Virtual Special City Commission Meeting - Minutes
Tuesday Dec. 29, 2020
Call to Order: Mayor Michelle J. Gomez called the Tuesday, Dec. 29, 2020, City Commission
Meeting, being held virtually, to order at 9:00 a.m.
Roll Call: Commissioner Marlon Bolton, Commissioner Debra Placko, and Mayor Michelle J.
Gomez were present virtually. Commissioner Mike Gelin arrived virtually at 9:02 a.m. and Vice
Mayor Elvin Villalobos arrived at 9:03 a.m.
Pledge of Allegiance: Mayor Gomez led the Pledge of Allegiance.
1. Opening Statement
Mayor Gomez stated the Special City Commission is to interview potential firms to provide
Interim City Attorney Services.
City Attorney Sam Goren explained the process for the closed meeting, and that the interviews
would remain on the record, be recorded and available for release in accordance with the
Florida Statutes. He further clarified the purpose of the closed meeting is to conduct interviews,
and there would be no other conversations while in the closed meeting.
2. Oral Presentations of Interim City Attorney Candidates/Firms
Mayor Gomez stated the City Clerk Jennifer Johnson, a member of the IT Department, City
Manager Michael C. Cernech, City Attorney Sam Goren, and Purchasing and Contracts
Manager Keith Glatz would attend the closed session for technical assistance as necessary.
Mayor Gomez recessed the public meeting at 9:05 a.m.
Mayor Gomez convened the closed meeting at 9:08 a.m. and proceeded with interviews of the
following firms. All members of the Commission were present throughout the interviews, as
each firm was interviewed.
Lewis, Longman & Walker, P.A.
Representing Lewis, Longman & Walker, P.A. are Al Malefatto and Janice Ruskin.
Ottinot Law, P.A.
Representing Ottinot Law are Hans Ottinot and Jasmine Barnes
ii. Torcivia, Donlon & Goodeau, P.A.
Representing Torcivia, Donlon & Goodeau, P.A. are Glen Torcivia, Christy Goodeau,
Pamala Ryan, Matthew Ransdell and James Bracko.
At the conclusion of the interviews, Mayor Gomez ended the closed meeting, and recessed at
12:23 p.m.
Mayor Gomez reconvened the public meeting at 12:40 p.m. All members of the Commission
were present for the evaluation and remainder of the public meeting.
3. Evaluation of the Interim City Attorney Firms
Discussion by the Commission ensued related to the pros and cons of the three firms being
considered to provide Interim City Attorney Services.
Mayor Gomez asked the members of the Commission to rank order their selections for Interim
City Attorney firms.
Commissioner Bolton: Torcivia, Ottinot (tied for first) and LLW (3)
Commissioner Gelin: Ottinot (1), LLW (2) and Torcivia (3)
Commissioner Placko: Torcivia (1), Ottinot (2) and LLW (3)
Vice Mayor Vilialobos: Ottinot (1), Torcivia (2) and LLW (3)
Mayor Gomez: Torcivia, Ottinot (tied for first) and LLW (3)
4. Possible motion to select a firm for Interim City Attorney Services
Vice Mayor Villalobos motioned to hire Ottinot Law for Interim City Attorney Services.
Commissioner Bolton seconded.
Clerk Johnson conducted a roll call vote, and the motion to hire Ottinot Law for Interim City
Attorney Services carried unanimously (5-0).
5. Review of attorney's report issued by John Herin, Esq. and possible motion
regarding the self -storage project at Rock Island Road and Commercial Boulevard
John Herin, Esq., provided information related to his research of the settlement agreement
between Prestige Homes of Tamarac, Inc., and the City of Tamarac, and possible next courses
of action for the City.
Discussion by the Commission related to the report provided Mr. Herin, the issue, and potential
options moving forward.
Mayor Gomez recessed the meeting for technical issues at 3:02 p.m. and reconvened at 3:03
p.m.
Discussion by the Commission continued, with Michael Burke of Johnson, Anselmo, Murdoch,
Burke, Piper & Hochman, P.A., adding information related to possible consequences if the City
does not move forward with signing the closing documents.
Following discussion, no action was taken by the City Commission.
City Attorney Goren stated, absent a motion, the City would move forward fulfilling the
transaction as defined in the terms of the he settlement agreement.

e I haven't changed my mind since I
addressed the Commission when this was
first introduced. Its too big and too tall. As I
explained there are over 20 apartments in
the community behind them that would
never see sunshine again. A small or pocket
park would show to visitors the beauty of

I recommend NO. There is a larger facility
just a few blocks west of this on
Commercial and it has empty units and is
one of the least expensive in the area. I
know this because I rent a unit there.

Due to the power lines on the west side of
the property, the limit to the possible size 0
the facility limits the potential pro ita i ity o
this location. Tamarac doesn't need another
failed business in the community.
A small dog park would be nice, the only
dog park in Tamarac is on the far west side.
Due to the number of robberies/the ts t at
have been the reported at the various drug
stores in the area (CVS & Walgreens,
gun shots and other issues, what about a
BSO substation? Perhaps with a... See Mot

breathtaking area of Tamarac, bar none.
Can we just leave it alone for a while and let
people enjoy it instead of having people
move to better areas in the Tri county area
just to duplicate the "exact dream"they
purchased after working hard for 1/2 their
lives..

regular times). That intersection is so
congested regularly. Adding more there
would make it worse. Thank you for asking

Need to attend a commission meeting?
The City Commission holds a workshop meeting on the Monday prior to each regular
commission meeting at 9:30 am in City Hall, Conference Room 105, where agenda items are
discussed at length. Residents are welcome but shall not participate.
Regular commission meetings are held on the second and fourth Wednesday of the month at
9:00 am and 7:00 pm, respectively, in the City Hall Commission Chambers. Residents are
welcome and can participate.
Special topic workshops are scheduled as needed.
