R-2022- OJ q A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE GRANTING OF A PERPETUAL EASEMENT TO FLORIDA POWER AND LIGHT FOR THE INSTALLATION OF UNDERGROUND ELECTRIC UTILITY FACILITIES AT TRACT 27 BOOSTER STATION PROJECT LOCATED AT 9901 NW 77th STREET; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE SAID PERPETUAL EASEMENT TO FLORIDA POWER AND LIGHT; AUTHORIZING AND DIRECTING THE CITY CLERK TO RECORD SAID AGREEMENT IN THE PUBLIC RECORDS OF BROWARD COUNTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, the Tract 27 Booster Station located at 9901 NW 77th Street will require the installation of underground electric utility facilities ; and 132685378.1 Temp. Reso. #13760 March 15, 2022 Page 2 of 3 WHEREAS, a perpetual easement is required by Florida Power Light for the installation, maintenance, and operation of necessary underground electric utility facilities; and WHEREAS, the City, as owner of the Tract 27 Booster Station has offered a perpetual easement (a copy of which is attached and hereto as "Exhibit 1 ") to Florida Power and Light ; and WHEREAS, the Acting Director of Public Services recommends that this perpetual easement be granted to Florida Power and Light; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the business owners, residents, and visitors of the City of Tamarac to approve a perpetual easement for the installation of underground electric utility facilities, and to authorize the appropriate City Officials to execute said perpetual easement for the installation of underground electric utility facilities to Florida Power and Light at the Tract 27 Booster Station located at 9901 NW 77th Street. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT. - SECTION 1: The foregoing whereas clauses are ratified and confirmed as being true and correct, are the legislative and administrative findings of the City Commission and made a specific part of this Resolution; all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: The City Commission of the City of Tamarac hereby authorizes the granting of a perpetual easement to Florida Power and Light for the 132685378.1 Temp. Reso. #13760 March 15, 2022 Page 3 of 3 installation of underground electric utility facilities at the Tract 27 Booster Station located at 9901 NW 77th Street; and the appropriate City Officials are hereby authorized to execute said easement. SECTION 3: The City Clerk is hereby authorized and directed to record the perpetual easement in the Public Records of Broward County. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
