Ord. #2469 1111 March 9, 2021 Page 1 of 4 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2021- 0/ 9 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 2, ENTITLED "ADMINISTRATION", ARTICLE II, SECTION 2- 36 ENTITLED "CAMPAIGN FINANCE REPORTS" BY ADDING A PROVISION EXTENDING THE FILING DEADLINE DUE TO THE INOPERABILITY OF THE ELECTORNIC FILING SYSTEM; PROVIDING FOR CODIFICATION, CONFLICTS, AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 2020-006, requiring Mayor and Commission candidates file campaign finance reports electronically; and WHEREAS, the ordinance did not identify an alternate form of reporting if the campaign finance software were inoperable on the date the report is due; and WHEREAS, the City Clerk recommends the City Commission incorporate language for instances when the software may be inoperable and election candidates will be unable able to file campaign finance reports; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Section 2- 36 of the City's Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: • CODING: Words in struck through type are deletions from existing law; Words in underscored type are additions. Ord. #2469 March 9, 2021 • Page 2 of 4 SECTION 1 : The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof; all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: Article II, Section 2-36 entitled "Campaign Finance Reports" is HEREBY amended to read as follows: Sec. 2-36 — Campaign Finance Reports. a) Electronic reporting. Candidates for the office of mayor or city commissioner shall file their campaign treasurer's reports electronically with the city clerk. The city clerk shall determine the required format for the campaign treasurer's reports and shall provide copies of the form upon request. For purposes of this article, 411 "campaign treasurer's reports" or "reports" shall mean the reports required of the campaign treasurers of candidates pursuant to F.S. § 106.07, as may amended from time to time, Reports filed pursuant to this section shall be completed and filed through the electronic filing system not later than midnight of the day designated. Reports not filed by midnight of the day designated are late filed and subject to the penalties below, and all other applicable penalties, as otherwise provided by law. However, in the event the electronic filing system is inoperable on the date a report is due, the report will be accepted as timely filed if filed no later than midnight, Eastern Timer of the first business day the electronic filing system becomes operable again. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any • person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
