R-2022 - 0/ 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING BROWARD COUNTY THE CONVEYANCE OF THREE PARCELS OF REAL PROPERTY TO THE CITY OF TAMARAC' PURSUANT TO SECTION 125.38, FLORIDA STATUTES AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Broward County, a political subdivision of the State of Florida, ("County"), is the owner of certain real property located in the City of Tamarac, Florida ("Property"), which Property is more particularly described in the legal descriptions and sketches made subject to the Quit Claim Deeds, which are attached hereto as Attachments A, B, and C ("Quit Claim Deeds") to "Exhibit 1 "; WHEREAS, the City of Tamarac, a Florida municipal corporation, ("City"), is willing to accept the conveyance the Property from the County, pursuant to Section 125.38, Florida Statues, and in accordance with the terms of the Quit Claim Deeds; and WHEREAS, the Acting Director of Public Services recommends the City Commission of the City of Tamarac approve the conveyance of the properties described in the legal descriptions which are attached hereto as Attachments A, B, and C ("Quit Claim Deeds") to "Exhibit 1", as all properties are located within City -owned and maintained rights -of -way and the identified properties should be owned and maintained by the City; and WHEREAS, the City Commission of the City of Tamarac, has determined that Temp. Reso. # 13743 February 23, 2022 Page 2 conveyance of the Property serves a public purpose and is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution and all exhibits referenced herein and attached hereto are incorporated and made a specific part of this Resolution. SECTION 2: The City Commission hereby finds that: (1) the City applied to the Board for the conveyance of the Property for the Stated Purpose in accordance with Section 125.38, Florida Statutes; (2) the Stated Purpose promotes public or community interest and welfare; and (3) the Property is required by the City for the Stated Purpose, and is not needed for County purposes. The appropriate City Officials are hereby authorized to execute the necessary documents and do all things necessary to effectuate the terms of this Resolution. SECTION 3: The City authorizes the conveyance of the Property from the County for the Stated Purpose in exchange for the total price of Ten Dollars ($10.00). SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or Temp. Reso. # 13743 February 23, 2022 Page 3 applications of this Resolution. SECTION & This Resolution shall become effective immediately upon its passage and adoption. Severability. 18 If any portion of this Resolution is determined by any court to be invalid, the invalid 19 portion will be stricken, and such striking will not affect the validity of the remainder of this 20 Resolution.
