Ord. #2471 4/28/2021 Rev. 1 - 5/5/2021 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2021- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING SECTION 2-5 "DISASTER RELIEF FUNDING AGREEMENTS" OF THE CITY CODE AUTHORIZING THE CITY MANAGER TO EXECUTE DISASTER/EMERGENCY RELIEF FUNDING AGREEMENTS AND DOCUMENTATION NECESSARY TO SECURE FEDERAL AND STATE EMERGENCY FUNDING FOR COSTS INCURRED BY THE CITY OF TAMARAC AS A RESULT OF ANY CATASTROPHIC EMERGENCY; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac can incur considerable costs relative to preparation, damages, flooding and clean-up of any catastrophic emergency and/or pandemic or other emergency events; and WHEREAS, the City of Tamarac would be eligible for certain reimbursement costs from Federal agencies and the State of Florida; and WHEREAS, Ordinance No. 0-2001-09, adopted on May 23, 2001, created City Code Section 2-5, "Disaster Relief Funding Agreements", providing that the City Manager shall have the authority to execute Disaster Relief Funding Agreements and any related documents necessary to secure Federal Emergency Management Agency (FEMAfunding, and/or State funding in the case of a catastrophic emergency; and 40 CODING Words in struck through type are deletions from existing law; Words in underscore type are additions. Ord. #2471 4/28/2021 Rev. 1 - 5/5/2021 Page 2 • WHEREAS, in order to obtain Federal and State funding, certain Federal agencies require that a representative from the City of Tamarac be authorized to execute the necessary Emergency Relief Funding Agreements and documentation; and WHEREAS, Section 5.04(e) of the Tamarac City Charter provides that the City Manager shall execute bonds, contracts, and issue checks on behalf of the City of Tamarac pursuant to appropriate ordinances, resolutions and directions of the City Commission; and WHEREAS, the Director of Finance recommends authorizing the City Manager to execute disaster/emergency relief Funding Agreements; and • WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to authorize the City Manager to execute disaster/emergency relief Funding Agreements and documentation necessary to secure reimbursement from various Federal agencies and the State of Florida for the costs incurred by the City of Tamarac as a result of any catastrophic emergency or disaster event. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Temp. Ord. #2471 4/28/2021 Rev. 1 - 5/5/2021 Page 3 SECTION 2: That Article 1, Section 2.5 of the City of Tamarac Code be amended as follows: * SECTION 2-5. "Disaster Emergency Relief Funding Agreements" The City Manager shall have the authority to execute Disaster Emergency Relief Funding Agreements and any related documents necessary to secure Federal Emergency Management Agency (FEMA Federal agency funding, and/or State funding in case of a catastrophic emergency." * * * SECTION 3: It is the intention of the City Commission of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this ordinance may be renumbered, re-lettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: Conflicts: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: Severability: If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance than can be given without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. • Temp.
