RESOLUTION NO. R- 2022- ) 1
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING AN AGREEMENT
BETWEEN THE CITY OF TAMARAC AND ALLIED
UNIVERSAL CORPORATION, TO PROVIDE SODIUM
HYPOCHLORITE SOLUTION FOR WATER TREATMENT
PURPOSES UTILIZING CONTRACT PRICING PER THE
AGREEMENT BETWEEN CHARLOTTE COUNTY AND
ALLIED UNIVERSAL CORPORATION PURSUANT TO BID
NO. 2022000564; AUTHORIZING EXPENDITURES FROM
THE APPROPRIATE ACCOUNTS IN AN AMOUNT NOT TO
EXCEED $246,000.00, OR AS MAY BE AMENDED BY THE
CITY COMMISSION FOR SAID PURPOSE; AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO EXECUTE,
EXTEND, AND RENEW THE AGREEMENT AND TO
EXPEND BUDGETED FUNDS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SCRIVENER ERRORS,
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Florida Statutes provide that municipalities shall have the
governmental, corporate, and proprietary powers to enable them to conduct municipal
government, perform municipal functions, and render municipal service, and exercise any
power for municipal purposes, except when expressly prohibited by law; and
WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac
empowers the City to adopt, amend, or repeal such ordinances and resolutions as may
be required for the proper governing of the City; and
WHEREAS, The City is responsible for providing properly treated water to the
business owner, residents, and visitors of the City; and
WHEREAS, as provided by City Code Section 6-148 (d), which states that the

Purchasing Officer may utilize contracts with other governmental agencies, the City
desires to enter into an agreement with Allied Universal Corporation ("Allied") provide
sodium hypochlorite solution for water treatment purposes utilizing the Agreement
between Charlotte County - Bid No. 2022000564. A copy of the Agreement between
Allied and Charlotte County is on file with the City Clerk and incorporated into this
Resolution by this reference; and
WHEREAS, it is the recommendation of the Acting Director of Public Services, the
Acting Director of Financial Services and the Purchasing and Contracts Manager that the
City Commission approve the Agreement between the City and Allied, a copy of which is
attached to this Resolution as Exhibit 1"; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be
in the best interest of the business owners, residents, and visitors of the City of Tamarac
to approve the Agreement between the City and Allied.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
Section 1. The foregoing whereas clauses are ratified and confirmed as being
true and correct, are the legislative and administrative findings of the City Commission
and made a specific part of this Resolution; all exhibits referenced and attached hereto
are incorporated herein and made a specific part of this Resolution.
Section 2. The Agreement between the City and Allied, attached to this
Resolution as Exhibit 1 ", is approved and the appropriate City Officials are authorized to
execute, extend, or renew the Agreement and expend budgeted funds in an amount not

to exceed $246,000.00, or as may be amended by City Commission.
Section 3. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 4. Any scrivener or typographical errors that do not affect intent may be
corrected with notice to and authorization of the City Attorney and City Manager without
further process.
Section 5. If any clause, section, other part, or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

Section 6. This Resolution shall become effective immediately upon its passage
and adoption.
