Ord. #2503 May 17, 2022 Page 1 of 6 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2022- a 11 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE TAMARAC CODE OF ORDINANCES BY REPEALING SEC. 2-425 (3), "FIXED EXPENSE ACCOUNT', OF ARTICLE XIII, CHAPTER 2 "ADMINISTRATION", ENTITLED "TRAVEL EXPENSES", TO REPEAL PROVISIONS RELATED TO AN OPTIONAL FIXED EXPENSE ACCOUNT FOR ELECTED OFFICIALS UPON REQUEST; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and CODING: Words in strUGk throug# type are deletions from existing law, Words in underscored type are additions. 134272423.1 Temp. Ord. #2503 May 17, 2022 Page 2 of 6 WHEREAS, Section 4.04 of the Charter of the City of Tamarac provides for the reimbursement of expenses incurred by elected officials in the scope of their official duties; and WHEREAS, the City has adopted over the years numerous policies to facilitate the reimbursement of expenses for elected officials; and WHEREAS, the City Commission of the City of Tamarac wishes to amend the Code of Ordinances of the City of Tamarac, Florida ("Code"), Article XIII, Chapter 2 "Administration", entitled "Travel Expenses" by repealing Sec. 2-425 (3) "Fixed Expense Account" related to a fixed expense account for elected officials upon request by repealing Ordinance No. 0-2021-007 in its entirety; and WHEREAS, the Director of Financial Services recommends amending Article XIII, Chapter 2 "Administration", entitled "Travel Expenses" by repealing Sec. 2-425 (3) "Fixed Expense Account", to eliminate a fixed expense travel account for elected officials upon request; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to amend Article XIII, Chapter 2 "Administration", entitled "Travel Expenses" by repealing Sec. 2-425 (3) "Fixed Expense Account" of the Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: CODING: Words in struoL }ham type are deletions from existing law; Words in underscored type are additions. 134272423.1 Temp. Ord. #2503 May 17, 2022 Page 3of6 SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof, all exhibits attached hereto are incorporated herein and made a specific part thereof. SECTION 2: Article XIII, "Travel", Sec. 2-425 (3), "Fixed Expense Account" of the Code is repealed in its entirety as follows: Article XIII. - Travel Sec. 2-425. — Travel Expenses. Ord. #2503 May 17, 2022 Page 4 of 6 SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Ord. #2503 May 17, 2022 Page 5 of 6 SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption.
