Ord. #2455 February 5, 2021 Page 1 of 4 CITY OF TAMARAC, FLORIDA ORDINANCE NO.2021- t)/ G AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 2, "ADMINISTRATION," ARTICLE III, `BOARDS, COMMITTEES, COMMISSIONS," OF THE CITY OF TAMARAC CODE OF ORDINANCES, BY CREATING DIVISION 5," UNITED STATES SUPREME COURT JUSTICE RUTH BADER GINSBURG COMMISSION ON THE STATUS OF WOMEN; PROVIDING FOR APPOINTMENT OF MEMBERS; PROVIDING FOR TERM OF OFFICE; PROVIDING FOR DUTIES AND POWERS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, women are an important part of the City of Tamarac; and WHEREAS, the City Commission deems it important to inspire women and to encourage women's involvement in community affairs and in leadership roles; and WHEREAS, the City Commission desires to establish the Commission on the Status of Women in honor of the late United States Supreme Court Justice Ruth Bader Ginsburg. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1. The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2. The City Commission hereby amends Chapter 2, "Administration," Article IIl, "Boards, Committees, Commissions," of the City of Tamarac Code Of Ordinances, by creating Division 5, "Supreme Court Justice Ruth Bader Ginsburg Commission on the Status of Women", to read as follows: DIVISION 5. -SUPREME COURT JUSTICE RUTH BADER GINSBURG COMMISSION ON THE STATUS OF WOMEN Sec. 2-156. — Created; composition. There is hereby established the Supreme Court Justice Ruth Bader Ginsburg Commission on the Status of Women ("RBG Commission"), which shall consist of five (5) members appointed by the CODING: Words in stroke through type are deletions from existing law; Words in underlined type are additions. The RBG Commission shall be dedicated to identifying and resolving economic, health and wellness, social, and all other issues concerning women's lives through education and advocacy in the City of Tamarac. Sec. 2-157. Residencv requirements. Each member of the RBG Commission shall be a resident of the City or an owner or employee of a business located in the City. Failure to be a resident of the City or employed by a business located in the City shall result in forfeiture of the position on the RBG Commission. The City Commission may waive the requirements of this section. Sec. 2-158. Appointment process; terms; annual review The appointment process shall occur in accordance with the terms and provisions of sections 2-57 and 2-58 of the City Code. Terms of appointees shall occur in accordance with the terms and provisions of section 2-59 of the City Code. The annual review shall occur in accordance with the terms and provisions of section 2-60 of the City Code. Sec. 2-159. — Duties and Responsibilities. The duties of the RBG Commission shall include but not be limited to the following duties, functions, powers and responsibilities: (1) To serve in an advisory capacity by making studies, reports and recommendations to the City Commission and to the City Manager; to make recommendations with respect to all matters pertaining to the status of women within the City of Tamarac, including but not limited to, the fair and equal treatment of women. To ensure that policies and practices are in place that do not discriminate against women, whether practice by government, individuals or corporations. To review working and living conditions of women, focus on the health and wellness of women, the delivery of public and private services to women and the education and training for women and public accommodations afforded to women; and (2) To make continuing studies with recommendations and reports of all City agencies, facilities, boards, services and programs dealing with or affecting women, including equal funding of such facilities, services and programs; and (3) To study, recommend and report any needed improvements and changes to the City ordinances, resolutions and written and unwritten policies and practices of the City; and (4) To appear before any governmental or non -governmental agency to present findings and recommendations on behalf of the City with the approval of the City Commission; and CODING: Words in stroke through type are deletions from existing law; Words in underlined type are additions. Ord. #2455 February 5, 2021 Page 3 of 4 (5) To operate and to conduct the affairs of the RBG Commission on the Status of Women within the Human Resources Department; and (6) To monitor the City's pay scale to ensure equal pay for women performing the same work as men; and (7) To meet as often as appropriate to perform its function; and (8) To perform any other functions as directed by the City Commission. Sec. 2-160. — Meetings The RBG Commission shall meet at least once a month at the regularly scheduled time which is to be approved by the City Clerk; the RBG Commission may determine annually its own vacation period not to exceed more than one (1) cancelled meeting per year. A quorum shall consist of a majority of the membership. Sec. 2-161. — Vacancies a. Removal of members. A RBG Commission member appointed by the City Commission serves at the pleasure of the City Commission and shall be removed at any time by majority vote of the City Commission. b. Resignation of members. A resignation by a RBG Commission member made either orally or in writing will be deemed accepted by the City Commission when the Board member announces his or her resignation to the City Commission, City Manager or RBG Commission. The Commission need not take any formal action to accept the resignation. Failure to attend three (3) consecutive meetings without being excused by the chairperson shall be deemed a resignation. SECTION 3. It is the intention of the City Commission of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this ordinance may be renumbered, re -lettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4. If any clause, section, or other part or application of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect. SECTION 5. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.
