R-2022— 0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING REPLACEMENT OF THE WASTEWATER VIDEO VAN, UTILIZING CUES, INC. AS A SOLE SOURCE DIRECT PROVIDER FOR THE REPLACEMENT OF THE WASTEWATER VIDEO VAN; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $357,057.00 FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, funds were appropriated in the Adopted Fiscal Year 2022 Budget for the replacement of Vehicle No. 4095, a Sewer TV inspection unit ("Video Van"); and WHEREAS, the timely replacement of City equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, the compatibility of the electronic equipment, parts, and services with the existing hardware and equipment currently in operation requires the use of specialized equipment only available through CUES Inc., the Sole Source Direct Provider for all CUES CCTV Equipment, Services, Parts, and Support for the entire State of Florida, a copy of the Sole Source Letter is attached hereto as "Exhibit 1 "; and WHEREAS, the replacement of the Wastewater Video Van was included in the FY 2022 Adopted Budget, and funds for the Vehicle Purchase Programs, in the amount of $396,120.00 exist in the FY 2022 Adopted Budget in the Utilities Fund; and WHEREAS, the Acting Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase replacement Video Van, utilizing CUES, Inc. as a sole source direct provider, in an amount not to exceed $357,057.00, a copy of the quote is attached hereto Temp. Reso. #13737 April 13, 2022 Page 2 of 4 as "Exhibit 2` and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that the appropriate City Officials be authorized to purchase the Replacement Video Van, utilizing CUES, Inc. as a Sole Source Provider, at a cost not to exceed $357,057.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac authorizes the purchase of replacement equipment, utilizing CUES, Inc. as a Sole Source Provider; authorizing an expenditure in an amount not to exceed $357,057.00 from the appropriate account, per the quote attached hereto as "Exhibit 2". The appropriate City Officials are further authorized to execute all appropriate agreements and do all things necessary to effectuate this Resolution. SECTION 3: Funds totaling $396,120.00 were appropriated in the Adopted Fiscal Year 2022 Budget for the replacement equipment. SECTION 4: An expenditure in the amount of $357,057.00 for said purpose is hereby authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp.
