 49 South, Range 41 East, for the Kings Point Professional Plaza
project, is hereby approved and accepted. A copy of said agreement is attached
hereto as Exhibit "A".
SECTION 2: The City Clerk is hereby authorized and directed to
record said easement in the Public Records of Broward County, Florida.
SECTION 3: This Resolution shall become effective upon adoption.

RECORD OF COUNCIL VOTE
EASEMENT
This Easement is made this AW day of June, 1982, by F&R BUILDERS,
INC., a Florida corporation (the "Grantor") to the City of Tamarac,
a municipal corporation (the "Grantee")
W I T N E S S E T H:
WHEREAS, Grantor is the fee simple owner of the real property
described on Exhibit A attached hereto (the "Property") and
WHEREAS, Grantor desires to create a non-exclusive easement in
favor of Grantee for ingress and egress over the Property to construct,
maintain, repair and replace a sewer line and all necessary laterals
thereto, upon the terms and conditions set forth herein.
NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00)
paid to Grantor the receipt and adequacy of which is hereby acknowledged,
and for other good and valuable considerations, Grantor does hereby
create, establish and grant, a non-exclusive easement on, over, under
and through the Property to Grantee for the purpose of ingress and
egress to construct, install, maintain, repair and replace a sewer
line and all necessary laterals thereto.
This non-exclusive easement is conditioned upon the Grantee's
obligation to repair, restore or replace, (as the case -may be) the
paved and/or sod area located in portions of the Property (and the real
property adjacent thereto) which paved and/or sod area (and real property
adjacent to the Property) may be damaged as a result or by reason of
Grantee's wrongful or negligent acts or omission of Grantee or of its
agents or employees in the course of their employment; and further,
upon the obligation of Grantee to indemnify Grantor and its successors
and assigns against any loss or damage occasioned thereby.
IN WITNESS WHEREOF, Grantor has caused this Easement to be executed
on the said day and year first above written.
