R-2022-" ° )".-3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING THE CITY OF TAMARAC AMERICANS WITH DISABILITIES ACT TRANSIT ACCESS & SIDEWALK GAP ANALYSIS PLAN; AUTHORIZING AND DIRECTING THE CITY MANAGER, OR DESIGNEE, TO TAKE ALL ACTION NECESSARY TO IMPLEMENT THE PLAN AND EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, the City Planning Technical Assistance Program (PTAP) grant project was approved for federal funding by the Broward Metropolitan Planning Organization (BMPO) Board at its October 8, 2020, meeting; and WHEREAS, as part of the PTAP, the City worked collaboratively with staff in the BMPO office to conduct an accessibility study on existing sidewalk routes, bike lanes, and their connection to the existing public transit network; and 134292929.1 Temp. No. 13&72 ?375,L February 15, 2022 Page 2 of 4 WHEREAS, the focus of the study was to identify areas that presented barriers to public transportation access resulting from non -compliant ADA transit infrastructure and gaps in the city's sidewalk network; and WHEREAS, the City led multiple outreach efforts to solicit the public's input announcing the commencement of the study at its April 28, 2021, City Commission meeting, launching a robust public engagement campaign including; online, print, and in - person distribution of transportation related surveys, e-mail blasts to local Homeowner Associations along study transit routes, and solicited input from partner agencies on transit operations; and WHEREAS, the City's existing ADA Transition Plan does not specifically address programmatic improvements and available funding sources for enhancing accessibility to public transportation modes; and WHEREAS, the purpose of the study was to inform the development of a plan to address accessibility to public transit stops and gaps within the existing sidewalk network impacting persons who may require the use of ADA facilities; and WHEREAS, the study area included 31 stops, comprised of 21 Community Shuttle Bus stops and 10 Broward County Transit stops, in addition to biking and walking conditions within '/4 mile radius of each stop location; and WHEREAS, field data corresponding to current conditions was collected and analyzed to assess the state of the current transportation network; and WHEREAS, the resulting analysis identified access deficiencies that were used to ultimately inform the development of an accessibility plan; and 134292929.1 Temp. No. 44642 February 15, 2022 Page 4 of 4 SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof; all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: The ADA Transit Plan attached as Exhibit "A" is approved and aadopted by the City, and the City Manager or designee is authorized to take all action necessary to effectuate the intent of this Resolution. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. No. 1 t3'7,2- February 15, 2022 Page 3 of 4 WHEREAS, the City of Tamarac wishes take steps to implement a plan to ensure that the City is developing a multi -modal transportation network that is inclusive of infrastructure and facilities for all persons visiting or residing in Tamarac; WHEREAS, the City of Tamarac Transit Access & Sidewalk Gap Analysis Plan a copy of which is attached hereto as Exhibit "A" ("ADA Transit Plan")), recommends infrastructure improvements that will allow the City to comply with the prescribed ADA standards for public transportation facilities and qualify for continued federal, state, and local infrastructure funding; and WHEREAS, the City's professional staff has reviewed the ADA Transit Plan and it supports the City's Strategic Plan Goal #1 "Tamarac is Home" to improve accessibility to convenient public transportation options for all its visitors and residents; and WHEREAS, this item also supports the City's Strategic Plan Goal #4 "Tamarac is Vibrant" by ensuring the City's multi -modal transportation network is designed in a manner that is inclusive of all members of its community and in compliance with the standards set forth in the American with Disabilities Act; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the business owners, residents, and visitors of the City to adopt the ADA Transit Plan to facilitate the development of a multi -modal transportation network that is accessible to all persons utilizing public rights of way and transportation modes in Tamarac. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORID& 134292929.1 Temp. Reso.
