R-2021- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING AND AUTHORIZING THE PURCHASE OF TWO (2) JOHN DEERE 410L BACKHOES FOR STREETS AND WATER DIVISIONS, UTILIZING COMPETITIVE PROCUREMENT METHODS AND CURRENT AGREEMENTS AVAILABLE FOR COOPERATIVE PURCHASES AT THE TIME OF PURCHASE INCLUDING AGREEMENTS AWARDED BY THE FLORIDA SHERIFF'S ASSOCIATION CONTRACT NUMBER FSA20- EQU18.0, IN A TOTAL AMOUNT NOT TO EXCEED $304,768.25 AUTHORIZING AN EXPENDITURE IN THE AMOUNT NOT TO EXCEED $304,768.25 FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac Public Services Water Division maintains and manages the Citywide Water Distribution System and the Streets Division maintains and repairs public streets and roads throughout the City, in addition to debris removal activities following tropical storms and hurricanes; and WHEREAS, the existing backhoes in use by the Water and Streets Divisions are approximately twenty-one (21) years old, and the timely replacement of the equipment is necessary in order to ensure the effective and efficient delivery of services and prevent the potential failure of a critical piece of equipment; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and Temp. Reso. #13704 November 10, 2021 Page 2 of 5 WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing heavy equipment; and WHEREAS, Public Services Staff reviewed current agreements available for cooperative purchases at the time of purchase including agreements awarded by the Florida Sheriffs Association and Sourcewell, and determined both are competitively solicited cooperative contracts and include the required replacement equipment; and WHEREAS, Public Services Staff received and reviewed proposals for the replacement equipment from Dobbs Equipment utilizing the Florida Sheriffs Association Contract Number FSA20-EQU18.0 Specification #169, and Sourcewell Contract #032119-JDC, an evaluation of the price comparisons is attached hereto as "Exhibit 1"; and WHEREAS, Public Services Staff determined the most advantageous pricing include utilizing the Florida Sheriffs Association Contract Number FSA20-EQU18.0 Specification #169 for both the Streets replacement backhoe (2022 John Deere 410L 4x4 Backhoe with Grapple Bucket) at a price not to exceed $152,943.25 and the Water Distribution replacement backhoe (2022 John Deere 410L 4x4 Enclosed Cab with 48" Ditching Bucket) at a price not to exceed $151,825.00, for a combined price not to exceed $304,768.25, the proposals for the Streets Division replacement equipment and the Water Division replacement equipment are attached hereto as "Exhibit 2" and "Exhibit 3", respectively; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing Temp. Reso. #13704 November 10, 2021 Page 3 of 5 and Contracts Manager have determined that it is in the City's economic interests to purchase the replacement equipment from Dobbs Equipment, utilizing Florida Sheriffs Association Contract Number FSA20-EQU18.0 Specification #169 for the Streets replacement backhoe (2022 John Deere 410L 4x4 Backhoe with Grapple Bucket) at a price not to exceed $152,943.25 and the Water Distribution replacement backhoe (2022 John Deere 410L 4x4 Enclosed Cab with 48" Ditching Bucket) at a price not to exceed $151,825.00, for a combined price not to exceed $304,768.25; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve and authorize the purchase of the replacement equipment from Dobbs Equipment, utilizing Florida Sheriffs Association Contract Number FSA20-EQU18.0 Specification #169 the Streets replacement backhoe (2022 John Deere 410L 4x4 Backhoe with Grapple Bucket) at a price not to exceed $152,943.25 and the Water Distribution replacement backhoe (2022 John Deer 410L 4x4 Enclosed Cab with 48" Ditching Bucket) at a price not to exceed $151,825.00, for a combined price not to exceed $304,768.25. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits referenced and attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac does HEREBY approve Temp. Reso. #13704 November 10, 2021 Page 4 of 5 and authorize the purchase of the replacement equipment from Dobbs Equipment, utilizing Florida Sheriffs Association Contract Number FSA20-EQU18.0 Specification #169 the Streets replacement backhoe (2022 John Deere 410L 4x4 Backhoe with Grapple Bucket) at a price not to exceed $152,943.25 and the Water Distribution replacement backhoe (2022 John Deer 410L 4x4 Enclosed Cab with 48" Ditching Bucket) at a price not to exceed $151,825.00, for a combined price not to exceed $304,768.25; and, a copy of pricing proposals are attached hereto as "Exhibit 1". SECTION 3: Funds totaling $154,500.00 in the General Fund and $154,800 in Utilities Fund were allocated in the Fiscal Year 2022 Adopted Budget for the purchase of the replacement Streets and Water Division Backhoes. SECTION 4: An expenditure in an amount not to exceed $304,768.25 is HEREBY approved from the appropriate accounts. SECTION 5: All resolutions or parts of resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
