R41-^. ,C3 A RESOLUTION APPROVING AN AGREEMENT FOR CONVEYANCE OF TITLE TO THE CANAL RIGHTS -OF -WAY ON TRACTS 12, 13, and 13A IN LAND SECTION 6-49-41 OFFERED BY F & R BUILDERS TO THE CITY, PURSUANT TO STIPULATION #10 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Agreement for Conveyance of Title to the Canal Rights -of -Way on Tracts 12, 13, 13A in Land Section 6, Township 49 South, Range 41 East is hereby approved and accepted. SECTION 2: That the appropriate City Officials are hereby authorized to execute this agreement. And the Ci.ty Clerk is hereby authorized to record this document, attached hereto as Exhibit A, in the Public Records of Broward County Florida. DISTRICT DISTRICT DISTRICT Arthur Bi rken, City Attorney DISTRICT RECORD OF COUNCIL VOTE AGREEMENT This Agreement made as of the az day of July, 1981 by and between the City of Tamarac ("City") and F&R Builders, Inc. ("F&R") . W I T N E S S E T H: WHEREAS, City and Leadership Housing, Inc. ("Leadership") entered into an agreement entitled "Agreement to Compromise, Settle, Release and Discharge All Claims and Obligations dated July 31, 19 79 " ; and WHEREAS, City desires to acquire certain canal rights -of -way on Tracts 12, 13 and 13A more particularly described on Exhibit A attached hereto and made a part hereof, and WHEREAS, F&R is the present fee simple owner of Tracts 13 and 13A; and WHEREAS, F&R entered into an agreement for the transfer and exchange of Tract 12 (together with such additional Tracts which are also owned by Leadership) for Tract 24 which Tract is presently Is owned by F&R; and WHEREAS, F&R desires to convey title to said canal rights -of - way on Tracts 12, 13 and 13A to City upon the terms and conditions herein set forth. NOW, THEREFORE, in consideration of the premises and for such other good and valuable consideration, the sufficiency and adequacy of which is hereby acknowledged by the parties, it is agreed as follows: 1. Subject to the terms and provisions herein, F&R hereby conveys and City hereby accepts title to the canal rights -of -way on Tracts 12, 13 and 13A described on Exhibit A. Accordingly, F&R has executed and delivered to the City Attorney of the City (the "Escrow Agent") three (3) original Quit Claim Deeds, copies of which are attached hereto as Composite Exhibit B. 2. Escrow Agent by his acceptance and agreement to be bound to the terms hereof understands and agrees that he is holding all three Quit Claim Deeds in escrow subject to: (i) execution of this Agreement by the parties hereto and recording of the Agreement among the Public Records of Broward County, Florida by either party and (ii) closing of title to Tract 12. Upon the happening of the events described in (i) herein, Escrow Agent shall be authorized to release the suit Claim Deeds for Tracts 13 and 13A to the City and, upon the happening of the event described in (ii) herein Escrow Agent shall be authorized to release the Quit Claim Deed for Tract 12 to the City. 3. City shall, at its sole cost and expense, excavate the canals within said rights -of -way in accordance with the current design standards set forth in Section 24-32 of the City Code. City understand and agrees where roadways cross the canals described herein, FBR, its successors and assigns, shall be allowed to construct culvert crossings in lieu of bridges. City further understands and agrees that the fill generated from the excavations of the canals does not belong to City and said fill shall be placed adjacent to the excavations. 4. City agrees that the conveyance of the canal rights -of - way as herein described shall not reduce the number of dwelling units for the Tracts shown on Exhibit C. 5. the City shall complete excavatic- of said canals no later than January 10, 1983. 6. The cost of Florida Documentary Tax Stamps due upon the -2- Quit Claim Deeds and the recording of same shall be paid by I City.
