Gomez called the Monday, August 22, 2022, City to Commission Workshop to order at 10:00 a.m. ROLL CALL Present were Mayor Michelle J. Gomez, Vice Mayor Mike Gelin (at 10:06 a.m.), Commissioner Marlon B. Bolton, Commissioner Debra Placko, and Commissioner Elvin Villalobos. Also present were: City Manager Kathleen Gunn, Interim Assistant City Manager Levent Sucuoglu, City Attorney John Herin, and City Clerk Kimberly Dillon. PLEDGE OF ALLEGIANCE Commissioner Marlon Bolton led the Pledge of Allegiance. 1. Ap-enda La.T02500 — Noise Ordinance Presentation by John Herin Jr., City Attorney City Attorney John Herin outlined changes to the Noise Ordinance between first and second reading which staff had made at the direction of Commission. He explained the process staff had undergone to create an Ordinance which would provide for more effective mechanisms for enforcement and allow the City to recoup staff costs. Mayor Gomez discussed definitions and stated while large special events were covered by the Ordinance, she had concern there was not enough in it to protect resident quality of life. She noted additional clarification was needed related to first and second offenses. City Attorney Herin responded. Commissioner Placko asked how noise across the golf course would be addressed. City Attorney Herin discussed Code Enforcement procedures. Lb. T02512 — Special Events Ordinance Presentation by John Herin Jr., City Attorney City Attorney John Herin outlined changes staff had made to the Special Events Ordinance, including augmenting definitions and language which tracked with the Noise Ordinance related to enforcement and providing for recouping staff costs. He noted there were also clarifications of authority of the Fire Marshall and appropriate penalties for violations. He stated under the Ordinance, events which would be serving alcohol would be required to go before the City Commission. Commissioner Villalobos asked how use of fireworks outside of the specified dates were being addressed. City Attorney Herin stated it could qualify as a violation of the Noise Ordinance and added that he would conduct additional research as to State preemptions on the matter. Mayor Gomez asked that additional clarification be added regarding the number of permits to be issued to a particular applicant. She suggested edits to language regarding noise penalties, division locations, and signage. 1.e.Referendum Questions Update Presentation by John Herin Jr., City Attorney City Attorney John Herin explained at the time proposed Charter Amendments were discussed at the Commission, there were questions regarding the Commissioners' role as educators versus advocates. He stated staff had put together a more detailed memorandum to clarify and make sure the City was compliant with State law. He noted language which was prohibited by Statute. Discussion continued to clarify the limitations.
