R-2022— 0 S,;L- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE OF TWO (2) TOWABLE GENERATORS FROM GENERAC MOBILE PRODUCTS UTILIZING THE UNITED STATES GENERAL SERVICES ADMINISTRATION CONTRACT#GS- 07F0407X IN AN AMOUNT NOT TO EXCEED $96,408.64; AUTHORIZING AN EXPENDITURE NOT TO EXCEED $96,408.64 FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Public Services operates and maintains eighty-eight (88) wastewater pump stations throughout the City; and • WHEREAS, these stations operate using electrical services provided by Florida Power & Light; and, while electrical service is relatively reliable, failures occurwhich require the use of an alternate source, such as a mobile generator; and WHEREAS, the City of Tamarac is vulnerable to power outages, in particular during the hurricane season, which requires the ready availability of emergency power to ensure the wastewater collection system is functioning; and WHEREAS, due to new residential development within the City of Tamarac and increased wastewater flows, two (2) new mobile generators are required for the emergency operation of wastewater pump stations; and WHEREAS, funds were appropriated in the Adopted Fiscal Year 2022 Budget for two (2) trailer -mounted generators; and 0 WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of Temp. Reso. #13748 March 23, 2022 Page 2 of 4 contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing equipment; and WHEREAS, funds in the amount of $133,000.00 exist in the FY 2022 Adopted Budget and are available in the Utilities Fund; and WHEREAS, the Acting Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase two (2) Portable Towable Generators, utilizing a current agreement available for cooperative purchase through the United States General Services • Administration Contract GS07F0407X Price List, and detailed quotation are attached hereto as "Exhibit 1"; hereto attached, and the Terms and Conditions for GSA GS07F0407X are • incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that the appropriate City Officials be authorized to select, approve and award the cost-effective choice for replacement equipment as identified in "Exhibit 1" be purchased utilizing a competitive procurement method and current agreement available for cooperative purchase, including but not limited to, the Agreement awarded by the United States General Services Administration Contract GS07F0407X for the replacement of portable towable generators at a cost not to exceed $96,408.64. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE 0 CITY OF TAMARAC, FLORIDA.- • is Temp. Reso. #13748 March 23, 2022 Page 3 of 4 SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission of the City of Tamarac HEREBY authorizes the purchase of two (2) Portable Towable Generators utilizing competitive procurement methods and current agreements available or cooperative purchase, at the time of purchase, including, the Agreement awarded by the United States General Services Administration Contract authorizing an expenditure in an amount not to exceed $96,408.64 from the appropriate account for said equipment. The appropriate City Officials are further authorized to execute all appropriate agreements and do all things necessary to effectuate this Resolution. SECTION 3: Funds totaling $133,000.00 were appropriated in the Adopted Fiscal Year 2022 Budget for the purchase of Towable Generators as identified in "Exhibit 1 ", attached hereto. SECTION 4: An expenditure in the amount not to exceed $96,408.64 is HEREBY authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
