R- 2021 t' C) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING AN APPROPRIATION OF $14,569.00 FROM THE STATE LAW ENFORCEMENT TRUST FUND FOR THE PROVISION OF FUNDING CYCLYING EVENT AND CRIME PREVENTION INITIATIVE; AUTHORIIZING DONATION TO TAMARAC PARKS AND RECREATION FOUNDATION IN THE AMOUNT OF $14,569 FROM THE APPROPRIATE ACCOUNTS FOR THE PURCHASE OF EQUIPMENT FOR THE CYCLING EVENT; AUTHORIZING AN APPROPRIATION OF $14,569; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac currently contracts for police services with the Broward Sheriffs Office; and • WHEREAS, the City Commission of the City of Tamarac approved a five (5) year Agreement with the Broward Sheriffs Office as Resolution R-2020-092, which is on file in the City Clerk's Office; and WHEREAS, the Broward Sheriff's Office has requested funding for a Cops and Community Bike ride and Bike Give-away as detailed in the funding request attached as Exhibit A; and WHEREAS, the appropriation of the Law Enforcement Trust Funds (LETF) are governed by the City of Tamarac City Commission and may be appropriated for the Tamarac District's use within the boundaries of the City; and WHEREAS, in accordance with the requirements of Section 3.18 of the Broward Sheriffs Office Policy Manual, the request shown as Exhibit A has been determined to be • in legal compliance and signed off by BSO; and Temp. Reso. 13607 April 28, 2021 Page 2 • WHEREAS, the City Manager, the BSO Chief of the Tamarac District, and the Director of Financial Services recommend the acceptance of the application by BSO to authorize the use of $14,569.00 to provide funding for a Cops and Community Bike ride and Bike Give-away; and WHEREAS, the funds will be donated to the Tamarac Parks and Recreation Foundation, Inc (501c3) for the purchase of Bikes for a Bike Give-Away to Tamarac at- risk youth; and WHEREAS, the City Commission of the City of Tamarac, pursuant to the BSO Policy Manual, desires to appropriate an amount not to exceed Fourteen Thousand Five Hundred and sixty-nine and 00/100 ($14,569.00) Dollars from the State Law Enforcement Trust Fund. • NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits referenced in this Resolution are hereby incorporated herein and made a specific part hereof. Section 2: The City of Tamarac hereby approves the use of Fourteen Thousand Five Hundred and sixty-nine and 00/100 ($14,569.00) Dollars from the State Law Enforcement Trust fund for the purpose of providing funding for a ops and Community Bike ride and Bike Give- away. Section 3: An appropriation in the amount not to exceed Fourteen Thousand Five • Hundred and sixty-nine and 00/100 ($14,569.00) Dollars is hereby approved and will be Temp. Reso. 13607 April 28, 2021 Page 3 • included in a Budget Amendment prior to November 30, 2021, pursuant to F.S. 166.241(2). Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 6: All Resolutions or parts of Resolutions in conflict herewith be and the same are repealed to the extent of such conflict. Kathleen, The LETF request for the "Bike with Mike "event on May 22nd and 23rd for the amount of$14,569 has been approved by BSO. The funds have been authorized to be distributed to the Tamarac Parks and Recreation Foundation Inc. to purchase 50 bicycles and 50 helmets to at-risk youth.
