R-2022 - Dq Lt A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A PURCHASE OF REPLACEMENT LANDSCAPING AND GOLF COURSE MAINTENANCE EQUIPMENTFOR THE COLONY WEST GOLF CLUB FROM JOHN DEERE & COMPANY UTILIZING STATE OF FLORIDA AGREEMENT #25101900-21-STC FOR AGRICULTURE AND LAWN EQUIPMENT THROUGH ITS AUTHORIZED DEALER, EVERGLADES EQUIPMENT GROUP, AND ACCEPTING AN ALTERNATE PROPOSAL FOR REFURBISHED EQUIPMENT FROM IT'S AUTHORIZED DEALER, EVERGLADES EQUIPMENT GROUP, FOR A TOTAL EXPENDITURE NOT TO EXCEED $143,000.00, FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law ; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City) empowers the City to adopt, amend or repeal such ordinances and resolutions as may be required for the proper governing of the City ; and 136977194,1 Temp. Reso. #13833 August 24, 2022 Page 2 of 6 WHEREAS, the City of Tamarac owns and is responsible for the management and maintenance of the Colony West Golf Course ; and WHEREAS, the existing golf course maintenance equipment is approaching ten (10) years old, has reached the end of its estimated useful life and timely replacement is necessary to ensure the effective and efficient maintenance services to offer a safe, high -quality facility and golfing experience; and WHEREAS, Public Services Fleet staff have evaluated the existing equipment and found it to be in poor condition and in need of replacement; and WHEREAS, §6-148 City of the Tamarac Code of Ordinances ("City Code"), allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provides the lowest prices as well as the most efficient method for purchasing heavy equipment; and WHEREAS, Indigo Golf and City staff sought quotations for replacement equipment from various sources providing pricing from State of Florida Agreements and agreements available from national purchasing consortiums available to governmental agencies and to the golf industry as permitted by §6- 148(f) of the City Code; and 136977194.1 Temp. Reso. #13833 August 24, 2022 Page 3 of 6 WHEREAS, the market for the golf course equipment industry is limited to two (2) major manufacturers, John Deere & Company, and Toro Company, as confirmed by the Purchasing and Contracts Manager; and WHEREAS, proposals were received from sources for both John Deere & Company and Toro Company from agreements including the State of Florida and national consortium agreements available to governmental agencies and to the golf industry; and WHEREAS, the following proposals were received from authorized local dealers for Toro Company (Hector Turf) and for John Deere & Company (Everglades Equipment Group); and John Deere & Company (Everglades Equipment Group) $253,372.46 "Exhibit 1", State of Florida Agreement #25101900-21-STC for Agriculture and Lawn Equipment, Toro Company (Hector Turf) $299,329.68 "Exhibit 2". Pricing from Troon National Account for golf course industry and OMNIA Partners, City of Mesa, AZ Agreement for Governmental Agencies; and WHEREAS, staff determined that the cost for new equipment was excessive and that supply chain delays have created extensive delivery times; and WHEREAS, the vendor providing the lowest aggregate proposal has proposed an alternative proposal for refurbished equipment from a local private golf course with a one (1) year comprehensive warranty, with the option of purchasing an additional year of warranty coverage; and 136977194.1 Temp. Reso. #13833 August 24, 2022 Page 4 of 6 WHEREAS, staff invited the other proposer to provide a similar alternative proposal but the firm was unable to provide a quote for refurbished equipment; and WHEREAS, due to the excessive cost of new equipment and the operational hardship that would be created due to extensive delays in delivery times for new equipment City staff recommends that the City Commission consider the alternate proposal; and WHEREAS, Indigo staff with input from City staff have negotiated a proposal cost of $120,000.00 plus a cost of $23,000 for an additional year of warranty coverage for a total of two (2) years of warranty coverage for a total not to exceed cost of $143,000.00 included herein as "Exhibit 3"; and WHEREAS, the Director of Parks and Recreation, Director of Public Services, Director of Financial Services, and the Purchasing and Contracts Manager have determined that it is in the City's economic and operational interests to purchase the replacement equipment utilizing the alternative proposal provided by the lowest priced proposer, Everglades Equipment Group, for refurbished equipment for a price not to exceed $143,000.00 as set forth in Exhibit "Y, and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the business owners, residents, and visitors of the City of Tamarac to approve and authorize the purchase of the replacement equipment utilizing the alternative proposal submitted by Everglades Equipment Group for refurbished equipment, including three (3) 2019 John Deere 2500B Tri-Plex Mowers, two (2) 2019 John Deere 7700A Fairway Units and a 2019 John Deere 136977194.1 Temp. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1: The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2: The purchase of golf course maintenance replacement equipment utilizing the alternative proposal by Everglades Equipment Group, for refurbished equipment in an amount not to exceed $143,000.00, as set forth in attached "Exhibit 3" is approved. Section 3: Funds totaling $143,000.00 in the Colony West Fund were allocated in the Fiscal Year 2022 Adopted Budget for the purchase of the replacement equipment. Section 4. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5: If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 136977194.1 Temp.
