R- 2022- 060 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE PURCHASE OF TWO (2) REPLACEMENT PARATRANSIT VANS THROUGH FLORIDA TRANSPORTATION SYSTEMS, INC. (FTS) UTILIZING FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TRANSIT RESEARCH INSPECTION PROCUREMENT SERVICES (TRIPS) CONTRACT NUMBER TRIPS-19-MV-FTS; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $132,006.00.00 FROM THE APPROPRIATE ACCOUNTS FOR THE VEHICLES AND EQUIPMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, funds were appropriated in the Adopted Fiscal Year 2020 Budget for replacement of two (2) paratransit vans, and due, in part to the COVID-19 Pandemic, the purchase of the replacement vehicles was deferred; and WHEREAS, the timely replacement of City vehicles and equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the 134281667.1 Temp. No. 13787 May 25, 2022 Page 2 of1/9 authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing vehicles and heavy equipment; and WHEREAS, the Director of Parks and Recreation, Acting Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase replacement transit vans as identified in Exhibit 1", attached hereto, from Florida Transportation Systems, Inc. (FTS) utilizing Florida Department of Transportation (FDOT) Transit Research Inspection Procurement Services (TRIPS) Contract Number TRIPS-19-MV-FTS, incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, the replacement cost of each paratransit van is $66,003.00 per vehicle, for a cumulative cost not to exceed $132,006.00, per the FTS Proposal utilizing TRIPS Contract Number TRIPS-19-MV-FTS, a copy of the cost proposal is attached hereto as "Exhibit 2"; and WHEREAS, funds for the Vehicle Replacement Programs, in the amount of $211,019.00 exist in the FY 2020 Adopted Budget in the Asset Maintenance Program for the purchase of the replacement vehicles, a detailed budget summary is hereto attached as "Exhibit 1 "; and WHEREAS, it is in the best interest of the City to authorize the appropriate City officials to select, approve, and award the most cost-effective procurement method utilizing competitive procurement methods and current agreements available for 134281667.1 Temp. Reso. No. 13787 May 25, 2022 Page 4 of/D is hereby authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. No. 13787 May 25, 2022 r Page 3 ofz' cooperative purchase at the time of purchase including, Transit Research Inspection Procurement Services (TRIPS) Contract Number TRIPS-19-MV-FTS; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to approve the purchase of replacement vehicles and equipment as identified in "Exhibit 1" through Florida Transportation Systems, Inc. (FTS) utilizing Florida Department of Transportation (FDOT) Transit Research Inspection Procurement Services (TRIPS) Contract Number TRIPS-19-MV-FTS ("Replacement Vehicle Purchase Agreement") NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof; all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: The Replacement Vehicle Purchase Agreement attached as Exhibit 1 for the purchase of two (2) replacement transit vans in an amount not to exceed $132,600.00 is approved, and the appropriate City officials are authorized to execute the Agreement on behalf of the City. SECTION 3: Funds totaling $211,019.00 were appropriated in the Adopted Fiscal Year 2020 Budget for the purchase of replacement vehicles and equipment as identified in "Exhibit 1".
