R-2022- J A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING AND AUTHORIZING THE PURCHASE OF ONE (1) 8" TRASH PUMP FOR STORMWATER MANAGEMENT, UTILIZING THE AGREEMENT AWARDED BY THE FLORIDA SHERIFF'S ASSOCIATION CONTRACT FSA20-EQU18.0 SPECIFICATION #276, IN AN AMOUNT NOT TO EXCEED $85,394.12; AUTHORIZING AN EXPENDITURE IN THE AMOUNT NOT TO EXCEED $85,394.12 FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac maintains and manages the Citywide Stormwater collection, detention system, and conveyance system, and desires to provide its residents a safe and operational Stormwater Management System throughout the City; and WHEREAS, the portable Trash Pumps are integral components of the overall Stormwater System to manage excess stormwater during and after extremely heavy rainfall, to prevent and mitigate flooding, and minimize flood related damage and disturbances; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids Temp. Reso. #13721 January 12, 2022 Page 2 of 5 available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing heavy equipment; and WHEREAS, Public Services Staff reviewed current agreements available for cooperative purchases at the time of purchase including agreements awarded by the Florida Sheriff's Association, and Sourcewell, and determined both are competitively solicited cooperative contracts and include the required equipment; and WHEREAS, Public Services Staff received and reviewed proposals for the pump from Thompson Pump utilizing the Florida Sheriff's Association Contract #FSA20- EQU18.0 Specification #276 and Thompson Pump Sourcewell Contract #012418-TPM, the proposal is attached hereto as "Exhibit 1 "; and WHEREAS, Public Services Staff determined the most advantageous pricing include utilizing the Florida Sheriff's Association Contract FSA20-EQU18.0 Specification #276 for the Stormwater Pump (Model No. 8JSCE-DJDST-45HC04-M) at a price not to exceed $85,394.12; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase the equipment from Thompson Pump, utilizing the Thompson Pump Florida Sheriff's Association Contract FSA20-EQU18.0 Specification #276 for the Stormwater Pump (Model No. 8JSCE-DJDST-45HC04-M) for a price not to exceed $85,394.12; and Temp. Reso. #13721 January 12, 2022 Page 3 of 5 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve and authorize the purchase of the equipment from Thompson Pump, utilizing the Thompson Pump Florida Sheriff's Association Contract FSA20-EQU18.0 Specification #276 for the Stormwater Pump (Model No. 8JSCE-DJDST-45HC04-M) for a price not to exceed $85,394.12. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits referenced and attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac does HEREBY approve and authorize the purchase of the equipment from Thompson Pump, utilizing the Thompson Pump Florida Sheriff's Association Contract #FSA20-EQU18.0 Specification #276 for the Stormwater Pump (Model No. 8JSCE-DJDST-45HC04-M) for a price not to exceed $85,394.12-1 and, a copy of pricing proposal is attached hereto as "Exhibit 1 ". SECTION 3: Funds totaling $132,000.00 in the Stormwater Management Fund and were allocated in the Adopted Fiscal Year 2022 Budget for the purchase of Stormwater Trash Pump. Temp. Reso. #13721 January 12, 2022 Page 4 of 5 SECTION 4: An expenditure in an amount not to exceed $85,394.12 is HEREBY approved from the appropriate accounts. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
