HomeMy WebLinkAbout2021-03-10 - City Commission Regular Meeting MinutesCity of Tamarac Virtual City Commission - Minutes Wednesday, March 10, 2021 CALL TO ORDER: Mayor Gomez called the Wednesday, March 10, 2021, Virtual City Commission meeting to order at 7:00 p.m. ROLL CALL: Commissioner Marlon Bolton, Commissioner Debra Placko, Vice Mayor Elvin Villalobos, and Mayor Michelle J. Gomez were present virtually. Commissioner Mike Gelin arrived virtually at 7:03 p.m. Also present were City Manager Michael C. Cernech, Interim City Attorney Hans Ottinot, and City Clerk Jennifer Johnson. PLEDGE OF ALLEGIANCE: Commissioner Gelin led the Pledge of Allegiance. 1. PROCEDURES FOR VIRTUAL MEETINGS Interim City Attorney, Hans Ottinot, summarized the procedures for conducting virtual meetings including the public comments portion of the meeting and conducting a roll call vote. 2. PROCLAMATIONS AND PRESENTATIONS a. State of the City Address by Mayor Michelle J. Gomez Requested by Mayor Gomez Mayor Gomez introduced the 2021 State of the City Video, followed by the 2020 Accomplishments video. b. Proclamation — Women's History Month Requested by Commissioner Bolton Commissioner Bolton read the proclamation, and Mandy Johnson was in attendance to accept the proclamation. c. Proclamation — International Women's Day (Girl UP) Requested by Mayor Gomez Mayor Gomez read the proclamation, and Alexandra Hernandez, President, Girl Up, an initiative by the United Nations Foundation, was in attendance to accept the proclamation. d. Proclamation — Red Cross Month Requested by Mayor Gomez Mayor Gomez read the proclamation, and Freddie Hennessy, Executive Director of the American Red Cross of Broward County, was in attendance to accept the proclamation. e. Proclamation — Bleeding Disorders Awareness Month Requested by Mayor Gomez Mayor Gomez read the proclamation, and Debbie Adamkin, Executive Director, and Kim Madeiros, Development Director for the Florida Hemophilia Association, were in attendance to accept the proclamation. f. Proclamation — Honoring Pranav Gupta Requested by Commissioner Gelin Commissioner Gelin read the proclamation, and Pranav Gupta was in attendance to accept the proclamation. 3. CITY COMMISSION REPORT a. Commissioner Bolton Commissioner Bolton commended Pranav Gupta for his efforts bringing forward an ordinance to turn off sprinklers during school crossing time zones. Commissioner Bolton made a motion to suspend the six -day rule to add an item to the agenda in accordance with Section 2-34(d) of our Code, allowing that I discuss an item with possible action immediately and for this item, I would like to suspend Robert's Rules of Order. Commissioner Gelin seconded. Clerk Johnson confirmed there were no public comments for this item. Mayor Gomez requested clarification on the 48-hour rule for adding items to the agenda. Interim City Attorney affirmed Commissioner Bolton is proceeding in accordance with the Charter, and the City Commission procedures. Clerk Johnson conducted a roll call vote, and the motion carried unanimously 5-0- Discussion by the Commission ensued. Commissioner Bolton moved that effective immediately, Hans Ottinot would assume the permanent City Attorney position for the city of Tamarac. Commissioner Gelin seconded. Discussion by the Commission ensued relative to continuing the process of requesting letters of interest from firms interested in serving as the permanent city attorney. Following discussion, Clerk Johnson conducted a roll call vote, and motion carried 4-1 with Mayor Gomez dissenting. b. Commissioner Gelin Commissioner Gelin provided a presentation, which is on file in the City Clerk's Office. c. Vice Mayor Villalobos Vice Mayor Villalobos encouraged residents to stay in touch, stay engaged and feel free to reach out if you have any questions. d. Commissioner Placko Commissioner Placko provided comments about the late Commissioner Diane Glasser. Placko commended her on being a mover and shaker, and for taking her under her wing when she first started. With that, Placko stated she would be sponsoring two $2500 scholarships, in honor of Diane Glasser, to help young students with their education endeavors. Placko stated the requirements and deadline are available for download from the City's website. e. Mayor Gomez Mayor Gomez waived providing a report. 4. CITY ATTORNEY REPORT City Attorney, Hans Ottinot, thanked the Commission for supporting him, and said the firm would continue to work hard for the City. Mayor Gomez asked that he send out an introduction of the other attomey he has hired to work for the firm. 5. CITY MANAGER REPORT a. Investment Report— January 2021 b. City Manager, Michael Cemech, stated the City of Tamarac and Broward Sheriffs Office . welcome Deputy Kaitlyn Spehr to the Tamarac District. Deputy Spehr has been assigned as our new business community -policing liaison in an effort to enhance communication and problem solving with our vast business district. Her first priority will be to meet with as many businesses as possible to see how BSO can assist them with keeping their business, employees and patrons safe. We are very happy to have Deputy Spehr here with us in Tamarac. The Community Development Department wants you to know that the second installation of Inspiration Way is currently underway. Vibrant new art pieces are being installed on the Nob Hill corridor between Commercial Boulevard and McNab. You are encouraged to do a drive by to see the new colorful pieces as they are being installed. For those residents looking for something to do, we have some exciting things happening during the month of March at Parks and Recreation... Please come out and check out the NEW Aquatic Complex Park! Located adjacent to the Caporella Aquatic Center at 9300 N.W. 58th St., the City's newest park includes a covered playground, covered seating, walking path, Wi-Fi and a picnic shelter. Guests can park near the pool and walk across the bridge to the park. The park is open from 8 a.m. —dusk. Everyone is invited to the Wet & Wild Egg Splash on Saturday, March 20th at the Caporella Aquatic Center. Bring your swimsuit and basket to enjoy a decorated pool deck and a 2-hour pool session while going on a splashing egg hunt. Please pre -register at www.tamarac.me/events, cost is $5 per guest. The event starts at 10:00 am and • sessions will be divided by age. Please contact the Caporella Aquatic Center for further details at 954-597-3660. All guests are required to wear facial coverings at all times, except when enjoying the pool. The Parks and Recreation department along with the Broward Sheriffs Office are bringing "Floppy the Bunny" to your door for a personal visit this Easter season! Floppy will be escorted by BSO for surprise visits on March 20th or 2711 from 10am-12pm. Included will be a 3-5 minute visit with Floppy and a goody bag. Face masks are required. Please sign up at www.tamarac.me/events for a home visit. The cost is $5 per child per visit. We are continuing with the Feeding South Florida Tamarac food distributions. TR13544 —Sister Cities Committee Appointments A Resolution of the City Commission of the City of Tamarac, Florida, appointing five (5) member members to the Sister Cities Committee to serve a term concurrent with their • appointing a Commission member, or until such time as new appointments are made; providing for conflicts; providing for severability; and providing for an effective date. b. TR13568 —Purchase of a Replacement Trash Pump A Resolution of the City Commission of the City of Tamarac, Florida, approving the purchase of two (2) trash pumps for Stormwater and Wastewater Services, utilizing competitive procurement methods and current agreements available for cooperative purchases at the time of purchase including Agreements awarded by the Florida Sheriffs Association Contract FSA20-EQU18.0 Specification #276, and Thompson Pump Sourcewell Contract Number 012418-TPM, in an amount not to exceed $114,735.00; authorizing an expenditure in the amount not to exceed $114,735.00 from the appropriate accounts; providing for conflicts; providing for severability; and providing for an effective date. c. TR13569 —Authorizing a 4-week Hiatus A Resolution of the City Commission of the City of Tamarac, Florida, authorizing a four - week consecutive period (July 16, 2021 —August 13, 2021) in which time the City Commission will not schedule any regular meeting pursuant to Section 4.06(a) of the City Charter; providing for conflicts; providing for severability; and providing for an effective date. d. TR13575 —Surplus MREs Donation • A Resolution of the City Commission of the City of Tamarac, Florida, to approve a donation of surplus of MREs (meal -ready -to -eat) to the National Firefighters Association of Peru at a value of $5,587.20; authorizing the appropriate city officials to approve the . MREs donation; providing for conflicts; providing for severability; providing for an effective date. e. TR13576 — Setting the Second Regular City Commission Meeting Time A Resolution of the City Commission of the City of Tamarac, Florida, establishing 7:00 p.m. as the time to begin the City Commission's second regular meeting of the month; providing for conflicts; providing for severability; and providing for an effective date. City Manager, Michael Cernech, stated there were no additions or deletions. Commissioner Gelin motioned to approve. Vice Mayor Villalobos seconded. There being no discussion, Clerk Johnson conducted a roll call vote, and the motion to approve carried unanimously 5-0. 8. REGULAR AGENDA a. TR13577 —Naming Policy A Resolution of the City Commission of the City of Tamarac, Florida, establishing a policy for the name or renaming of streets, parks, and city -owned facilities; providing the City Manager with the authority to do all things necessary to effectuate the policy; • providing for the repeal of conflicting resolutions; providing for severability; and providing for an effective date. Interim City Attorney City Attorney, Hans Ottinot, read the title for the record. Commissioner Gelin motioned to approve. Vice Mayor Villalobos seconded. City Clerk Johnson confirmed there were no comments from the public on this item Discussion by the Commission ensued relative to having the entire length of Southgate Blvd. named after Congressman Alcee Hastings, having NW 108 Terrace named after former Commissioner Diane Glasser, the impact on homes and businesses on these roads if there is name change, renaming be on a case -by -case basis, etc. City Clerk Johnson conducted a roll call vote and the motion to approve carried unanimously 5-0. 9. ORDINANCE(S) — FIRST READING a. TO2460 — Ordinance amending the City of Tamarac Code of Ordinances to allow Food Trucks in the City of Tamarac in certain zoning districts An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 10 of the City of Tamarac Code of Ordinances, entitle entitled "land Development Code" by amending Article 3, entitled "Use Regulations", amending Section 10-3.5, entitled • "Temporary Uses and Structures" by specifically amending subsection 10-3.5(G)(3) entitled "Food Truck" of the City of Tamarac Code of Ordinances, to provide definitions, terms and regulations for food trucks operating within the City of Tamarac; providing for conflicts; providing for severability; providing for codification; and providing for an • effective date. Interim City Attorney City Attorney, Hans Ottinot, read the title for the record. Commissioner Bolton motioned to approve. Commissioner Placko seconded. Maxine Calloway, Director of Community Development, provided a presentation, which is on file in the City Clerk's Office. Discussion by the Commission ensued, related to how many trucks the city would authorize, where they can park, fees, period they are authorized to be open, etc. Commissioner Bolton amended his motion to include operating hours of Tuesday — Sunday, from 9 a.m., to 10 p.m., and removing the restaurant restrictions. Commissioner Placko seconded the amendment. Mayor Gomez opened for public comment, and David Gilbert, and his wife, joined the meeting. Gilbert thanked the members of the Commission. Clerk Johnson conducted a roll call vote and the motion to approve, as amended, carried Unanimously 5-0. b. TO2462 — Amendment to the Code of Ordinances to turn off sprinklers during school zone times • An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 22, Article Vill of the Code of Ordinances of the City of Tamarac, entitled "Water Conservation Regulations", specifically amending Section 22-303 entitled "Year -Round Permanent Landscape Irrigation Measures" to extend the schedule in which no water use restrictions are in effect to 7:00 a.m. to ensure the sfety safety of our residents and children that use the sidewalks during school hours; providing for conflicts' providing for severability; and providing for an effective date. Interim City Attorney City Attorney, Hans Ottinot, read the title for the record. Commissioner Bolton motioned to approve. Commissioner Placko seconded. Mayor Gomez opened for public comments. Mr. Pranav Gupta joined, and thanked the Commission for considering this item. Clerk Johnson confirmed there were no other comments, and Mayor Gomez closed public comments. Discussion by the Commission ensued. Following discussion, City Clerk Johnson conducted a roll call vote and the motion to approve carried unanimously 5-0. TO2455 — Creation of the Ruth Bader Ginsburg Commission An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 2m "Administration," Article III, "Boards, Committees, Commissions," of the City of Tamarac Code of Ordinances, by creating Division 5, "United States Supreme Court Justice Ruth Bader Ginsberg Commission on the Status of Women:" providing for appointment of members; providing for term of office; providing for duties and powers; providing for conflicts; providing for severability; providing for codification; and providing for an effective date. Interim City Attorney City Attorney, Hans Ottinot, read the title for the record. Commissioner Bolton motioned to approve. Vice Mayor Villalobos seconded. City Clerk Johnson confirmed there were no comments from the public on this item. TO2457 —Amending Section 2-58(a) "Application Process" An Ordinance of the City Commission of the City of Tamarac, Florida, amending Article III of the Code of Ordinances entitled "Boards, Committees, Commissions" by specifically amending Sec. 2-58(a) "Application Process" by providing for discretion and flexibility when advertising for board and committee vacancies; providing for conflicts; providing for severability; and providing for an effective date. Interim City Attorney, Hans Ottinot, read the title for the record. Commissioner Bolton motioned to approve. Vice Mayor Villalobos seconded. City Clerk Johnson confirmed there were no comments from the public on this item. TO2461 — Amending Chapter 2 "Comprehensive Procedures" Voting Order An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 2 of the City's Code of Ordinances, entitled "Administration", amending Article II, entitled "City Commission", by specifically amending Section 2-34 entitled "Comprehensive Procedures for City Commission Meetings" to provide in subsection (K) "Voting Procedures" that the order of voting at Commission Meetings shall rotate in a random • manner for all members; providing for codification; providing for conflicts; providing for severability; providing for an effective date. CARES Act, Community Development Block Grant — Coronavirus (CDBG-CV) Citizen input for the CARES Act, Community Development Block Grant — Coronvirus Coronavirus (CDBG-CV) federal funding program competitive solicitation issued by the Florida Department of Economic Opportunity (DEO) with funding provided by the U.S. Department of Housing and Urban Development (HUD) Community Development Block (CDBG) to address, prevent, prepare for, and respond to the COVID-19 pandemic. The project will provide for construction/reconstruction of sidewalks to allow for social distancing and ADA accessibility to mass transit for Tamarac residents in LMI (low to moderate income) locations within the City. The City of Tamarac is requesting $181,156. Mayor Gomez open for comments from the public.
