ORDINANCE NO. 2021 - iJ()I-r
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AMENDING CHAPTER 10 OF THE CITY OF
TAMARAC CODE OF ORDINANCES, ENTITLED "LAND
DEVELOPMENT CODE" BY AMENDING ARTICLE 4, ENTITLED
"DEVELOPMENT AND DESIGN STANDARDS" SPECIFICALLY
AMENDING SECTION 10-4.3, ENTITLED "OFF-STREET PARKING
AND LOADING", BY CREATING SECTION 10-4.3(J), ENTITLED
"ELECTRIC VEHICLE PARKING REQUIREMENTS"; AND
AMENDING ARTICLE 6 ENTITLED "RULES OF CONSTRUCTION
AND DEFINITIONS," SPECIFICALLY AMENDING SECTION 10-6.3
ENTITLED OTHER TERMS DEFINED" TO PROVIDE FOR
ADDITIONAL TERMS AND DEFINITIONS FOR ELECTRIC
VEHICLE CHARGING STATIONS; PROVIDING FOR
CODIFICATION: PROVIDING FOR CONFLICTS PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Electric Vehicle sales have an increased by over 50% accounting for
over 1 million of vehicle purchases since 2016 according to the U.S. Department of
Energy; and
WHEREAS, the increase in Electric Vehicle sales signal a shift in consumer trends
and heightens demand for Electric Vehicle Charging Infrastructure; and
WHEREAS, Greenhouse Gas Emissions generated by vehicle travel contribute to
the proliferation of pollutants such as CO2 into the earth's atmosphere thereby increasing
global warming; and
WHEREAS, the Vehicle Technologies Office of the US Department of Energy cited
that gasoline -powered vehicles emit sixty percent (60%) more harmful carbon dioxide
(CO2) emissions than electric vehicles on an annual basis; and
WHEREAS, the goal of Tamarac's Conservation Policies is to ",preserve, protect,
and appropriately manage the City's natural resources'; and

WHEREAS, clean air is considered a natural resource and pollutants from
excessive vehicle emissions pose a credible threat to the City's air quality; and
WHEREAS, climate change conditions have warranted a response on a global,
national, regional, and local scale; and
WHEREAS, the City desires to encourage the use of alternative fuels and reduce
Greenhouse Gas Emissions to support its climate resiliency efforts; and
WHEREAS, the City recognizes the need to adopt sustainable poficies that are
cohesive with and supported by multilevel government agencies; and

WHEREAS, these vuhahves have irripacted how the region wilil address
transportation planning in the future, requiring the Broward MPO to also provide support
for electric vehicle policy planning and infrastructure improvements; and
WHEREAS, intergovernmental coordination will further opportunities for the City
to receive local and regional support for its electric vehicle charging pormies; and
WHEREAS, the Director of Community Development recommends approval of
the ordinance amendment and
WHEREAS, the City Commission of the City of Tamarac wishes to continue to be
responsive to the impacts of climate change by supporting environmentally conscious
policy to foster climatic resiliency within the City, and has deemed it to be in the best

interest of the citizens, residents, and visitors to the City of Tamarac to amend the Land
Development Code to allow for the provision of Electric Vehicle Parking Requirements
and Standards for Electric Vehicle Charging Stations.
NOW, THEREFORE, be it ORDAINED by the City Commission of the City of
TAMARAC, Florida, as follows:
SECTION 1. The foregoing recitals are hereby ratified and confirmed as being true
and correct and are hereby made a specific part of this Ordinance upon adoption hereof.
SECTION 2. The City Commission hereby amends Chapter 10, Section 10-4.3
entitled "Off -Street Parking and Loading" of the City Code, by creating Section 10-4.3(J)
entitled 'Electric Vehicle Parking Requirements" so that the Code shall read as follows:
Section 10-4.3 Off -Street Parking and Loading
(J) Electric Vehicle Parking Requirements
(1) General
(a) Electric vehicle parking spaces and charging stations required pursuant
to this section shall meet the following design standards in addition to all
other design standards set forth in this article.
(i) Any Mixed -Use, Non -Residential, or Multi -family development with
20 or more parking spaces shall install and provide access to
electrical Power supply rated at 240 volts or greater, in all off-street
parking facilities, to allow for the installation of electric vehicle parking
spaces.
(ii) Electric vehicle parking spaces shall be marked by green painted
lines or curbs.

(iii) Each electric vehicle parking space shall be marked by a sign
designating the parking space as an electric vehicle parking space.

(b) In Mixed -Use Nan -Residential Districtsand Multi -family Districts, uric

(3) Electric Vehicle Parking Required for Existing Developments
Any new development, redevelopmerrt, or expansion of any facility in a Mixed -Use
Non -Residential or Multi -family District resutting in an increase of at least 20 or
more required off street parking spaces shall be subiecl to the electrical vehicle
parking standards outlined in Section 10-4-30)(1) of this Gode.

SECTION 3. The City Commission hereby amends Chapter 10, Section 10-6.3
entitled "Other Terms Defined" of the City Code, by adding terms related to electric vehicle
charging stations so that the Code shall read as follows:
Section 10-6.3 Other Terms Defined
Abutting. The condition of two adjoining properties having a common property line
or boundary, including cases where two or more lots adjoin a comer, but not
including cases where adjoining lots are separated by a street or alley.
Accent Lighting. Any luminary that emphasizes a particular object or draws
attention to a particular area for aesthetic purposes.
Accent Material. Building materials used to integrate with the primary building
materials of a wall elevation.
Easernerrt. An interest in land granted by the property owner to another party
(including the City, other government entities, utrTity providers, ort other persons)
that entitles the hokler to a specific usage of the land for specified purposes.

Electric vehicle charging level. The standardized indicator of electrical force or
voltage, at which the battery of an electric vehicle is recharged
a Level 1 transfers 120 volts (1.4-1 9 jLVD of electricity to an electric

vehicle battery.
c. DC fast charging transfers a high voltage (typically 400-500 volts or 32-
100 kW, depending on the electrical current) of direct current to vehicle
batteries.
Electric vehicle parking space. An off-street parking space that is equipped with
an electric vehicle charging station.
Electric vehicle charging station. Battery charging equipment utilized for the
primary purpose of transferring electric energy (by conductive or inductive means
to a battery or other energy storage device in an electric vehicle.

SECTION 4. Codification. It is the intention of the City Commission of the City of
Tamarac that the provisions of this Ordinance shall become and be made a part of the Code
of Ordinances of the City of Tamarac, Florida, and that the Sections of this ordinance may
be renumbered, re lettered and the word "Ordinance" may be changed to "Section", "Article"
or such other word or phrase in order to accornpfiish such intention.
