R-2023- 004� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING TASK AUTHORIZATION NO. 23-03D AND AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE TASK AUTHORIZATION NO. 23-03D WITH STANTEC CONSULTING SERVICES, INC., TO PROVIDE A THIRD - PARTY PEER REVIEW OF THE DESIGN PLANS AND SPECIFICATIONS FOR THE WATER TREATMENT PLANT CONTROL BUILDING & SITE IMPROVEMENTS PROJECT IN ACCORDANCE WITH THE CITY'S CONSULTING ENGINEERING AGREEMENT AS AUTHORIZED BY RESOLUTION NO. R-2022-138, AT A BASE CONTRACT COST NOT TO EXCEED $13,223.00, A CONTINGENCY IN THE AMOUNT OF 10% OR $1,322.00 WILL BE ADDED TO THE PROJECT ACCOUNT FOR A TOTAL PROJECT BUDGET OF $14,545.00; RATIFYING PAST PURCHASES FROM STANTEC CONSULTING SERVICES, INC. IN THE AMOUNT OF $64,580.00, FOR A TOTAL AGGREGATE SPEND OF $79,125.00; AUTHORIZING EXPENDITURES FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER ERRORS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and Temp. Reso. #13886 January 25, 2023 Page 2 of 8 WHEREAS, the Mayor and City Commission deem it to be in the best interest of the citizens, residents, and staff of the City of Tamarac to maintain and upgrade City water treatment and distribution; and WHEREAS, the Water Treatment Administration building was constructed in 1969 with a second -floor addition added in 1986; and the building does not meet current hurricane standards; and WHEREAS, an Engineering Investigation and Assessment performed in 2012 identified conditions that require an extensive renovation or replacement of the building in order to meet current standards; and WHEREAS, the City Commission approved a contract with CPZ Architects Inc., in June 2020, via Resolution No. R-2020-049, for the design of the Water Treatment Plant Control Building & Site Improvements Project; and WHEREAS, CPZ Architects, together with their design team have completed the design plans and specifications for this project; and WHEREAS, the Water Treatment Plant Control Building & Site Improvements Project is now ready to go out for bid through the City's competitive bidding process, and considering this is a very large scale and highly technical project with a proposed budget of $25,000,000.00, City Staff recommend, out of an abundance of caution, that third -party peer review of the design plans and specifications be performed to ensure that they are thorough and comprehensive and to try to minimize potential issues that could generate change orders to the City; and Temp. Reso. #13886 January 25, 2023 Page 3 of 8 WHEREAS, upon Consideration, Public Services Staff have selected Stantec Consulting Services Inc. ("Stantec") to perform this third -party peer review, as Stantec possesses the required expertise, experience, knowledge, and resources to perform this third -party peer review; and WHEREAS, Stantec, has been pre -qualified as an approved consultant for architectural services by the City of Tamarac as authorized by Resolution No. R-2022- 138, incorporated herein by reference and on file at the Office of the City Clerk; and WHEREAS, per Task Authorization Number 23-03D, at a base contract cost not to exceed $13,223.00, a contingency in the amount of 10% or $1,322.00 will be added to the project account for a total project budget of $14,545.00, a copy of Task Authorization is attached hereto as "Exhibit 1 "; and WHEREAS, Funding exists in the Utilities Renewal and Replacement Capital Fund for said project; and WHEREAS, per City Ordinance and Procurement Policy, the City Manager previously approved Purchase Order No. 260353 and Purchase Order No. 260292, which are incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, the cumulative total of the two (2) above mentioned Purchase Orders is $64,580.00, and therefore did not have nor did they require City Commission approval; and WHEREAS, the additional proposed Task Authorization No. 23-03D for third -party peer review of the design plans and specifications for the Water Treatment Plant Control Building & Site Improvements Project will result in a cumulative total of $79,125.00 in Temp. Reso. #13886 January 25, 2023 Page 4 of 8 Fiscal Year 2023, thereby requiring City Commission approval for expenditures in excess of the State of Florida threshold for Category Three purchases as defined in §287.017(3), Fla. Stat. and §6-145 of the Tamarac Code of Ordinances ("City Code"), which is $65,000; and WHEREAS, it is the recommendation of the Acting Director of Public Services, the Director of Financial Services and the Purchasing and Contracts Manager that the City Commission ratify past expenditures with Stantec at a cost of $64,580.00, that Task Authorization No. 23-03D from Stantec Consulting Services, Inc., be approved and executed by the appropriate City Officials, a copy of Task Authorization No. 23-03D is attached hereto as "Exhibit 1 ", and to further authorize a cumulative total expenditure of $79,125.00; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to ratify past expenditures with Stantec at a cost of $64,580.00; to accept and execute Task Authorization No. 23-03D (a copy of which is attached hereto as "Exhibit 1 ") with Stantec Consulting Services, Inc., to provide a third -party peer review of the design plans and specifications for the Water Treatment Plant Control Building & Site Improvements Project in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2022-138, at a base contract cost not to exceed $13,223.00, a contingency in the amount of 10% or $1,322.00 will be added to the project account for a total project budget of $14,545.00, and to approve and authorize a cumulative expenditure of $79,125.00. Reso. #13886 January 25, 2023 Page 5 of 8 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission ratifies past expenditures with Stantec at a cost of $64,580.00, approves Task Authorization No. 23-03D and authorizes the appropriate City Officials to execute Task Authorization No. 23-03D with Stantec Consulting Services, Inc., to provide a third -party peer review of the design plans and specifications for the Water Treatment Plant Control Building & Site Improvements Project in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2022-138, at a base contract cost not to exceed $13,223.00, a contingency in the amount of 10% or $1,322.00 will be added to the project account for a total project budget of $14,545.00, a copy of Task Authorization No. 23-03D is attached hereto as "Exhibit 1" , for a total aggregate spend of $79,125.00-1 and SECTION 3. A cumulative expenditure in an amount not to exceed $79,125.00 for said purposes is hereby approved. Temp. Reso. #13886 January 25, 2023 Page 6 of 8 SECTION 3: The City Manager, or his designee, is hereby authorized to make changes, issue change orders in accordance with Section 6-147 of the City Code, and close the contract award including, but not limited to, making final payment within the terms and conditions of the contract and within the contract price. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: Funding for the third -party peer review of the design plans and specifications for the Water Treatment Plant Control Building & Site Improvements Project in accordance with the City's Consulting Engineering Agreement as authorized by Resolution No. R-2022-138, at a base contract cost not to exceed $13,223.00, a contingency in the amount of 10% or $1,322.00 will be added to the project account for a total project budget of $14,545.00, is available in the Utilities Renewal and Replacement Capital Fund. SECTION 6. Any scrivener or typographical errors that do not affect intent of this Resolution may be corrected with notice to and authorization of the City Attorney and City Manager without further process. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, Temp. Reso. #13886 January 25, 2023 Page 7 of 8 in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Stantec 800 Fairway Drive Suite 195, Deerfield Beach FL 33441-1828 November 29, 2022 City of Tamarac 6011 Nob Hill Road Tamarac, FL 33321 Attention: Mr. Ron Stein Sr. Project Manager - Public Services Department Reference: Third -Party Review for Site and Architectural Design of the Tamarac Water Treatment Plant Tamarac Work Authorization No. 23-03D Dear Mr. Stein: The firm of Stantec Consulting Services, Inc. is pleased to submit this price proposal for the above referenced project for your review and consideration. We look forward to the opportunity of working with The City of Tamarac (City). It is our understanding that the City would like to Stantec to complete a third -party review of the Contract Drawings of the site design and architectural building design of the Tamarac Water Treatment Plant. Consultant Scope Stantec proposes to provide one (1) third -party review for the 100% design of the site improvements of the Tamarac Water Treatment Plant and architectural design of the Water Treatment Plant Control Building at the Plant. The detailed review will focus on the project's design approach, constructability, value engineering opportunities, maintenance requirements, life safety, and building code compliance. Other discipline drawings will be utilized for reference and coordination of review items specific to site and architectural design. In addition, all site permit applications (drainage, utilities, tree removal, etc.) and design calculations shall be provided for our review. The review will include a comment log, indicating the drawing, type of comment, and description of comment, in addition to a set of redline markup drawings for reference. The comment log and markups will be provided upon completion of the review. If support is required for additional reviews, backcheck of comments, or compliance to comments, additional fees will be requested. TR 13886 EXHIBIT 1 Fees The fees for our services will consist of a lump sum amount of Thirteen Thousand Two Hundred Twenty -Three Dollars ($13,223.00) broken down as follows. Third -Party Review $ 12,609.00 Project Management $ 414.00 Reimbursables $ 200.00 TOTAL FEE $ 13,223.00 We will bill you monthly for the percentage of services rendered and for any Reimbursable expenses. Any request for printing above the indicated amount will be billed as a reimbursable expense as allowed in the contract. Deliverables and Schedule Stantec will deliver a third -party review including drawing markups and a comment log to the City within 45 days of Notice to Proceed. The markups and comment log will include one (1) electronic file of the drawing markups presented in pdf format and one (1) electronic file of the comment log presented in excel format for the City's use as needed.
