HomeMy WebLinkAbout2021-04-14 - City Commission Regular Meeting Minutes• City Commission Minutes Wednesday, April 14, 2021 7 p.m. CALL TO ORDER: Mayor Gomez called the Wednesday, April 14, 2021, Regular City Commission Meeting, being held virtually, to order at 7 p.m. ROLL CALL: Commissioner Marlon Bolton, Commissioner Mike Gelin, Vice Mayor Villalobos, Commissioner Debra Placko, and Mayor Gomez were in attendance. Also, in attendance were City Manager Michael Cernech, City Attorney Hans Ottinot and City Clerk Jennifer Johnson. PLEDGE OF ALLEGIANCE: Commissioner Placko led the Pledge of Allegiance. A minute of silence was held to recognize the passing of Congressman Alcee Hastings. 1. PROCEDURES FOR VIRTUAL MEETINGS City Attorney, Hans Ottinot, provided information and procedures for conducting virtual public meeting. 2. PROCLAMATIONS AND PRESENTATIONS a. Broward County Supervisor of Elections - High School Voter Registration Drive Requested by Jennifer Johnson, City Clerk, Presented by Ben Williams, Broward Supervisor of Elections -Director of Election Day • Operations b. Proclamation - Autism Awareness Month Requested by Mayor Gomez c. Proclamation - Father's MIA Requested by Commissioner Bolton d. Proclamation - Paralyzed Veterans of America Requested by Mayor Gomez Mayor recessed meeting at 7:16 pm due to technical issues with Facebook and reconvened at 7:30 pm. 3. CITY COMMISSION REPORTS a. Commissioner Bolton Commissioner Bolton did not give a report • b. Commissioner Gelin Commissioner Gelin provided a presentation, which is on file in the City Clerk's Office. Commissioner Gelin asked for clarification regarding the RFP process for selecting a . permanent City Attorney, based on direction from the workshop and the meeting. C. Vice Mayor Villalobos Vice Mayor Villalobos stated he wanted to make it clear to everyone on the dais and to staff that he is here for his constituents. He further stated that he wants to support his colleagues and their projects but outlined that they are not his priority. Vice Mayor asked his colleagues to notify him if they are conducting any meetings in his district. He asked Mayor Gomez to keep track of the Commissioners discussion times and the number of times they each get to speak. Vice Mayor asked City Manager Cernech to compare the demands of the present Commission to that of the members of the Commission in 2016. d. Commissioner Placko Commissioner Placko stated that over the last few weeks she received numerous calls and emails on various code enforcement issues. She asked the residents to be patient, and that she will acknowledge each request and work with staff on each issue. She also thanked Cayden for the letter she received from her- e. Mayor Gomez Mayor Gomez stated that her total travel expense for FY 2019-2020 was $6121.59. She wished Israel Happy Independence Day. 4. CITY ATTORNEY REPORT a. Discussion on Ordinance Amending Chapter 10 LDR An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 10 of the City's Code of Ordinances, entitled "Land Development Code" by designating the City Commission as the final decision maker on land use matters, including special exceptions, major site plans, and variances; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. City Attorney Hans Ottinot and Assistant City Attorney Pamela Ryan provided information related to suggested changes to the Land Development Code. Discussion ensued by the Commission, at the end of discussions there were no recommended changes. Attorney Ottinot stated that he will move forward with adding the item as an Ordinance for first reading at the next Commission meeting. 5. CITY MANAGER REPORT ECONOMIC DEVELOPMENT: The City's Economic Development Office has a few items to share this evening: We are happy to report that our partnership with Broward College's/Broward UP program for the FREE educational opportunities for Tamarac residents to enhance the workforce skills needed for career advancement is having a positive response. 0 We have had 70 Tamarac residents register for the April classes and we are in the process of preparing the schedule for May. Residents can follow the City of Tamarac's social media pages for more information on the free classes offered next month or visit https://www.broward.edu/browardup for more information. We would also like to announce that our support local business restaurant campaign, Savor The Flavors Tamarac planning is in full swing, starting May 1st with the kickoff competition for "The Tastiest Appetizer in Tamarac" People's Choice Award. Tamarac chefs will compete in the "American Cuisines" appetizer category the first 2-weeks in May. Followed by Asian, Caribbean, Italian and Latin Cuisines chef/restaurant competitions running through July. Everyone is invited to visit participating restaurants, taste and vote for your favorite appetizers. Participants will be eligible to win prizes, and of course, your favorite restaurant will win bragging rights and a special "Tamarac Tastiest Appetizer" trophy. COMMUNITY DEVELOPMENT: The Community Development Housing Division is happy to report that the March 31, 2021 First Time Homebuyers Purchase Assistance workshop was a success. Of the 449 individuals who registered, 193 actually attended and participated in the Workshop. The open enrollment for the 2021-2022 Program is now being advertised. Online Applications will become available beginning, Monday, May 3rd and will remain open until funds are exhausted. PARKS & RECREATION: The Parks and Recreation Foundation of Tamarac invites you to attend the 9th Annual P.A.R.O.T. Golf Tournament on Friday, May 14, 2021, at Colony West Golf Club. This year's event includes light lunch, goodie bag, golf shirt, and dinner. Discussion on Commission Salary and benefits with possible motion and action. Commissioner Bolton motioned to have item 13g.,' Discussion on Commission Salary and benefits with possible motion and action' be brought under the City Manager's report. Commissioner Gelin seconded. Clerk Johnson conducted a roll call vote, the motion carried 4-1, Commissioner Bolton, Commissioner Gelin, Commissioner Placko, Vice Mayor Villalobos in favor with Mayor Gomez dissenting. Discussion ensued by the Commission regarding a Sun Sentinel article, Commission financial responsibility, Commissioners job classification, Commission budget and spending, lack of transparency, Commission travels, Commission salary, the role of a Commissioner, City Manager salary and benefits and the Commission car allowance. Vice Mayor Villalobos mentioned to end discussion. The motion failed for a lack of a second. • Commissioner Bolton motioned to reduce the salaries all the Commission salaries and benefits to no more than $10,000 per year. The motion failed for a lack of a second. 6. PUBLIC PARTICIPATION Chriss Martorelli — 9416 NW 72nd St, Tamarac, FL, expressed that she opposed the renaming of Southgate Blvd. Darcy Schiller — 7879 Grandville DR, Tamarac, FL, expressed that there are a lot of residents from Kings Point that is opposition against of renaming Southgate Blvd. She also stated that she would like to know the number of homeowners or the number of residents' units in District 1 and if Commissioner Bolton literally goes door to door. Dr. Schiller expressed her concerns of Commissioner Bolton purchasing food and supplies for residents and possible connections of using this gesture to `buy votes'. She stated she had questions on the ethics of Commissioner Bolton and Gelin. Ronald Wasserman — Jade Dr, Tamarac, FL, thanked the Commission and Chief Percy Sayles for their hard work and asked the Commission to work together. Jodi Marcia — of Tamarac, FL, expressed her opposition of renaming Southgate Blvd. She asked the Commission to revisit the and bring the item back on the agenda for it to be revoked. Bernie Burawski — 5706 NW 84th Ave, Tamarac, FL, stated that meeting seemed very dysfunctional and that there was too much conflict of interest. He urged the Commission to work together. Elizabeth Walter — Sunflower, Tamarac, FL, spoke on a comment made by Commission Gelin at a previous about not holding from the past against and individual. She stated that she agrees with the Commission but that when one holds a public office its left up to perception. She addressed the naming of Southgate Blvd and expressed her opposition to the renaming and asked Commissioner Placko to make a motion to stop the renaming. Mr. Cernech stated there were additions or deletions to the agenda. a. Approval of the February 24, 2021, Virtual City Commission Minutes b. Approval of the March 10, 2021, Virtual City Commission Minutes Commissioner Placko made a motion to approve the consent agenda. Commissioner Gelin seconded. Clerk Johnson conducted a roll call vote, the motion carried unanimously (5-0). 8. REGULAR AGENDA 0 Commissioner Gelin motioned to move item 8f. TR13592 - Designating the Tamarac Sports Complex as the location for Walking, Jogging and Running Track. Seconded by Commissioner Bolton. Clerk Johnson conducted a roll call vote, the motion carried unanimously. a. TR13592 -Designating the Tamarac Sports Complex as the location for Walking, Jogging and Running Track A Resolution of the City Commission of the City of Tamarac, Florida, designating the Tamarac Sports Complex as the location for a walking, jogging, and running track for the residents of the City of Tamarac; providing the City Manager and City Attorney with the authority to do all things necessary to effectuate the commencement of the construction of the walking, jogging, and running track on or about September 1, 2021; providing for an effective date. Greg Warner Director of Park and Recreations gave a presentation, a copy of which is on file in the City Clerk's Office. Mayor Gomez opened public comments: Reginald Holt — 1011 NW 121st Terrace, Coral Springs, FL, talked about his organization and the positive impact they have had with assisting athletes through different sports programs. . Bryan Hagopain — 1055 NW 100th Ave Pembroke Pines, 33024, expressed his support for the construction of a track. Josh Stem — of Planation, FL, expressed his support for the construction of a track. Gregory Barnes — of Miami, FL, expressed his support of having a track constructed. Jonathan Carter — of Pembroke Pines, FL, talked about the importance of having a track in the community and expressed his support of having a track constructed. Kristin Zanleoni — of Davie, FL, expressed her support for the construction of a track. Charles Hafley Jr. — Head coach of Taravella High School track team, expressed his support for the construction of a track. Julie Fishman — 7650 Westwood Blvd, Tamarac FL, expressed her opposition of the construction of a track. Frankie Ruiz — of Miami, FL, expressed his support for a construction of well -designed track. Thomas Johnson — of Royal Beach, FL, expressed his support for the construction of a track. Richard Bobker — Kings Point, Tamarac, FL, expressed his opposition to the construction of a track. He also stated that he opposed the amount of money that will be spent to construct the track. . Mayor Gomez recessed the meeting at 1012 pm and reconvened at 10:25 pm. Mayor Gomez asked Clerk Johnson to conduct roll call to confirm all members of the Commission was still in attendance. All were in attendance. 0 Discussion ensued; Vice Mayor Villalobos motioned to have the item tabled until the Commission has more information. Commissioner Placko seconded. Clerk Johnson conducted a roll call vote, the motion carried 3-2, Commissioner Placko, Voce Mayor Villalobos and Mayor Gomez in favor with Commissioner Bolton and Commissioner Gelin dissenting. Mayor Gomez asked if there is a vote to extend meeting beyond the 11:30 pm hard stop. Vice Mayor Villalobos motioned to end the meeting at 11:30 pm. Commissioner Gelin seconded. Clerk Johnson conducted a roll call vote, the motion failed 4-1, Commissioner Bolton, Commissioner Placko, Vice Mayor Villalobos and Mayor Gomez dissenting with Commissioner Gelin in favor. TR13582 -Approval of the Agreement with Techgroupeone Inc. for the Sunset Point Park Artistic Structure. A Resolution of the City Commission of the City of Tamarac, Florida, awarding RFP No. 20-11RP to Techgroupone Inc., and approving the execution of an agreement between the City of Tamarac and Techgroupone, Inc. attached hereto as Exhibit "A" and incorporated herein, to provide design/build services for Sunset Hammock artistic work project at Sunset Park located at 11000 W McNab Road, Tamarac, in the amount of $773,342.09; authorizing the inclusion of a city controlled contingency in the project budget in the amount of $77,334.21, providing for conflicts; providing for severability; and providing an effective date. Maxine Calloway, Director of Community Development, provided a presentation, which is on file in the City Clerk's Office. Discussed by the Commission ensued E Clerk Johnson conducted a roll call vote, and the motion to approve failed 3-2, Commissioner Bolton, Commissioner Gelin and Vice Mayor Villalobos dissenting with Mayor Gomez and Commissioner Placko voting in favor. Ms. Calloway outlined that city would return the $400,000 allotted grant funds. b. TR13587 - Recommendation to Award RFP 21-03R to Group B Properties FL LLC for 7200 N. University Drive and Authorization to Negotiate a Contract for Sale and Purchase and a Development Agreement. A Resolution of the City Commission of the City of Tamarac, Florida, Awarding RFP 21- 03R to Group B Properties FL LLC, for the Development of Real Property in the City, Authorizing the Negotiation of a Contract for Sale and Purchase and a Development Agreement with Group B Properties FL LLC,; To Facilitate the Sale and Commercial Development of 1.41 Acres of Real Property Located at 7200 N University Drive in the City of Tamarac, Florida; Providing for Conflicts; Providing for Severability; and Providing for an Effective Date. City Attorney, Hans Ottinot, read the title for the record. Mayor Gomez disclosed that Rachel Friedman reached out to her via Linkedln, with comments regarding projects in Tamarac. Commissioner Bolton asked Clerk Johnson that the comment be distributed to the Commission. Mayor Gomez stated she will download the comments and get it to Clerk Johnson. Commissioner Bolton motioned to approve. Commissioner Placko seconded. Lori Funderwhite, Economic Development Manager and Ken Krasnow, Vice Chairman of Institutional Investor Services, Colliers, provided a presentation, which is on file in the City Clerk's Office. Mayor Gomez opened public comments. Nectaria Chakas - 1401 E Broward Blvd # 303, Fort Lauderdale, FL 33301, stated that she is an attorney representing JM properties that submitted the proposed 7-Eleven. She outlined that the proposal submitted by JM Properties is in line with the city's goals for the area. She stated that JM Properties is willing to increase their offer from $1.3 million to $1.7 million dollars with the deposit increasing to $100,000. Eric Liborio — of West Palm Beach, FL, Principal member of 7-Eleven talked about the design, the new concept and new brand being proposed by 7-Eleven. Discussion by the Commission ensued Developer Michel Bittan voluntarily proffered $100,000 over the next 5 years, with 50% of funds to be used to fight homelessness through a charity that is on the list of City of is Tamarac's list of charities. Commission Bolton amended the motion to approve, to include the proffer from developer. 0 Clerk Johnson conducted a roll call vote, the amended motion carried unanimously (5-0). c. TR13588 - Appointing 1 (one) Alternate At -Large Member to the Planning Board A Resolution of the City Commission of the City of Tamarac, Florida, appointing one (1) Alternate At -Large member for a term that will expire November 8, 2022, or until such time new appointments are made to the Planning Board; providing for conflicts; providing for severability; and providing for an effective date. Commissioner Bolton seconded. Commissioner Bolton modified the motion to extend meeting to 2 am. Commissioner Placko seconded. Clerk Johnson conducted a roll call vote, the motion to extend the meeting to 2 am carried unanimously (4-0). Mayor Gomez recessed meeting at 12:59 am and reconvened meeting at 1:05 am. Mayor Gomez asked Clerk Johnson to conduct roll call to confirm all members of the Commission was still in attendance. All were in attendance with the exception of Commissioner Gelin. Selection of the 2021/22 Broward League of Cities Board of Directors Requested by City Clerk, Jennifer Johnson. Clerk Johnson stated that the Broward League of Cities conduct a selection every year • for the positions of Director, 1st and 211 Alternates. She outlined that there is a deadline to make the selection and the swearing in of members takes place in May. Discussion ensued by the Commission. Vice Mayor Villalobos motioned to appoint Commissioner Bolton as Director, Commissioner Placko as 1st Alternate, and Vice Mayor Villalobos as 2nd Alternate. Commissioner Bolton seconded. Clerk Johnson conducted a roll call vote, and the motion to approve carried unanimously (4-0). b. Discussion and possible direction regarding the Sister Cities program and Committee role. City Commission discussion and possible direction regarding the city selection and the Sister Cities Committee member role. Caporella Park — Discussion on project elements Greg Warner Director of Park and Recreations gave a presentation, a copy of which is on file in the City Clerk's Office. Discussion by the Commission regarding a date of completion, noise restrictions, additional parking, the amphitheater design, concession stand, food trucks and a farmer's market. Director Warner stated that no vote is required at this time, however a budget will come later to include any additional cost for the suggestions offered by the Commission. d. Public Art Committee Update Maxine Calloway asked the Commission to table item to the next Commission meeting on April 28, 2021. Commissioner Bolton motioned to table item until the next Commission meeting on April 28, 2021. Vice Mayor Villalobos seconded. Mayor Gomez stated she would like to have on the next meeting the procedure on selecting the permanent attorney. Discussion ensued by the Commission on how to make Commission meetings shorter. By whom? Where is the needs assessment or the petition from the residents of Tamarac asking for the track? Where is the backup material showing the Sports Complex can accommodate this track? The City Attorney goes further to state that the Sports Complex is already home to many of the sports and is widely used by the residents. If the track is placed in the Sports Complex, what elements would be lost to, not only the track but the stadium seating needed for a world class track but also the additional parking needed for all those attendees. The City of Tamarac has spent millions of dollars researching the elements already in use and placing them in the Sports Complex, including the new artificial turf fields, the new press box, new additions to the playground area, and the yet to be completed new concession stand. In addition to no backup material on the assertion that the Sports Complex is the ideal place for the track, there is no backup material on the so-called estimated price of 3.5 million for the track. Does this include the stadium seating and additional parking? What about additional bathrooms? Does this include the price of demolishing existing elements the City has already paid for • to put the track in? Does it include the additional infrastructure necessary for a project of the magnitude? The accompanying Resolution calls for the construction of the track to commence on or before September 1, 2021. Is that even possible given the fact the infrastructure needs must be met, the environmental impacts must be factored in, traff is studies would need to be done, the City's bidding process would have to be followed along with the approval of the design and finally the destruction of the existing elements that would need to be removed. Tamarac already has numerous paths utilized by the residents for walking and running including the current path at the Sports Complex. I use it and have witnessed my neighbors using it.
