R-2018-6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; APPROVING THE FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF TAMARAC AND BROWARD COUNTY FOR THE KEEP BROWARD BEAUTIFUL PROGRAM, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE SAID AMENDMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, as stated in the City of Tamarac's Strategic Goals, "The City of Tamarac will provide resources, initiatives, and opportunities to continually revitalize our community and preserve the environment", and WHEREAS, the City of Tamarac, in partnership with Broward County, has provided a program allowing local not -for -profit organizations, community groups, and residents to "Adopt -a -Street" for the purpose of removing litter from certain rights of way within the City of Tamarac; and WHEREAS, in May 2014, via Resolution Number R-2014-47 the City Commission of the City of Tamarac approved and authorized an Interlocal Agreement (ILA), between the City of Tamarac and Broward County for Optional Services including the Keep Temp. Reso. # 13156 August 22, 2018 Page 2 Broward Beautiful Adopt -a -Street Program, a copy of Resolution Number R-2014-47 is incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, the ILA is eligible for a one (1) year extension, a copy of the First Amendment to the ILA is attached hereto as "Exhibit 1 ", incorporated herein and made a specific part of this Resolution; and WHEREAS, City Staff has determined this program to be a cost-effective way to help control litter within the City of Tamarac and encourage engagement of citizens and community organizations within the City of Tamarac; and WHEREAS, the Director of Public Services and the Director of Financial Services recommend that the First Amendment to the Interlocal Agreement for the Keep Broward Beautiful Program be executed; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute this Interlocal Agreement with Broward County. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Temp. Reso. # 13156 August 22, 2018 Page 3 Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2: The City Commission hereby approves the First Amendment to the ILA with Broward County for the Keep Broward Beautiful Program, hereto attached as "Exhibit 1 ", and the appropriate City Officials are hereby authorized to execute the First Amendment to the ILA and to take all steps necessary to effectuate the intent of this Resolution. Section 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 5: This Resolution shall become effective immediately upon its passage and adoption. Recitals A. On August 28, 2012, the Board of County Commissioners approved the form of an interlocal agreement to allow municipalities in Broward County to use County services for Keep Broward Beautiful, Household Hazardous Waste, and Bulk Trash and Yard Waste programs (the "Programs") on a fee -for -service basis. B. Keep Broward Beautiful program focuses on the organization, education, and coordination of volunteers for the removal of litter, including Adopt -A -Street, waterway cleanups, beach sweeps, and municipal events. C. D. E. On 6/21/2014, City entered into the Agreement with County. The Agreement currently expires on September 30, 2018. F. County is in the process of evaluating the next steps for the Programs. NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, County and City hereby agree as follows: 1. The Agreement, which expires on September 30, 2018, is extended for one year, with a new expiration date of September 30, 2019. All other terms, conditions, and covenants contained in the Agreement shall remain in force and effect, IN WITNESS WHEREOF, the Parties hereto have made and executed this First Amendment to the Interlocal Agreement: BROWARD COUNTY, through its County Administrator, authorized to execute same pursuant to Board action at the April 10, 2018 meeting, and the City of Tamarac, signing by and through its Mayor and City Manager, duly authorized to execute same.
