Gomez called the Wednesday, April 13, 2022, regular City Commission meeting, being held in Commission Chamber to order at 7:00 p.m. ROLL CALL: Commissioner Marlon D. Bolton, Commissioner Debra Placko, Commissioner Elvin Villalobos, Vice Mayor Mike Gelin and Mayor Michelle J. Gomez were present. Also present were City Manager Kathleen Gunn, City Attorney John Herin and City Clerk Jennifer Johnson. PLEDGE OF ALLEGIANCE: Saul Restrepo, a member of the Tamarac Teen Council, led the Pledge of Allegiance. 1. CITY ATTORNEY REPORT None. 2. CITY MANAGER REPORT 2.a Investment Report - February 2022 2.b 2022 Legislative Update: State Representative, District 97, Dan Daley State Representative, Dan Daley, highlighted the bills which were adopted, or not adopted, during the 2022 Legislative Session. Daley also mentioned an upcoming Special Legislative Session to discussion Congressional redistricting, and possibly property insurance reform. 2.c Proclamation - Autism Awareness Month Requested by Michael Annese, Tamarac Fire Chief Mayor Gomez read the proclamation for the record, and presented it to Firefighter Christopher Rodriguez-Jaile, Lieutenant Stephen McLaughlin and their families. City Manager Gunn added that the Finance Department received the Distinguished Budget Presentation Award from the Government Finance Officers Association for the 24th consecutive year. The Economic Development Office is inviting everyone to Rise Business Expo Thursday, May 5, 2022, from 1 p.m. to 6:30 p.m. at the Tamarac Community Center. Lastly, Household Hazardous Waste and Recycling event will be Saturday, May 7, 2022, from 9 a.m. to 2 p.m., at the Public Services Complex on Nob Hill Road. 3. PUBLIC PARTICIPATION City Attorney John Herin reviewed the rules and procedures applicable to public participation. Mayor Gomez opened for comments from the public. 1. Bob Valdez of, 8281 NW 66th Terrace, Tamarac, provided a police report and expressed his concern regarding the constant noise and disturbing behavior from the neighbor's home. Mr. Valdez requested additional enforcement by Code Enforcement and BSO [Broward Sheriff's Office], and that this behavior is not limited to just party houses. 2. RoseAnn Valdes, of 8281 NW 66th Terrace, Tamarac, expressed her concern for the neighbors consistent noise and loud music throughout all hours of the day. Valdes also mentioned that her neighbors were intimidated by the person in question and his behavior is of concern. 3. Sharon Reynolds, of 8270 NW 66th Terrace, Tamarac, expressed her concern for her self and her neighbors based on the behaviors of the neighbor. Reynolds reiterated the person in question is intimidating and the behavior has traumatized the whole neighborhood. 4. Ron Wasserman, of 8577 Jade Drive, Tamarac, asked that every be aware of cancer and the ravages it has on families. Wasserman explained, that on two occasions, his home has been broken into. He asked when the City is going to do something about the level of crime. 5. Armando Gomez, of Gainesville, Florida, stated he has been watching City Commission meetings, and asked that each of the members be kind to one another. He asked that they give the best of themselves, make a difference and dig deep to do the right thing. Gomez also apologized to a member of the Commission whom he did not recognize at a previous meeting. 6. Steve Sax, a Navy Veteran of Sunrise, Florida, stated he was escorted by Mayor Michelle J. Gomez, for his Honor Flight over the weekend. He thanked her for the wonderful trip, and to keep supporting the mission of Honor Flight. 7. Mel Yoder, of Kings Point, Tamarac, stated the travel soccer team item had no backup material and the backup material for the budget item was dated 2014. He asked that the information be more up to date. Yoder mentioned elections are coming up, and he feels Commissioners are placing items on the agenda for sound bites and politics. 8. Patty Lynn, of 6411 NW 58th Street, Tamarac, asked if Tamarac was doing anything for the countywide recycling program. Lynn stated she lives in Mainlands 8, and would like to members of the Commission to keep the overnight parking restrictions in place, because her neighborhood has significant parking challenges. Lynn also stated Tamarac has the best staff anywhere. 9. Taneka Rene, of 5702 Malaleuca Drive, Tamarac, stated she accidentally signed up to speak. 4. CONSENT AGENDA 4.a March 21, 2022 - Commission Workshop Minutes 4.b March 23, 2022 — Commission Meeting Minutes 4.c TR13737 - A Resolution of the City Commission of the City of Tamarac, Florida, approving replacement of the Wastewater Video Van, utilizing CUES, Inc. as a Sole Source Direct Provider for the replacement of the wastewater video van; authorizing an expenditure in an amount not to exceed $357,057.00 from the appropriate accounts; providing for severability; and providing for an effective date. 4.d TR13754 - A Resolution of the City Commission of the City of Tamarac, Florida, approving a Declaration of Restrictive Covenant ("DRC") for Colony West Golf Course Hotel and Championship Course, located at 6850 NW 88th Avenue, Tamarac, Florida; authorizing the appropriate City staff to execute said DRC; authorizing the City Clerk to record the DRC with Broward County; providing for conflicts; providing for severability; and providing for an effective date. 4.e TR13760 - A Resolution of the City Commission of the City of Tamarac, Florida, approving the granting of a Perpetual Easement to Florida Power and Light for the installation of underground electric utility facilities at Tract 27 Booster Station Project located at 9901 NW 77th Street; authorizing the appropriate City Officials to execute said Perpetual Easement to Florida Power and Light for the installation of underground electric utility facilities at the Tract 27 Booster Station, 9901 NW 77th Street; authorizing and directing the City Clerk to record said Agreement in the Public Records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. 4.f TR13764 -A Resolution of the City Commission of the City of Tamarac, Florida, authorizing a four -week consecutive period (July 15, 2022 - August 12, 2022) during which time the City Commission will not schedule any regular meetings pursuant to Section 4.06(1) of the City Charter; providing for conflicts; providing for severability; and providing for an effective date. 4.g TR13767 — A Resolution of the City Commission of the City of Tamarac, Florida, authorizing the appropriate city officials to execute amendment #1 of the lease agreement with Yamaha Motor Finance Corporation, USA to extend the lease by 12 months for 100 golf carts and one (1) beverage cart; providing for conflicts; providing for severability; and providing for an effective date. City Manager, Kathleen Gunn, requested Item 10.a. be moved to the workshop, scheduled for April 25, 2022. Moved by Commissioner Elvin Villalobos; seconded by Commissioner Debra Placko to Approve. REGULAR AGENDA None. 6. ORDINANCE(S) - FIRST READING 6.a TO2492 - An Ordinance of the City Commission of the City of Tamarac, Florida, amending Ordinance 2021-031, which adopted the City of Tamarac Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2022, by increasing the total Revenues and Expenditures by a total of $2,324,602 as detailed in Attachment A attached hereto and summarized in Attachment B; providing for conflicts; providing for severability; and providing for an effective date. City Attorney, John Herin, read the title for the record. Director of Financial Services, Christine Cajuste, and Budget Manager, Jeff Streder, provided a presentation, which is on file in the City Clerk's Office. Discussion by the Commission ensued regarding the City Planner position change. Moved by Commissioner Marlon D. Bolton; seconded by Commissioner Elvin Villalobos to Approve. Motion Passed: 5 - 0 Voting For: Mayor Michelle J. Gomez, Vice Mayor Mike Gelin, Commissioner Marlon D. Bolton, Commissioner Elvin Villalobos, and Commissioner Debra Placko Voting Against: None 6.b TO2495 - An ordinance of the City Commission of the City of Tamarac, Florida amending Chapter 10, Article 4, entitled "Development and Design Standards" by amending Section 10-4.10 entitled "Signs" of the City of Tamarac Code of Ordinances, by specifically amending Section 10-4.10 (C) entitled "Comprehensive Sign Plan (CSP)"; Section 10-4.10 (D) entitled "General Sign Requirements"; Section 10-4.10 (E) entitled "Design criteria"; section 10-4.10(F) entitled "construction and location"; section 10-4.4 (H) entitled "temporary Signs" and Section 10-4.10(M) entitled "Nonconforming Signs" to provide for updated signage regulations in support of economic development opportunities, citywide; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. City Attorney, John Herin, read the title for the record. Director of Community Development, Maxine Calloway, provided details regarding the changes made after suggestions by the Commission during the March 21, 2022, workshop. Discussion by the Commission ensued related to window tinting and outreach efforts regarding the impending changes. Moved by Commissioner Debra Placko; seconded by Commissioner Elvin Villalobos to Approve. Motion Passed: 5 - 0 Voting For: Mayor Michelle J. Gomez, Vice Mayor Mike Gelin, Commissioner Marlon D. PUBLIC HEARING(S) 7.a TR13761 - A Resolution of the City Commission of the City of Tamarac, Florida approving the Local Housing Assistance Plan (LHAP), attached hereto as Exhibit "1", as required by the State Housing Initiatives Partnership Program Act, subsections 420.907-420.9079, Florida Statutes; and rule Chapter 67-37, Florida Administrative Code; authorizing and directing the Mayor to execute any necessary documents and certifications needed by the State; authorizing the submission of the Local Housing Assistance Plan for review and approval by the Florida Housing Finance Corporation (FHFC); authorizing the appropriate City Officials to accept the State of Florida's State Housing Initiatives Partnership (SHIP) program budget by accepting the fiscal year 2022, 2023, and 2024 allocations of the program funds to be utilized according to the city's Local Housing Assistance Plan and housing delivery goals chart; that the appropriate City Officials are hereby authorized to appropriate said funds including any and all subsequent budgetary transfers to be in accordance with proper accounting standards; providing for conflict; providing for severability; and providing an effective date. City Attorney, John Herin, read the title for the record. Community Development Director, Maxine Calloway, provided a presentation, which is on file in the City Clerk's Office. Mayor Gomez opened for comments from the public. 1) Taneka Rene, of 8205 Melaleuca Drive, Tamarac, asked for clarification on finding a home first, and then applying. 2) Armando Gomez, of Gainesville, Florida, stated the real wait for approval at the moment is the appraisal. Gomez also asked is there were any stop -gap measures considering most people are priced out of the market. There being no other comments from the public, Mayor Gomez, closed public comments. Discussion by the Commission ensued related to the type of assets an applicant can have up to $25,000 and the expected turn -around time for the process. Calloway stated that the maximum an applicant can have in cash, is $25,000, and we are looking at 3-4 weeks for a turn -around time. Moved by Commissioner Elvin Villalobos; seconded by Commissioner Debra Placko to Approve. Motion Approved: 5 - 0 Voting For: Mayor Michelle J. Gomez, Vice Mayor Mike Gelin, Commissioner Marlon D. Bolton, Commissioner Elvin Villalobos, and Commissioner Debra Placko Voting Against: None Mayor Gomez recessed the meeting at 8:36 p.m. and reconvened at 8:51 p.m. 8. ORDINANCE(S) - SECOND READING 8.a TO2496 - An Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter II, entitled "Administration", amending Article II, entitled "City Commission", by specifically amending Section 2-34 entitled "Comprehensive Procedures for City Commission Meetings" to provide in subsection (k) "Voting Procedures" a new voting rotation; providing for conflicts; providing for severability; and providing for an effective date. City Attorney, John Herin, read the title for the record. Mayor Gomez opened for comments from the public, there being none, closed public comments. Moved by Commissioner Marlon D Bolton; seconded by Vice Mayor Mike Gelin to Approve. Motion Adopted: 4 - 1 Voting For: Mayor Michelle J. Gomez, Commissioner Marlon D. Bolton, Commissioner Elvin Villalobos, and Commissioner Debra Placko. Voting Against: Vice Mayor Mike Gelin 9. QUASI-JUDICIAL HEARING(S) None. 10. OTHER 10.a Discussion and consideration of potential Charter amendments This item was deferred to the workshop, Monday, April 25, 2022. 10.b Discussion to adopt a participatory budgeting process in the City of Tamarac Requested by Vice Mayor Mike Gelin Vice Mayor Gelin requested to table the item. 10.c Direction to direct staff to establish a travel soccer team Requested by Vice Mayor Mike Gelin Vice Mayor Gelin requested to table the item. 10.d Discussion regarding civility among the members of the Commission during agenda items Requested by Commissioner Elvin Villalobos Commissioner Villalobos asked that a portion of the meeting from Wednesday, March 23, 2022, be played in reference to the item. Discussion by the Commission ensued related to civility among one another, moving beyond past behavior and not copying one another on emails to avoid a Sunshine Law issue. Mayor Gomez asked for consensus to abide by the City's ordinances, County ethics rules, and the State constitution and be proper, ethical, and responsible. Commissioner Bolton, Commissioner Placko, Commissioner Villalobos and Mayor Gomez agree to the matter. Vice Mayor Gelin did not agree with the matter.
