Ord. #2467 March 3, 2021 Page 1 of 3 • CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2021 • - AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 16, PENSIONS AND RETIREMENT, ARTICLE IX, ELECTED AND APPOINTED OFFICERS AND NON-REPRESENTED EMPLOYEES RETIREMENT PLAN; AMENDING SECTION 16.902, ADMINISTRATION OF THE RETIREMENT PLAN; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac Elected and Appointed Officers and Non- Represented Employees Retirement Plan (the "Plan") Board of Trustees (the "Board") • has reviewed the proposed changes; WHEREAS, Plan retirees can bring experience and knowledge to the Board, therefore the City Commission and the Trustees of the Board desire to amend the Plan Document to provide retired members the ability to serve as Trustees on the Board; WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens of the City of Tamarac to amend the Plan to reflect this change; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section 16-902 of the City of Tamarac Code of Ordinances, is hereby amended to read as follows: CODING: Words in strike through type are deletions from existing law; Words in underscore type are additions. Ord. #2467 March 3, 2021 Page 2 of 3 Sec 16-902 Administration of the Retirement Plan. • (a) The sole and exclusive administration of, and the responsibility for, the proper effective operation of the retirement plan and for enforcing the provisions of this article is vested in a board of trustees. (b) The board of trustees consists of five (5) persons all of whom shall either be members or retirees of the plan. (1) Two (2) persons shall be elected from among the membership of the plan. (2) Two (2) persons shall be appointed by the City Manager. (3) tThe fifth person shall be appointed by the other four members of the board. Neither the City Manager nor a member of the City Commission shall serve as a trustee. SECTION 2: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of Ordinances of the City of Tamarac, Florida, and that the sections of this Ordinance may be renumbered or re-lettered, and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. . Ord. #2467 March 3, 2021 Page 3 of 3 • SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
