R-2022 - 093 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, RATIFYING PAST PURCHASES FROM VCLOUD TECH, INC.; AWARDING IQ-2022-0169 TO VCLOUD TECH, INC., AND APPROVING THE PURCHASE OF A PRINTERLOGIC SOFTWARE SUBSCRIPTION RENEWAL FROM VCLOUD TECH, INC. AT A TOTAL COST OF $10,330.00; AUTHORIZING EXPENDITURES FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, technology is one of the key components in the efficient delivery of City services, and the City's network infrastructure is critical to ensuring continued operations; and WHEREAS, the City utilizes PrinterLogic software for managing, monitoring and deploying printer configurations through the organization, and the current maintenance and support agreement expires on September 3, 2022, thereby requiring renewal; and 13696301 1.1 Temp. Reso. #13826 August 1, 2022 Page 2 of 4 WHEREAS, on July 11, 2022, the City issued Informal Quote Request IQ-2022- 0169, requesting quotes from authorized PrinterLogic partners and/or resellers, for a one (1) year PrinterLogic Software Subscription renewal; and WHEREAS, five (5) responses/quotes were received, and the quote from vCloud Tech, Inc. was deemed the lowest responsible and responsive quote for the required PrinterLogic Software Subscription renewal; and WHEREAS, funding is available in the Information Technology operating account for this purchase; and WHEREAS, the aggregate annual expenditure for goods and services from vCloud Tech, Inc. thus far has been $55,772.29, but with the purchase of the PrinterLogic Software Subscription renewal, at a cost of $10,330.00, will total $66,102.29, thereby requiring City Commission approval for expenditures in excess of the State of Florida threshold for Category Three purchases as defined in §287.017(3), Fla. Stat. and §6-145 of the Tamarac Code of Ordinances ("City Code"), which is $65,000; and WHEREAS, it is the recommendation of the Interim Director of Information Technology and the Purchasing and Contracts Manager that the City Commission ratify past expenditures with vCloud Tech, Inc., award IQ-2022-0169 to vCloud Tech, Inc., and approve the purchase of a one (1) year PrinterLogic Software Subscription renewal, at a total cost of $10,330.00, from vCloud Tech, Inc.; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to ratify past expenditures with vCloud Tech, Inc., award IQ-2022-0169 to vCloud Tech, Inc., 136963011.1 Temp. Reso. #13826 August 1, 2022 Page 3 of 4 and approve the purchase of a one (1) year PrinterLogic Software Subscription renewal, at a total cost of $10,330.00, from vCloud Tech, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT. - Section 1: The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2: The City Commission ratifies past expenditures with vCloud Tech, Inc.; awards IQ-2022-0169 to vCloud Tech, Inc.; approves the purchase of a one (1) year PrinterLogic Software Subscription renewal, at a total cost of $10,330.00, from vCloud Tech, Inc.; and, authorizes the appropriate City Officials to execute a Purchase Order for the purchase of the PrinterLogic Software Subscription Renewal. Section 3: Funding is available for the purchase of the Cisco Systems SMARTnet Maintenance and Support Renewal from the appropriate accounts for a total cost not to exceed $10,330.00. Section 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
