HomeMy WebLinkAbout2021-11-30 - City Commission Special Meeting MinutesCity Commission Minutes Special Meeting "Shade Session" Tuesday, Nov. 30, 2021 CALL TO ORDER: Mayor Gomez called the Special City Commission meeting, being held in Conference Room 105, at City Hall, to order at 6:08 p.m. ROLL CALL: Present were, Mayor Michelle J. Gomez, Commission Mike Gelin, Commissioner Debra Placko and Commissioner Marlon Bolton. Vice Mayor Elvin Villalobos was absent. Also present were, Interim City Manager Kathleen Gunn, City Attorney John Herin, and Special Counsel for the City, Max Lohman and City Clerk Jennifer Johnson. Special Counsel Lohman stated that the applicant has planned to resubmit the site plan on December 15, 2021. Additionally, Lohman stated he has had discussions with Ray Eubanks regarding the extension, with Florida DEO, and let him know the city is unable to prcvide a date certain at this time. 1. Purpose: Mayor Gomez stated the City Commission would be conducting an executive session on Tuesday, Nov. 30, 2021 at 6:00 p.m. in accordance with Section 286.011(8), Florida Statute to discuss settlement negotiations and/or strategy related to litigation expenditures in the following case. 13th Floor Woodlands HB GP, LLC vs. the City of Tamarac, Florida: CACE-21-019013 The following persons will attend the attorney -client session. • Mayor, Michelle Gomez • Commission Marlon Bolton • Commissioner, Mike Gelin • Commissioner, Debra Placko • Interim City Manager, Kathleen Gunn • Special Counsel for the City, Max Lohman • An official court reporter as provided by law from Veritext Gomez stated the length of the Attorney -Client Session will be approximately 1-hour, and the only item authorized for discussion will be settlement negotiations and/or strategy related to litigation expenditures for the above listed case. A court reporter will transcribe the shade meeting and at the conclusion of the litigation, the transcript will be open to public inspection. 2. Executive Session: Mayor Gomez stated we would now close the public meeting. All those whose name I did not call must leave the Conference Room, and the attorney -client session will commence at 6:11 p.m. City Clerk Johnson departed the meeting, and the executive session commenced. At the conclusion of the executive session, City Clerk Johnson returned at 7:26 p.m. Special Counsel Lohman asked for a motion to directing the special counsel pursue the course of action as discussed during the shade session. Commissioner Gelin motioned to direct special counsel pursue the course of action discussed during the shade session. Commissioner Bolton seconded. Clerk Johnson conducted a roll call vote, and the motion carried 3-1. Commissioner Bolton, Commissioner Gelin and Commissioner Placko were in favor. Mayor Gomez was not in favor. 3.
