Regular City Commission Meeting - Minutes
Wednesday, Sept. 23, 2020
CALL TO ORDER: Mayor Gomez called the Wednesday, Sept. 23, 2020, Virtual City
Commission Meeting to order at 9:30 a.m.
ROLL CALL: Mayor Michelle J. Gomez, Vice Mayor Marlon Bolton, Commissioner Gelin,
Commissioner Debra Placko and Commissioner Julie Fishman were present.
Also present were City Manager Michael C. Cernech, Assistant City Attorney Sam Goren and
City Clerk Jennifer Johnson.
PLEDGE OF ALLEGIANCE: Commissioner Fishman led the Pledge of Allegiance.
Mayor Gomez observed a moment of silence in honor of Joe Thalenfeld.
PROCEDURES FOR VIRTUAL MEETINGS
City Attorney, Sam Goren, provided details related to the authorization of virtual
meetings, as outlined in the Governor's Executive Order 20-62 and further extended by
Executive Order 20-193. Goren also outlined the public's right to access, and the need
for conducting a roll call vote for all items in the virtual environment.
2. PROCLAMATIONS AND PRESENTATIONS
Mayor Gomez read or summarized the following proclamations for the record.
a. Proclamation — Pedestrian Safety Month
Requested by Commissioner Gelin
Ms. Doris Span, who lost her husband after being struck by a motor vehicle, thanked
the Commission and the City of Tamarac for being serious about pedestrian safety.
She mentioned the Don't Forget Willie Foundation, and proudly announced the
foundation had awarded its third scholarship to a seventh grader at New
Renaissance Charter School at University. This student has pledged to stay safe on
our sidewalks, raise pedestrian safety awareness in her community and to assist
mobility impaired seniors.
b. Proclamation — Choose Peace Week
Requested by Mayor Gomez
c. Proclamation — Customer Service Week
Requested by City Manager Cernech
Interim Senior Strategic Communications Officer accepted on behalf of the Customer
Service Team, and recognized the importance placed on providing excellent
customer service always.

d. Proclamation — National Voter Registration Day
Requested by Mayor Gomez
e. Proclamation — University Hospital
Requested by Commissioner Placko
Jason Cunningham, and members of the University Hospital staff, accepted the
proclamation. Cunningham thanked the Commission and the City of Tamarac for the
award, stating this summer has been arduous but everyone pitched in, in response
to this pandemic. The staff, and front-line workers rose above and will rise again if
necessary.
3. CITY COMMISSION REPORTS
a. Vice Mayor Bolton

b. Commissioner Gelin
Commissioner Gelin provided a presentation, which is on file in the City Clerk's Office.
c. Commissioner Fishman
Commissioner Fishman stated it was just Rosh Hashanah, and part of Rosh Hashanah
is reflecting on the past year. Fishman then read the following statement. This has been
a very difficult year by any measure. When you look at the lives lost to COVID-19 and
the impact this pandemic continues to have on our daily lives and our economy: When
you factor in the growing unrest across our country because of the actions of rogue
police officers and bad police policies: Taking a look at the amount of activity in the
Atlantic and Pacific Oceans this hurricane season and the wildfires raging in California,
Oregon and Washington it would appear that Mother Nature is pissed and not playing
around anymore: and finally, when you count the loss of civil rights and women's rights
icons like Reverend C.T. Vivian, Congressman John Lewis and most recently Federal
Supreme Court Justice Ruth Bader Ginsberg our country has been dealt with much in
2020. How we as a people choose to handle this crisis will tell a lot about the crises
direction our country will take going forward. I read an article this morning entitled "The
Forgotten Meaning of `We the People,' taking into account that slaves and women were
not included in that phrase at the time, and in that article it talks about our democracy
being on trial at all levels of government and I agree. I also believe that the state of our
humanity is on trial and here is why:
I remember when I could disagree with someone's point of view without having to
demonize that person or denigrate them because we disagree. Politics has
created the need to be right above all else.
I remember a time when people took care of their neighbors without looking at
what's in it for me.
• 1 remember when elected officials chose to act with integrity and honesty in all
their dealings and served because they believed in service above self instead of
for their own benefit.

This article is a call to action for elected officials and citizens alike to ensure that we
continue to use our voices and our votes. We must ensure that voting rights are for all
people, not just those who have paid their fees and fines. We must stand up for our
constitutional right to peaceful assembly. And finally, we must take better care of each
other in our daily lives. None of us is going through this alone. Together we can and will
get through this year!
d. Commissioner Placko
Commissioner Placko did not have comments.
e. Mayor Gomez
Mayor Gomez stated she was pleased to share the City has received its next installment
of Community Development Block Grant CARES Act funding. A total of $339,281, or a
cumulative total of $584,731, which will go to the needs of the City. Gomez stated she
has been continuing to attend virtual meetings. I had the pleasure of attending the
Tamarac Elementary PTA meeting last night, and we continue to do what we can to help
our schools, children and parents. Food distributions continue. Just to remind everyone,
we will only be having them on Saturday mornings for the next two weeks at the Korean
Methodist Church. We will start twice a week in October.
4. CITY ATTORNEY REPORT
City Attorney, Sam Goren, provided details related to the complaint filed WCC
Development Agreement against the City. We are preparing an answer to the complaint,
as well as a proposed counterclaim, to the allegations in the complaint. Whatever
hearing could have been scheduled this morning, with regard to the Cure Plan, has now
been sidestepped by the filing of the lawsuit. The item before you today does require a
motion and carry to the legal obligation to file an answer and counterclaim to preserve,
protect and offer the City's legal position in the matter.
Commissioner Placko motioned to have counsel file a counterclaim as well a response
to litigation of Woodmont Country Club. Commissioner Fishman seconded.
Clerk Johnson conducted a roll call vote, and the motion carried unanimously 5-0.
City Attorney Goren outlined the process for the complaint and filings for the case.
Discussion by the Commission ensued related to trying to get to a resolution with WCC,
and if special counsel had already been appointed.
5. CITY MANAGER REPORT
a. Investment Report — July 2020
Commission District(s): Citywide
To start with this morning, I would like to take this opportunity to recognize and
congratulate our employees who have reached City service milestones over the past
year.

Collectively, this group of individuals has given over 400 years of dedicated service to
the City and I would like to express my thanks and appreciation to all of them.
Although current circumstances prevent us from recognizing these individuals in our
typical Tamarac way, we have prepared a presentation to celebrate their reaching of the
milestones. I am sure you join me in thanking our colleagues for their service. A video
was played in honor of the service awards and is available in the City Clerk's Office.
Tamarac Parks and Recreation cordially invites everyone to join us for the next drive-in
movie in the Park. Come out to the Sports Complex, 9901 NW 77' St., Friday, October
2n,1to watch "Haunted Mansion". A free bag of snacks will be provided for each car.
Attendees must stay in their vehicle.
Space is limited! Registration is needed to enter the event.
The City of Tamarac Parks and Recreation Department is excited to announce it's
newest adult sport league, Co -Ed Cornhole. This league will be for ages 18 and older
and will be co-ed. Games will be played at the Tamarac Recreation Center, 7501 N.
University Drive. Registration dates from September 21s'to October 2"d
The Community Development Housing Division wants you to know that the City's
Emergency Assistance Programs for COVID 19 related relief are still underway with 140
applications reviewed to date, 32 households assisted and $110,249.49 in funds
expended. Applications are being reviewed on a daily basis with new enrollment
opportunities expected to occur in the near future with the use of the County's Cares Act
allocation.
The City continues to do well with our response rate for the Census. The Census Bureau
has been out working to complete data collection as quickly and safely as possible. All
offices are scheduled to complete their work by September 30, 2020.
The current self -response rates are:
National — 66.2%
Florida — 63.0%
Broward — 62.3%
Tamarac — 71.7%
1 am happy to report that we have already surpassed our response rate from 2010 which
was 69%.

b. TR13495 - City Furniture Donation Acceptance
A Resolution of the City Commission of the City of Tamarac, Florida, awarding Bid
Number 20-14B and approving an agreement with Southern Underground Industries,
Inc. for the construction of the Water Treatment Plant Finished Water Meter Upgrade
Project in the amount of $432,010.00, a contingency of $43,201.00 (10%) will be
added to the account for a project total of $475,211.00; authorizing an additional
appropriation in the amount not to exceed $350,211.00 to be included in a future
budget amendment pursuant to F.S. 166.241(2); authorizing the appropriate City
officials to administer the contract; providing for conflicts; providing for severability;
and providing for an effective date.

c. TR13500 — Appointment of one Locally Elected Official to the Affordable
Housing Advisory Committee
A Resolution of the City Commission of the City of Tamarac, Florida, appointing one
locally elected official to the City's Affordable Housing Advisory Committee (AHAC)
as required by House Bill 1339, Section 420.9076 (2) Florida Statutes and City
Ordinance No. 2008-04; providing for expiration of terms of office; directing City staff
to take any and all action necessary to effectuate the intent of this resolution;
providing for conflict; providing for severability; and providing for an effective date.

d. TR13503 —Task Authorization No. 20-20D Tamarac/Sunrise Commercial
Boulevard Landscaping Improvements
A Resolution of the City Commission of the City of Tamarac, Florida, approving Task
Authorization No. 20-20D and authorizing the appropriate City officials to execute
Task Authorization No. 20-20D with Miller Legg to provide professional landscape
architectural design and construction administration related services, attached hereto
as Exhibit "1", for the Commercial Boulevard Median Improvements project in joint
participation with the City of Sunrise, Florida, in accordance with the City's consulting
engineering agreement as authorized by Resolution No. R-2016-80, for an amount
not to exceed $121,200.00; authorizing the execution of a joint participation and
associated maintenance agreements between the City of Tamarac and the City of
Sunrise, in furtherance of the scope of the professional services, hereto attached as
Exhibit "2"; providing for conflicts; providing for severability; and providing for an
effective date.

City Manager Cernech stated there were no additions or deletions this afternoon.

Vice Mayor Bolton motioned to approve the Consent Agenda. Commissioner Placko
seconded.

Clerk Johnson conducted a roll call vote, and motion to approve the Consent Agenda
carried unanimously 5-0.
Mayor Gomez recessed the meeting at 10:36 a.m. and adjourned at 10:50 p.m.
8. REGULAR AGENDA — NONE
a. TR13460 — 2020 Agreement for police services with BSO
A Resolution of the City Commission of the City of Tamarac, Florida, approving the
Agreement for Police Services between the City of Tamarac and the Sheriff of
Broward County (BSO) effective October 1, 2020 through September 30, 2025 with
one five (5) year renewal option; authorizing the appropriate city officials to execute
the agreement for Police Services; providing for conflicts; providing for severability;
and providing for an effective date.
City Attorney Goren read the title for the record.
Mayor Gomez requested a motion and second.
Commissioner Fishman motioned to approve. Commissioner Gelin seconded.
Lt. Col. David Holmes, of the Broward Sheriffs Office, and Capt. Jeff Cirminiello, BSO —
District 7, answered questions from the Commission related to contract and other law
enforcement related issues.
Clerk Johnson confirmed there were no public comments for this item.
Clerk Johnson conducted a roll call vote and the motion to approve carried unanimously
5-0.
Mayor Gomez recessed the meeting at 1:28 p.m. and reconvened at 1:50 p.m.
b. TR14360 — BSO Services for the Parks & Recreation Department
A Resolution of the City Commission of the City of Tamarac, Florida, approving a
Broward Sheriff's Office permit application for special details and authorizing the
appropriate City official to execute the permit application for police services to be
used by the Parks and Recreation Department in an amount not to exceed $76,000
in FY21, October 1, 2020 — September 30, 2021; approving funding from the
appropriate Parks and Recreation accounts; providing for conflicts; providing for
severability; and providing for an effective date.

A Resolution of the City Commission of the City of Tamarac, Florida, approving a
Memorandum of Understanding with the Federation of Public Employees, a division
of the National Federation of Public and Private Employees (FPE) affiliated with
District 1 — MEBA (AFL-CIO) to extend the terms and conditions of employment in
the existing Collective Bargaining Agreement between the City of Tamarac and the
FPE for the period from October 1, 2020 through September 30, 2021; authorizing
the appropriate City officials to execute the Memorandum of Understanding;
providing for conflicts; providing for severability; and providing for an effective date.

A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the
appropriate City officials to award Bid #20-21 B, "Furnish, Deliver and Discharge of
Quicklime" to, and execute agreements with Ljoist North America of Alabama, LLC
for the City of Tamarac and an additional twenty-three members of the Southeast
Florida Governmental Purchasing Cooperative (CO-OP); and with Carmeause Lime
and Stone on behalf of the CO-OP member, the City of Hollywood, for a period of
three (3) years with three (3) additional one-year renewal options, providing for
conflicts; providing for severability; and providing for an effective date.

e. TR13504 —Accepting and authorizing the execution of Interlocal Agreement
with Broward County for a subrecipient grant agreement with Department of
the Treasury for Coronavirus relief funding
A Resolution of the City Commission of the City of Tamarac, Florida, approving the
form of subaward agreement with Broward County for Cares Act Funding,
authorizing the appropriate City Officials to execute the final subaward agreement;
authorizing the City Manager or his designee to take all steps necessary and to
execute all documents necessary to provide for the City's receipt of Cares Act
Funding from Broward County; authorizing City Manager or his designee to execute
amendments to the subaward agreement; providing for severability; providing for
conflicts; and providing for an effective date.

Discussion by the Commission ensued related to providing the Commission with
reimbursement requests, if the City expected to have extra money for resident and
business assistance, and how much the Broward Sheriff's Office will receive for
Tamarac.

f. TR13505 — RFP20-09Q Agreement for the Eastside Parks Feasibility Study

A Resolution of the City Commission of the City of Tamarac, Florida, awarding RFP
20-09Q and execute an agreement with Miller Legg for the Eastside Feasibility Study
for an amount not to exceed $193,500, a contingency amount of $6,500 will be
added to the project for a total project budget of $200,000; approving all necessary
budget transfers; providing for conflicts; providing for severability; and providing for
an effective date.

Vice Mayor Bolton motioned to approve. Commissioner Placko seconded.
Parks & Recreation Director Greg Warner provided a presentation, which is on file in the
City Clerk's Office.
Discussion by the Commission ensued related to potential park space in the Woodlands,
use of public funds for a public park, Central Park will be moving forward and the study
will determine what elements are needed in the park, the bid process and Miller Legg
being selected to conduct the study, including the Parks & Recreation Advisory Board
and the Foundation in the study, etc.
