Gomez called the Wednesday, Feb. 10, 2021, City Commission Meeting, being held virtually, to order at 7:00 p.m. ROLL CALL: Commissioner Marlon Bolton, Commissioner Debra Placko, Vice Mayor Villalobos and Mayor Michelle J. Gomez were present virtually. Commissioner Mike Gelin arrived virtually at 7:02 p.m. Following roll call, Mayor Gomez asked for a moment of silence in honor of the FBI agents killed in Sunrise [Florida], everybody who is fighting for our country, who's lost their lives, and anybody we have lost due to COVID-19 or another illness. PLEDGE OF ALLEGIANCE: Mayor Gomez led the Pledge of Allegiance. 1. PROCEDURE FOR VIRTUAL MEETINGS Interim City Attorney, Hans Ottinot, outlined the process and procedures for conducting a virtual public meeting. 2. PROCLAMATIONS AND PRESENTATIONS a. Proclamation — Marjory Stoneman Douglas High School Remembrance Day is Requested by Mayor Gomez Mayor Gomez read the proclamation for the record. b. Proclamation — American Health Month Requested by Mayor Gomez Mayor Gomez read the proclamation for the record. c. Proclamation — Chinese New Year Requested by Mayor Gomez Mayor Gomez summarized the proclamation and recognized those individuals who will celebrate the holiday. d. Q4 2020 Neighborhood Beautification Recognition Program Mayor Gomez displayed pictures and recognized the following properties for their architectural appeal, landscape maintenance and sustainable designs. Commercial Property Misala Inc. (Marathon Gas) at 6921 NW 88th Avenue Sandra Reus, with Sunshine Gas, thanked the members of the Commission for recognizing the property. Residential Properties District 1: Evans & Linda Proctor Bailey at 5601 NW 4811 Terrace Ms. Bailey thanked the City for the great honor it has bestowed upon them. District 2: Elizabeth A & John A. Zarzycki at 5802 NW 86th Avenue Ms. Zarzycki stated she was amazed by the recognition because they have completely redone the front yard. District 3: Paula P Welte at 7601 NW 88th Way Ms. Welte was unable to attend. District 4: Kristy Delsalto at 8021 NW 831 Street Tracy Salter accepted on behalf of her wife, Krisy Delsalto, and thanked the City for recognizing their home. Salter stated they were new to the neighborhood, but have put in a lot of work to maintain the home. 3. CITY COMMISSION REPORTS a. Commissioner Bolton Commissioner Bolton stated he had nothing to report, except that it is Black History Month. He stated he has a video coming out tomorrow on his social media channels, for those that would like to view it. Bolton stated he finds joy in visiting with members of the community, and talking people about the wall that is coming to Commercial Blvd. The project is underway. Bolton also stated that he helped a representative with vaccinations this past Sunday, and it was a great success. Bolton then provided his Facebook and contact information for anyone who would like to reach out to him. b. Commissioner Gelin Commissioner Gelin provided a report, which is on file in the City Clerk's Office. Gelin also played a video called Black History in Two Minutes, featuring Henry Louis Gates. c. Vice Mayor Villalobos Vice Mayor Villalobos stated he did not have a report, but asked for a moment of personal privilege after City Manager and City Attorney comments, and public participation. d. Commissioner Placko Commissioner Placko presented a slide with information about who, where to call to make vaccination appointments. Placko stated she is happy to help, but we need to be patient in the coming weeks as the vaccine rolls out. e. Mayor Gomez Mayor Gomez stated she has had a few busy weeks. She attended the Florida League of Cities conference, and spoke with the Director of Emergency Management Jared Moskowitz regarding the vaccine, state resources, city reimbursements, etc. Gomez stated vaccine distributions are determined by the state, and to remain positive and patient with the process. Gomez stated, at the Broward League of Cities Directors meeting, a topic was HB219, regarding vacation rentals. She sent an email to the regulatory committee opposing HB219, which would prevent cities from regulating vacation rentals. She will send the information about the committee vote once she receives it. Gomez attend the ribbon cutting ceremony at Florida Medical Center today. The hospital has instituted a program that will determine if a patient needs ambulatory care or if they should see their primary doctor. Gomez stated the Housing Committee met this past Monday, and they have provided the County with their recommendations. We are still doing the food drives if there are residents who needs assistance. Every Saturday, at the Korean Methodist Church at 8 a.m., and Christian Life Center next Wednesday at 9 a.m. and Community Christian on Monday. Gomez mentioned there is a hundred year young individual in the community who will be celebrating his birthday tomorrow. I will be sending an invitation the Commission after the meeting, so join us tomorrow to say happy birthday. Vice Mayor Villalobos motioned to have a resolution drafted refraining from making any comment until FDOT addresses traffic issues. Commissioner Bolton seconded. Discussion by the City Commission ensued. Commissioner Bolton requested the City Attorney's Office issue an opinion, if it is appropriate to have a City Commission member talk about an application before it comes before this City Commission. Interim City Attorney, Hans Ottinot, advised the City Commission not to discuss quasi- judicial items before they come before the board 4. CITY ATTORNEY REPORT Interim City Attorney, Hans Ottinot, stated the court has asked the City to file responses no later than March 10, 2021, in the Woodmont Hotel litigation. S. CITY MANAGER REPORT Investment Report — November 2020 Investment Report City Manager, Michael Cernech, stated good evening Madam Mayor and Members of the City Commission. I would like to start by sharing some good news with you. We recently received the results for our 2020 Employee Survey and I am pleased to share with you that a record number of employees participated in the survey. Three -hundred and one (301) employees out of a possible 401 completed the Survey. In fact, ETC, the company who conducted the survey, stated Tamarac's level of employee participation is the highest they have ever seen for an Employee Survey. The major finding out of the survey is that 9 out of 10 employee's rate the City of Tamarac as a good employer. I would like to thank the employees who participated in the Employee Survey and say thank you to all of our employees for continuously improving our Strategic Goal # 6 by making Tamarac a Dynamic Workplace. And...I have more good news to share... This past year, despite some challenges due to the pandemic, our United Way Committee stepped up once again and rose to the challenge... they got creative, came up with some new fund raising activities, and were able to conduct a very successful fundraising campaign. I am happy to report that the City of Tamarac ranked #1 out of the 31 cities in Broward County for • employee giving. In total, this year our employees raised $24,437, which far exceeded their original goal. Thank you to the Committee for all of their hard work and to our employees for • their generous donation. In honor of Black History Month, the City will be offering the following programs and events: STORY WALK Please come out and participate in our Story Walk event. This family fun event will be held at Waters Edge Park, 7508 NW 61st Street this coming Saturday, February 13th from 10 a.m. to 12:00 p.m. Stroll through the park and enjoy a free interactive reading of "We all belong". Participants will receive a free book while supplies last. We ask that everyone who participates maintain social distancing. BLACK HISTORY MONTH CELEBRATION The Parks and Recreation Department cordially invites you to celebrate Black History Month at the Tamarac Sports Complex, 9901 NW 77 Street on Friday February 26th from 6:00 -8:30 p.m. Dr. Mark Lamont -Hill, American Academic, author, activist, and television personality will give a live virtual presentation that will be displayed on the large movie screen at the Tamarac Sports Complex. The evening will include an art display, poetry, dance, recognition of area black community leaders and the presentation by Dr. Hill. QUILTING A HISTORICAL PERSPECTIVE THROUGH ART Everyone is invited to participate in the virtual presentation of "Quilting, A Historical Perspective Through Art" on February 27th at 10 a.m. by world renowned South Florida artist George @ Gadson. Participants will be introduced to quilts that were used as tools for communication during the Underground Railroad, as well as quilts by artist, Faith Ringgold and Gees Bend Quilters. Participants will also be guided through a creative process that will allow them to create their own quilts using a variety of materials. FEEDING SOUTH FLORIDA DRIVE-THRU FOOD DISTRIBUTION The Feeding South Florida drive-thru food distribution events continue. The next distributions will take place on: Wed., Feb. 17 9:00 — 11:00am @ Christian Life Center Church Mon., Feb. 22 9:00 — 11:00am @ Community Christian Church I am happy to report that the City of Tamarac was named a 2020 Tree City USA by the Arbor Day foundation for the 28th consecutive year in honor of its commitment to effective urban forest management. Tamarac is one of more than 3,600 Tree City USA communities. The trees being planted and cared for by Tamarac are ensuring that generations to come will enjoy a better quality of life. The Community Development Housing Division wants you to know that Round 5 of the Emergency Residential Assistance Program to assist residents impacted by Covid 19 will open on Tuesday, February 16th. The program will continue to assist with mortgage, rent, utility payments and past due HOA fees. The application period will open on February 16 and will remain open until funds are exhausted. We have a public service announcement from our Information Technology Department. They would like to remind everyone to watch out for stimulus check scams. Scammers are always looking for new opportunities. Please be wary of any unsolicited emails or calls with messages that ask to "verify" or provide information, high-pressure tactics or ask you to pay a fee. Also, the IRS will not call, text or email anyone to verify their information. 6. PUBLIC PARTICIPATION Mayor Gomez read the rules for public comments during a virtual meeting, and Clerk Johnson read the following for the record. Clerk Johnson stated there were no sign ups to speak, or be contacted, and no emails submitted. 7. CONSENT AGENDA a. TR13552 —Revised Permit Fee Schedule —Private Providers A Resolution of the City Commission of the City of Tamarac, Florida, revising the City's Building Department Fees to become effective March 1, 2021, pursuant to Exhibit "A" attached hereto and incorporated herein; providing for conflicts; providing for severability; and providing for an effective date. Commission District(s): Citywide b. TR13561 — TFR Accept Donation of Electrostatic Sprayers A Resolution of the City Commission of the City of Tamarac, Florida, to approve Broward Healthcare Coalition Project Donation Agreement of one (1) Clorox 360 Electrostatic Machine and three (3) Victory Handheld Electrostatic machines at a value of $5,579.80, nunc pro tunc effective December 23, 2020; authorizing the appropriate City officials to execute the agreement; providing for conflicts; providing for severability; and providing for an effective date. c. TR13562 —Approve and Accept Broward County Reimbursement for completed Boulevards Drainage Project A Resolution of the City Commission of the City of Tamarac, Florida, accepting a reimbursement in the amount of $500,000.00 from Broward County for the completed drainage system improvements located along NW 54m Street and NW 28th Avenue and crossing Prospect Road; authorizing the appropriate City officials to execute and agreement and necessary documents between the City of Tamarac and Broward County for said reimbursement; providing for severability; and providing for an effective date. Commission District(s): Citywide Mayor Gomez asked the City Manager if there were any additions or deletions to agenda. City Manager, Michael Cernech, stated there were no additions or deletions. Commissioner Bolton asked to pull Item 7.d. TR13563. • Commissioner Gelin motioned to approve as amended. Commissioner Bolton seconded. Clerk Johnson conducted a roll call vote, and the motion to approve as amended carried unanimously (5-0). d. TR13563 —Authorization for Specification Writing Services for Emergency Assistance Repairs Program (Round 5) A Resolution of the City Commission of the City of Tamarac, Florida, approving a third amendment to the agreement with TSC Associates, Inc. to provide Home Inspector, Specification Write and Construction Liaison Services and increase the maximum amount to $300,000 and renewal through August 31, 2021; authorizing the appropriate City officials to execute amendment number three (3) attached hereto as Exhibit "1" and incorporated herein; providing for renewals; providing for conflicts; providing for severability; and providing for an effective date. Discussion by the Commission ensued. Clerk Johnson conducted a roll call vote, and the motion to approve carried 3-2 with Vice Mayor Villalobos and Commissioner Bolton dissenting. • 8. REGULAR AGENDA a. TR13560 —Award Bid No 21-04B for the Commercial Blvd. Force Main Project A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid No. 21-04B to and approving an agreement with Stanford and Sons Trucking Corp., dba Stanford Construction Co., to construct the Commercial Boulevard Force Main Replacement Project for the contract amount of $384,264.44; providing for a contingency in the amount of $57,639.67 to the project account for a total project budget of $441,904.11; authorizing an expenditure from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney, Hans Ottinot, read the title for the record. Commissioner Placko motioned to approve. Commission Gelin seconded. Public Services Director, Jack Strain, provided a presentation, which is on file in the City Clerk's Office. Mayor Gomez confirmed with the City Clerk that there were no comments from the public on this item. Discussion by the Commission ensued. The Commission requested staff reach out to • the HOA's in the area, and place door hangers to alert residents of project. • Clerk Johnson conducted a roll call vote, and the motion carried unanimously (5-0). b. TR13565 —Granting Keys to the City and Proclamations A Resolution of the City Commission of the City of Tamarac, Florida, establishing a policy for awarding Keys to the City and granting City Proclamations; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney, Hans Ottinot, read the title for the record. Commissioner Bolton motioned to approve, and Commissioner Gelin seconded. Mayor Gomez confirmed with Clerk Johnson that there were no public comments for this item. Discussion by the Commission ensued, with Commissioner Bolton amending his motion adding language to Section 2(a) that keys may also be awarded for acts of heroism, and that Section 3(d) that citizens can request proclamation six (6) business days prior to the meeting. Following discussion Clerk Johnson conducted a roll call vote, and to the motion as amended carried 4-1, with Vice Mayor Villalobos dissenting. • Mayor Gomez recessed the meeting at 9:37 p.m. and reconvened at 9:50 p.m. 9. ORDINANCE(S) — FIRST READING a. TO2437 — Revised Flood Ordinance An Ordinance of the City Commission of the City of Tamarac, Florida, amending chapter 8 of the code of Ordinances of the City of Tamarac, entitled "Flood Prevention and Protection," by amending Article I, entitled "Administration," by specifically amending §8- 9, entitled "Basis for Establishing Flood Hazard Areas," and Article II, entitled "Definitions," by specifically §8-47, definitions used in this chapter, and Article III, entitled "Flood Resistant Development," by specifically amending §8-48-2, §8-48.3, and §8-59 "Specific methods of Construction and requirements as mandated by the Federal emergency Management Agency (FEMA)"; providing for conflicts; providing for severability; providing for codification; and providing for an effective date. TO2447 — Ordinance requiring Electric Charging Stations in all multifamily and non-residential new development An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 10 of the City of Tamarac Code of Ordinances, entitled "Land Development Code" by amending Article 4, entitled "Development and Design Standards" specifically amending Section 10-4.3, entitled "Off -Street Parking and Loading" by creating Section 10-4.3(J), entitled "Electric Vehicle Parking Requirements"; and amending Article 6 entitled "Rules of Construction and Definitions," specifically amending Section 10-6.3 entitled "Other Terms Defined" to provide for additional terms and definitions for electric vehicle charging stations; providing for additional terms and definitions for electric vehicle charging stations; providing for codification; providing for severability; and providing for an effective date. TO2452 — Ordinance amending the Woodlands Overlay District to strike approval of exterior colors for single family homes from the City's authority and granting approval to the WHOA An Ordinance of the City Commission of the City of Tamarac, Florida, mending Chapter 10 of the City of Tamarac Code of Ordinances, entitled "Land Development Code" by amending Article 2, entitled "Zoning Districts" specifically amending Section 10-10- 2.7(C), entitled "Woodlands Overlay District," by striking the paint approval authority granted to the City under Section 10-2.7(C)(7), entitled "Exterior Colors for Single -Family Dwellings" as same is now within the purview of the Woodlands Homeowners Association ("WHOA"); providing for codification; providing for conflicts; providing for severability; and providing for an effective date. TO2456 — Amending Section 2-425 " Travel Expense" An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 2 "Administration" and amending Article XII, entitled "Travel"; specifically amending Section 2-242, entitled "Travel Expenses", to provide for an optional fixed expense account for elected officials upon request; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney, Hans Ottinot, read the title for the record. Vice Mayor Villalobos motioned to approve. Commissioner Gelin seconded. Discussion by the Commission ensued. Mr. Ottinot clarified this is optional for members of the Commission to opt -in. If a commission member does not opt in, they will need submit receipts for reimbursement. TO2458 — Amending Chapter 2 — "Comprehensive Procedures" An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 2 of the City's Code of Ordinances, entitled "Administration" specifically amending Section 2-29, 2-32 and 2-34; providing for new meeting time for the second regular City . Commission meeting; providing for the City Commission as a body to regular debate and public discussion; providing for paid legislative aides; providing for the placement of four (4) items on the agenda by a member of the City Commission; providing for the reading of a proclamation by the sponsor; and providing for the issuance of the Key to the City by the sponsor; providing for the penalties; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Discussion by the Commission ensued related to the previous item [Travel Expenses], there being a separate line item and it being inclusive of the car allowance. Discussion continued related to regulating debate, right to remove members of the public or the Commission, and to have the City Attorney research that Tamarac residents have preference for the Legislative Aide positions. TO2459 — Amending Section 6-148 "Exclusions and Exceptions to Bid Proposal Requirements" An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 6 entitled Finance and Taxation"; amending Article V, entitled "Tamarac Procurement Code"; specifically amending Section 6-148 entitled "Exclusions and Exceptions to Bid and Proposal Requirements" of the Tamarac Code of Ordinances; providing for conflicts; providing for severability; providing for codification; and providing for an effective date. TO2449 — Amending Section 15-43 "Membership" for the Parks Board • An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 15 of the Tamarac Code, entitled "Parks and Recreation," Article II "Administration," Division 2, Parks and Recreation Board," Section 15-43, to have appointed members of the board serve terms concurrent with their appointing Commissioner and the Chairman shall be selected by the majority of the members of the board to serve a term of two years; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney, Hans Ottinot, read the title for the record. Commissioner Placko motioned to approve. Commissioner Gelin seconded. Mayor Gomez confirmed with Clerk Johnson that there were no comments from the public regarding this item. Clerk Johnson conducted a roll call vote and the motion to approve carried unanimously (5-0). 12. QUASI-JUDICIAL HEARING(S) 13.OTHER • a. Discussion and possible direction related to City Commission Initiatives City manager, Michael Cemech, provided a presentation, which is on file in the City Clerk's Office. Discussion by the Commission ensued, and asked that the topic be refined and brought back for discussion at a workshop. Vice Mayor Villalobos made motion to extend the meeting until business is complete. Commissioner Placko seconded. Clerk Johnson conducted a roll call vote, and the motion to extend until business is completed carried unanimously (5-0). b. Discussion related to convening the Charter Board City Clerk, Jennifer Johnson, provided a presentation, which is on file in the City Clerk's Office. Discussion by the Commission ensued. Vice Mayor Villalobos asked for information regarding at -large voting districts and why the Mayor votes last. He requested bringing something forward changing that at the next meeting.
